CLEVELAND -- Cleveland City Councilman Zack Reed will spend time in jail for his third OVI conviction, but his sentence will not put his current seat on city council in jeopardy.
Judge Larry Allen sentenced Reed to 180 days in jail but suspended 90 of the days.
Reed will report to jail on September 25 to serve 10 days with another 60 days spent under electronic alcohol monitoring.
The judge will convene a hearing in two months to determine whether Reed is fully complying with his sentence. At that time, the remaining jail time may or may not be imposed.
In addition, the judge suspended Reed's license for two years and gave him two years probation with mandatory treatment.
Reed is already enrolled in a program with the Cleveland Clinic.
He must also perform 50 hours community service and pay a fine of $1,500.
Reed addressed the court before sentencing and accepted full responsibility for the incident. He says he hasn't had a drink since March and intends to continue to completely abstain from alcohol.
Reed was pulled over in March in downtown Cleveland at East 9th Street and Rockwell Avenue after police say he ran a red light and made an illegal turn.
Reed claimed during his trial that officers had smelled Listerine, not alcohol. He refused a breath test.
This marks Reed's third offense after previously being convicted of driving under the influence in 2005 and 2008.
Reed faces a primary challenge on September 10. Political insiders predict he will keep his seat on council.
