Cleveland: Bond set at $2 million for mother in son's death

CLEVELAND --  The mother charged in the death of her 3-year-old son faced a judge in court this morning. 

Judge Pinkey Carr set bond at $2 million for Camilia Terry.

The 20-year-old is charged with aggravated murder in the death of her child, Emilliano.  

During the brief arraigment which lasted only a few minutes, prosecutors gave more details on the injuries suffered by Emilliano.

Prosecutors described the child as having blunt force trauma to the  head and a skull fracture.  It is estimated the child had been dead five to seven days when his body was recovered at a trash facility on Monday night.

The medical examiner hasn't officially determined the cause of death.

Terry said little during the court appearance, except to answer a question from the judge, and looked down for much of the arraignment.

Judge Carr also ordered Terry to have no contact with her other children.

Terry initially told police Emilliano went missing from a Cleveland park on Sunday evening. However, the search soon led to a trash processing facility near Cleveland and turned up the remains of the child wrapped inside multiple trash bags.

The Cuyahoga County Medical Examiner has now positively identified the remains found at the trash processing facility as those of Emilliano.  The identification was made using DNA tests due to the decomposition of the body.  

A preliminary hearing in the case is scheduled for December 6.

CLEVELAND --  The Cuyahoga County Medical Examiner has positively identified the remains found in a trash processing facility on Monday as those of 3-year-old Emilliano Terry.

The medical examiner says the identification was made using DNA testing.

The cause and manner of death are still being investigated and will be released when tests are completed.

Emilliano's mother, Camilia Terry, 20, is being held on a charge of aggravated murder in the boy's death.  A judge has set her bail at $2 million and ordered her to have no contact with her other children.

Camilia Terry reported Emilliano missing from a park on Sunday.  The search and subsequent interviews with Terry led police to the trash processing facility outside Cleveland where the boy's body was found wrapped in trash bags.

Former President George H.W. Bush hospitalized

HOUSTON  --  Former President George H.W. Bush has been hospitalized in Houston for treatment of a lingering cough.

Methodist Hospital issued a statement Thursday saying the 88-year-old Bush has been in and out of the hospital recently for complications resulting from bronchitis.

The hospital says Bush is in stable condition and is expected to be released within 72 hours.

Bush's chief of staff, Jean Becker, told the Houston Chronicle the illness was not life-threatening but there had been concerns it could have developed into pneumonia.

Becker's office referred questions from The Associated Press to Bush's spokesman, who did not immediately respond to phone messages.

Bush's son, former President George W. Bush, has been among his visitors.

Cleveland: Mother charged in 3-year-old's death

CLEVELAND --  The mother of a 3-year-old found in trash bags at a Cleveland area garbage processing facility has been charged with aggravated murder.

Camilia Terry, 20, remains in police custody. She is due in court on Thursday at 8:30 a.m.

Terry was arrested Monday after the body of her son, Emilliano, was found inside three trash bags at a waste processing site. She initially had reported the child missing from a city park Sunday.

At a morning news conference, police formally announced the charge against Terry but added additional charges are likely as the investigation proceeds.

Commander Ed Tomba said while the remains were found inside multiple trash bags, the body itself was in tact.

Police have executed a search warrant at Terry's apartment on Buckeye but say they are still actively searching for the location where Emilliano died.  Officers are also reviewing surveillance video and talking to family members in an effort to establish a timeline to determine the last time anyone saw the little boy alive.

Although the remains have been tentatively identified as those of Emilliano, the medical examiner says DNA tests are still ongoing to positively identify the body.  Based on the decomposition of the body, the medical examiner says a visual identification was not sufficient.  Tests to determine the cause of death are also not yet concluded.  Results are expected possibly later this week.

Police say they are also reviewing social media postings made by Camilia Terry including posts about trying to adopt out Emilliano.

Camlia Terry was taken into police custody after officer's say they noted changes in her initial story about the boy's disappearance.

White House: Obama to meet Romney Thursday

WASHINGTON  --  The White House says President Barack Obama will meet privately Thursday with his vanquished rival Mitt Romney, their first face-to-face encounter since the election.

Obama promised in his victory speech on Nov. 6 to engage with Romney and consider his ideas.

The meeting comes as Obama and congressional Republicans negotiate a way out of automatic tax increases and deep spending cuts that have come to be known as the fiscal cliff.

Obama and Romney differed sharply during the campaign on how revive the economy. Obama called for higher taxes on the rich. Romney called for lower taxes on all.

The White House says the two men will meet in the White House's private dining room. There will be no press coverage.

Powerball jackpot grows to $550M

DES MOINES, Iowa --   The record Powerball jackpot just keeps rising. It now stands at $550 million after officials say brisk sales keep driving up the payout amount.

The jackpot was boosted to $500 million on Tuesday and raised again Wednesday morning to $550 million.

A winner taking the cash option would get $360.2 million before taxes.

The numbers are an estimate and could be increased again as the drawing nears.

Powerball officials say they now believe there is a 75 percent chance that the winning combination of numbers will be drawn Wednesday night.

Who will win the second-highest jackpot in Powerball's history and what could you buy with $425 million?

Eight months after a trio of ticket buyers split a $656 million Mega Millions jackpot to set a world lottery record, Powerball is now offering a life-changing fortune of $425 million.

Chuck Strutt, executive director of Multi-State Lottery Association, predicts there's about a 60 percent chance there will be a winner Wednesday, especially if there's a flurry of last-minute ticket purchasers picking unique numbers.

The jackpot already has defied long odds by rolling over 16 consecutive times without anyone hitting the big prize.

Strutt puts the odds at around 5 percent there will be no winner in the entire run, including Wednesday. As the drought increases, so too will the chances of it ending on the next draw, because ticket sales spike with a growing jackpot.

Tickets are currently $2 each. It's been said one has a better chance of being struck by lightning than winning the Powerball. But that woefully understates the danger of lightning.

Tim Norfolk, a University of Akron mathematics professor who teaches a course on gambling, puts the odds of a lightning strike in a person's lifetime at 1 in 5,000.

The odds of winning the Powerball jackpot: 1 in 175 million.

Kent State: Asst. professor learns in rubble of disaster

KENT -- Dr. Andrew Curtis at Kent State University has an office, but the one he does the most work in might be considered a disaster zone. It's not a knock on the cleanliness of his office, it's simply the truth.

Curtis, an associate professor of geography, just returned from his fifth trip to Joplin, Missouri.

The town was hit by one of the deadliest tornadoes on record about 18 months ago. He's also made several trips to Katrina-ravaged New Orleans, specifically the Lower Ninth Ward, to help every single one of us. 

He says to get the full-effect of the disasters and the recovery process he will probably go back for five years to get the "longitudinal" effect.

"We want to learn from what has gone on," he says. "The learning process is both the damage and all the way through recovery. So, this is a traumatic event, it's a terrible event, but we are going to get similar events like this and unless we learn from them, unless we collect data that allows us to go back and really analyze what happened, we are going to make the same mistakes again."

He's doing this by mounting small, sophisticated cameras on a car. They are equipped with GPS systems that allow Curtis, and his graduate student Adam Cinderich to carefully map neighborhoods and identify where recovery is taking place and pinpoint why some areas are able to recover more quickly.

Churches are one example, "the churches play a pretty big role in the community, so dependant on the strength of that existing role of church, if you are in an area, then it really plays an important part in the recovery," Curtis said.

Another goal, taking the information to policy makers. "(To) help spur that redevelopment and try and better direct where the resources should go -- because then we know if a community tends to build from the center out you can better work to make sure that happens on a larger scale," Cinderich explained.

Curtis says it also helps raise important questions that can unlock answers for rebuilding after future disasters. Things like, "is there a relationship between starting building spreading out, or maybe if you start early does it lead to problems when people don't return to those areas, so those are the sort of questions we can look at."

The idea behind the research is part science, health, safety and emotion, but all in the name of community. He is very passionate about sharing his research with anyone who is interested in it for learning purposes or even for nostalgia.

"The other aspect, which I think is important, is collecting the memories. Collecting the spatial patterns of what is going on in terms of where things happened, what happened before the event and collecting all those insights and those narratives and putting them into a map and basically keep creating an archive for them."

This information is also helpful to Sandy victims. Though the wounds are still very raw, what lies ahead for those affected is still difficult.

"In six months they are going to have experiences that are similar to people in Joplin or similar to people in New Orleans so if we can record, and sort of create a way that their experiences can be translated to another location then I think we can help with that support group of other disaster victims."

Police: Autopsy underway, mother in jail

CLEVELAND -- An autopsy is underway Tuesday to find out how and when 3-year-old Emilliano Terry died.

His mother, Camilia Terry, 20, was arrested Monday night and is in jail.

Once the autopsy is done, Cleveland police will obtain a search warrant to gather more evidence to take to the Cuyahoga County Prosecutor's office to determine what charges will be filed against her.

At 5:30 p.m. Wednesday, The Coalition for A Better Life/Peace in the Hood, Inc., in conjunction with The Task Force for Community Mobilization, The Peacemakers Alliance, community activists and friends, will hold a vigil and rally to "honor the life of 3 year old Emiliano N. Terry.

The park, at East 121st Street and Shaker Boulevard, is where his mother said Emiliano went missing.

The investigation began at 5 p.m. Sunday after Camilia called 911 to say that Emiliano disappeared from Kossuth Park.

The search continued as a possible abduction until police say the mother's story and statements became "inconsistent" and they began to look more closely at the mother and the neighborhood around her apartment.

Emiliano's body was found double-bagged in trash bags at the Waste Management trash processing plant in Oakwood late Monday afternoon.

Admitted bomb plotter appeals sentence

AKRON, Ohio -- One of the four men who pleaded guilty in a failed plot to bomb a highway bridge in Ohio has appealed his nearly 10-year sentence.

The attorney for 21-year-old Brandon Baxter of Lakewood filed the appeal Monday with the 6th U.S. Circuit Court of Appeals in Cincinnati.

The other two defendants sentenced last week in Akron also plan to appeal. Their attorneys say the men deserve leniency because they were entrapped by an FBI informant who provided a dud bomb device.

A fourth defendant is considering withdrawing his guilty plea if he doesn't get the lenient sentence offered in return for his cooperation.

A fifth defendant is undergoing a psychiatric exam.

Prosecutors described the defendants as self-proclaimed anarchists who acted out of anger against corporate America and the government.

Maple Hts: One dead after shooting on Rochelle Drive

MAPLE HTS -- Police are investigating a shooting that left one man dead.

It happened around 2:30 a.m. Sunday morning on Rochelle Drive.

Marion Alexander Sr., 26, of Cleveland, was shot multiple times and was taken to Marymount Hospital where he died.

Alaxander was at a party on Rochelle Dr. where a fight broke out and shots were fired. He was bleeding and found lying on the ground.

Police  have taken three people into custody. No charges have been filed at this time.

Cleveland Councilman Eugene Miller Arrested

CLEVELAND -- Cleveland Police have arrested Cleveland City Council Member Eugene Miller.

Miller was driving on Route 2 near South Marginal road when police caught him speeding.

Officers arrested Miller for OVI and speeding.

It is unclear how fast the Councilmen was traveling at the time of arrest.

Miller will be in Cleveland Municipal Court Monday, November 26th at 8:30 a.m.

It will be a cold,windy and sometimes snowy day across Northeast Ohio.

Temperatures will only reach into the 30s during the daytime with 20s at night. Winds are expected to be out of the Northwest at 15- 25 mph, with gusts as high as 30 mph.

And after snow showers yesterday, expect more today. Most will see a light dusting, but eastern Cuyahoga, Lake, Geauga, Ashtabula, and Trumbull counties could receive an additional 1-4 inches of snow.

Buckeyes-Michigan: The 'Clash for Cash'

WESTLAKE -- Dick's Sporting Goods at Crocker Park in Westlake turned from Black Friday to 'Scarlet and Gray Day.'

The Buckeyes section of souvenirs was filled with shoppers getting ready for the game against Michigan.

Mosquito Lake: One person missing after boat capsizes

TRUMBULL --  One person is missing after a boat capsized on Mosquito Lake.

The Trumbull County Sheriff's Office tells Channel 3 that the boat flipped sometime around 6:30 a.m.

Three people were on the boat. Deputies were able to save two of the victims.

Divers and Cadaver dogs are canvassing the lake for the missing person.

Sheriff: Two arrested in Thanksgiving Day murder

WINDHAM -- Portage County Sheriff David W. Doak confirmed that about 4 p.m. Thursday, sheriff's department detectives were requested to assist Windham Village Police in the investigation of an alleged homicide that had occurred.

Police identified the victim was identified as Blake A. Wolfe, 37, of Windham.

Wolfe was discovered in his home and police suspected foul play.

Detectives and the Ohio Bureau of Criminal Investigation responded and processed the scene.

Early Friday morning, detectives arrested and charged Thomas W. Walters, 42, of Shalersville Township, and Traci Y Wolfe, 40, of Paris Township, with aggravated murder.

Traci Wolfe is the estranged wife of Blake Wolfe., according to the sheriff's department.

Both Thomas Walters and Traci Wolfe are currently being held at the Portage County Jail without bond and both will be arraigned at 1:15 p.m. Monday at the Ravenna Courthouse.

The investigation is ongoing and the cause of death is yet to be determined.

An autopsy is scheduled to be preformed today (Friday) at the Summit County Medical Examiners Office.

Westlake: Someone draining Westlake man's ATM

WESTLAKE -- Police hope you can identify this man who is suspected of draining a Westlake man's ATM account of $2,500 plus ATM fees.

The Westlake man's debit card never left his wallet but the suspect somehow got accessand five withdrawals were made Oct. 18-23 in Youngstown, Salem, and Alliance.

The photo is from Oct. 19 at a First National Bank ATM in Youngstown.

His bank has credited the Westlake man's account for the losses, but police would like to identify and arrest the suspect.

Any tips can be phoned into Westlake Police Department to the attention of Officer Smith at 440.871.3311.

The trot stepped off at The Galleria on East Ninth Street.

The motto for today's race? Unleash your inner turkey.

Increasing Cloudiness Thursday night.  Breezy & Mild.  A few showers possible after Midnight.  Low: 48.  Wind: South 10-15 mph.

"BLACK FRIDAY", a Cold Front slices through the region.  It will be Cloudy & Windy with Rain likely in the morning.  Then behind the Front in the afternoon, there will be a slot of dry air, giving us a Partly Sunny, Windy afternoon with only a few scattered showers.  We'll have a High of 48 early in the day, with temperatures falling through the 40's in the afternoon.  Wind: West 15-25, gusts-35 mph.

Akron: Man withdraws guilty plea in bridge bomb case

AKRON -- One of the men accused in the plot to bomb a Brecksville bridge earlier this year has withdrawn his guilty plea.

As a result, Anthony Hayne, 35, will be back in court on Nov. 30 for the government to be able to respond to the plea change.

Hayne, who was scheduled to be sentenced Wednesday morning, filed the request to change his plea late Tuesday night.

The plea change request is conditional on whether Hayne gets a more lenient sentence than his co-defendants.

"24 hours from yesterday until today is probably not enough time to compare what happened yesterday to what should happen to Mr. Hayne," said his attorney Michael O'Shea.

O'Shea says Hayne's plea deal in return for cooperation could still mean a longer sentence than the eight-to-11-year terms handed down Tuesday to three co-defendants. 

All three pleaded guilty after Hayne, but without plea deals promising cooperation. Those three were collectively sentenced Tuesday to nearly 30 years behind bars.

Doug Wright, 27, the alleged ringleader, was given 138 months, or more than 11 years in prison, for his role in a failed plan to blow up the Route 82 bridge in April.

Brandon Baxter, 20, was sentenced to 117 months, nearly 10 years, for his role.

Connor Stevens, 20, was sentenced to 97 months, about 8 years, in prison. All three defendants will undergo substance abuse treatment and face lifetime supervision upon release.

"I think if the sentences of the three defendants who got sentenced yesterday stand on appeal, my client's [Hayne's] should be significantly less than theirs in light of his significant cooperation," said O'Shea.

Each sentence was more than the minimum required, but far less than the government recommended for each defendant.

Judge David Dowd stuck to the opinion he shared last week to sentence the group as terrorists, making them subject to harsher sentences.

Supporters of each defendant discussed the government's role in the case using an undercover FBI informant to sell fake explosives to the group. Witnesses referenced the defense's original position that this case involved entrapment.

A fifth suspect, Joshua Stafford, is undergoing psychiatric evaluation.

Akron: Three men sentenced in failed bridge bomb plot

AKRON - Three men convicted in a plot to bomb a Brecksville bridge will serve nearly 30 years collectively in federal prison.

Judge David Dowd sentenced Doug Wright, the alleged ring leader, to 138 months, or more than 11 years in prison, Tuesday morning for his role in a failed plan to blow up the Route 82 bridge in April.

Brandon Baxter, 20, was sentenced to 117 months, nearly 10 years, for his role.

Connor Stevens, 20, was sentenced to 97 months, about 8 years, in prison. All three defendants will undergo substance abuse treatment and face lifetime supervision upon release.

Each sentence was more than the minimum required, but far less than the government recommended for each defendant.  Judge Dowd stuck to the opinion he shared last week to sentence the group as terrorists, making them subject to harsher sentences.

Wright, 27, apologized to everyone affected by his actions. He said he was under the influence during most events in the plot, but he takes full responsibility for his actions.

Baxter had tears in his eyes while speaking to the court, acknowledging if the explosives were real, there could have been many victims. "This would have been a benefit to nobody and only a detriment to society and communities in that area," he said.

Stevens called the act the worst decision of his life, accepting responsibility for what he calls, "a foolish risk to life, an act of blind violence."

Stevens said he was in an emotionally distraught state, drinking excessively and using other drugs in April.

"I'm working on forgiving myself for this heinous act, and ask that the people of Brecksville and this court work on forgiving me as well," said Stevens.

Supporters of each defendant discussed the government's role in the case using an undercover FBI informant to sell fake explosives to the group. Witnesses referenced the defense's original position that this case involved entrapment.

"My son is guilty and so are you," said James Stevens, Connor's father. "The government is guilty. It's both your faults."

Anthony Hayne, who cooperated with federal prosecutors, is set to be scheduled Wednesday morning.

A fifth suspect, Joshua Stafford, is undergoing psychiatric evaluation.

Better Ohio holiday retail sales expected

CINCINNATI  --  Economic forecasters say Ohio's rebounding economy and jobs picture mean a brighter holiday sales outlook for the state's retailers.

A University of Cincinnati Economics Center forecast projects a 4.2 percent increase in sales for November and December this year, over last year.

Forecasters say consumer confidence is up while consumer debt is down, and note that Ohio's unemployment rate has also fallen from double digits during the Great Recession to below 7 percent.

The researchers say the biggest uptick will be in the important Columbus metro market, with sales expected to rise 7.5 percent for the holiday period.  A 3.5 increase is predicted for Cleveland.

They say possible drags on holiday spending could come from concerns about gas prices and the federal "fiscal cliff" looming without a deal on expiring tax cuts and automatic spending cuts.

Autism study: Pregnant women who had flu, fever

CLEVELAND -- For years, the medical community has been trying to figure out why there is an increase in autism.

So far there are many theories, but no concrete answers. But every clue, scientists say, will eventually lead to a cause and possibly a cure.

Now doctors are looking at a possible link between pregnant women getting the flu and their children developing autism. Abdulla Ghori, a pediatrician at MetroHealth, discusses the news study.

This Advisory has been issued for Ashtabula, Cuyahoga, Geauga, Lake, Lorain, Medina, Portage and Summit Counties.

The advisory will be effective from Sunday, November 18, 2012 through Tuesday, November 20, 2012.

High pressure over Northeast Ohio along with temperature inversion conditions will result in haze and fine particle pollution. Breathing fine particles can aggravate asthma, bronchitis, and other chronic lung diseases.

Air quality levels will be 'unhealthy for sensitive groups' during peak periods.

Northeast Ohio charities need help to help others

CLEVELAND -- It is a growing concern among many of the Northeast Ohio charities -- families going hungry.

"We want anyone that needs help this Christmas season to come to the Salvation Army on Monday," said Major Lurlene-Kay Johnson, with the Salvation Army.

The Salvation Army expects over 3,000 families to sign up for their Christmas Assistance program on Nov. 19 in Cuyahoga County alone.  

"We are seeing more and more people come in from the suburbs, in fact, the suburbs are seeing a 75 percent increase of people living below the poverty level," the Major added.

At least 1 in 4 children are at or below the poverty line here in Cuyahoga County. The Salvation Army wants to raise at least 25,000 toys to give to those children.

Mike Holmgren and the Cleveland Browns have also seen the need to help. They have jointly donated $20,000.00 to the Salvation Army to help the needy.

But there is a greater need, the need for food. The federal government is slashing food benefits this year and the cuts will be deep.

It is because of last year's winter was mild and electrical power bills were so low. The government uses a formula based on utility bills and, come January 90,000 local families could lose up to $50 a month in food stamps.

It is a thought Anne Goodman, the President and CEO of the Cleveland Foodbank, can't live with.

"I think about those children who will not grow appropriately without proper nutrition and when I think of the problem getting worse, it breaks my heart. With cuts like these, I don't know how we are going to do it. Real families, real children are going to be directly impacted by this soon."

More and more families are hurting financially and a bigger burden will be placed on local food banks.

According to Michelle Hilton, with the Akron-Canton Regional Foodbank, an eight-county area could lose up to $120 million annually, bringing the need to donate to an all-time high.

"At the rate we are going, we are going to be falling behind and we have a community that needs to help us to make sure that we don't fall behind." Goodman adds.

Frank Russo reports to federal prison

Former Cuyahoga County Auditor Frank Russo has reported to the Federal Correctional Institution in Lorreto, Pennsylvania. 

Russo arrived just after 11 a.m. 

When he'll walk out a free man is anyone's guess.

That's because Russo's work isn't done yet.  Russo, who testified against his former partner in crime, Jimmy Dimora, is still scheduled to testify again, this time against attorney Anthony Calabrese III in February. 

Calabrese is a Cleveland attorney indicted on multiple corruption-crimes and racketeering. Russo is facing 22 years but it's not set in stone. 

U.S. District Court Judge Sara Lioi could agree to reduce his sentence for his cooperation with prosecutors, but that won't be decided until maybe after he takes the stand against Calabrese in February. 

Until then, Russo will live alongside 1,300 other prisons in a small room where it'll cost us taxpayers about $73 a day.

Hill leaders voice confidence in fiscal cliff deal

WASHINGTON --  Congressional leaders are expressing confidence they can reach a deal with President Barack Obama to head off the "fiscal cliff" and the risk of a new recession.

The top members of the House and Senate spoke at the White House after a closed-door session with Obama. At issue is a series of tax increases and spending cuts that could undermine the economy and slow job creation starting Jan. 1.

House Speaker John Boehner and Senate Minority Leader Mitch McConnell both said they offered higher tax revenue as part of a deal. Boehner said he outlined a framework that is consistent with Obama's call for a "balanced" approach of both higher revenue and spending cuts.

Senate Majority Leader Harry Reid said, quote, "We all know something has to be done."

Gov: Ohio won't set up state health care exchange

COLUMBUS -- Ohio won't set up its own health insurance exchange, but is instead opting for a partnership with the federal government to run the new insurance market.

Republican Gov. John Kasich wrote in a Friday letter to the Obama administration that states lack flexibility to build and manage their own exchanges and that setting them up is too costly. He also said that regardless of who runs an exchange, the end product is the same.

Kasich's administration has indicated for months that Ohio was leaning in this direction. State officials have noted their continued misgivings about the federal health care law, including what they say is a lack of information.

Kasich says Ohio will continue to regulate the health insurance market, oversee health plans, and make decisions around Medicaid eligibility.

Bond set at $2M for Jackson Township coach

MASSILLON -- A judge set bond at $2 million for a Jackson Township coach charged with placing video recording devices in a boys' locker room turned toward the shower area.

Scott D. Studer, 46, faces eight counts of the illegal use of a minor in nudity-oriented material. He's being held in the Stark County Jail.

Police say the cameras were placed in the locker room over an eight-year period. A search of Studer's home led to authorities confiscating a DVD, flash drive and laptop computer.

Studer has been a coach for more than two decades. He has resigned his position with the district and his coaching job.

Parents, some of them angry, met with officials on Wednesday.

FDA probing if deaths were linked to energy drinks

WASHINGTON  --  The Food and Drug Administration is investigating reports of 13 deaths of people who took so-called "energy shots" marketed as 5-Hour Energy.

The agency says it has received 92 reports about the product, including 33 hospitalizations and 13 deaths. In a statement, FDA officials say they will take action if they can link the deaths to consumption of the energy drink. Such action could include forcing the company to take the drinks, often found at convenience store checkout counters, off the market.

The FDA cautions consumers that products labeled "energy shots" and "energy drinks" are not alternatives to sleep and that anyone thinking about taking them should consult with a health care provider.

The New York Times first reported that 13 deaths were linked to 5-Hour Energy.

Cleveland: Woman completes sidewalk sign sentence

CLEVELAND -- Under advisement from her attorneys, Shena Hardin didn't say anything this morning as she started Day Two of her sign-holding-sentence.

Unlike the first hour of her two hour sentence, she didn't smoke or text or talk on the phone. She stood quietly with music blaring from her ear buds.

Hardin was sentenced to spend two hours on two separate days holding a sign that read "Only an idiot would drive on a sidewalk to avoid a school bus."

Hardin was captured on cell phone video driving up on a sidewalk and around a bus loading special needs children. Neighbors say she did it multiple times before they were able to show police proof and have her charged.

Hardin's crime is only a misdemeanor. She would have only paid fees so the judge added the sign portion of the sentence to send a message to Hardin.

Tuesday Judge Pinkey Carr took issue with the way Hardin served her sentence, smoking, texting and talking and not even holding the sign as she was ordered.

Carr planned to go out to East 38th & Superior where Hardin was ordered to serve her sentence but changed her mind Wednesday morning, saying she didn't want to create a scene.

Judge Carr told WKYC that she believes Hardin will never drive on the sidewalk again.

One spectator took issue with Judge Carr's sentencing order, and the fact that the word idiot was on the sign. So a man named Archie from a new local radio station spent the morning with her wearing a sign taped to his shirt with the word idiot on it.

Hardin explained to Archie, who asked Hardin to apologize to the family of the little girl whose safety was jeopardized by her actions, that she would not apologize in front of the media; that she would talk to the family in due time, and she owed the media nothing.

"I am just going to serve this sentence and get on with my life, like you all should do a long time ago," Hardin said.

While the sign holding portion of her sentence is complete Hardin still doesn't have a license. She is ten days into her 30 suspension.

Acupuncture used in treating ADHD

INDEPENDENCE -- The ability to focus and tune out distraction can be challenging for anyone. But for children and adults with ADHD, it is a daily, frustrating battle.

Medication and behavioral therapy are traditional methods of treatment. Now, an alternative form of medicine with ancient roots is being used to ease the symptoms of ADHD.

A recent study by the Mayo Clinic finds that seven and a half percent of all school-age children are affected by ADHD. And symptoms vary from child to child.

Some may struggle with focus, distractibility, impulsivity, hyperactivity, or a combination of them.

"Western medicine looks at ADHD as a brain dysfunction, a brain chemistry dysfunction," says licensed acupuncturist Allison Bower.

"Eastern medicine looks at ADHD as the organ functions are malfunctioning, then causing the brain function to be off."

Licensed for more than 20 years, Bower sees both children and adults with ADHD, and says for them acupuncture is a complimentary form of medicine.

It works well in addition to other treatments, such as behavioral therapy and nutritional plans. Acupuncture is based on the theory that the body's energy or "qi" flows freely when you are well. But, it can become blocked or weakened.

Inserting hair-thin needles into the skin at specific points helps to restore that positive energy flow.

"So if we can balance the energy, or the qi, of the organ systems in the body, then the brain chemistry can adjust," Bower explains.

Acupuncture can help calm the disruptive nature of Attention Deficit Hyperactivity Disorder (ADHD), and it can also help to ease the side effects of the medications used to treat ADHD.

Gabrielle Belli was diagnosed with ADHD at age 11.

"Distractibility has always been sort of an issue," she admits. Impulsivity is also a problem, in addition to social anxiety. That's not uncommon.

ADHD is often coupled with other disorders ranging from social anxiety to depression, or facial tics.

"ADHD often does not fly solo. It flies along with some anxiety or some depression. So we know that if acupuncture speaks to those conditions, it will most certainly speak to ADHD," according to Jill Zupon, Founder and Executive Director of The Attention Center, the Independence facility devoted solely to the care of children and adults with ADHD and ADD.

In addition to testing, therapy, nutritional services and coaching Zupon saw the benefits of acupuncture and brought Bower on board.

"We are not a center that provides homeopathic medicine. But we knew that it would be a good alternative to those who didn't want to be medicated," Zupon explains.

Belli tried medication, but found it didn't work for her. She came to The Attention Center for help managing her ADHD. When she heard they also offered acupuncture, Belli decided to give it a try.

"I felt more like myself than I had probably in a whole year. So it was just the biggest relief," Belli claims.

We went with Gabrielle on a day she visited Bower. Home from Ohio University, she hadn't received acupuncture in about two months. She had lost two sets of keys in recent weeks, and says she struggled with her organization and thought processes.

For Gabrielle, the benefits of acupuncture she says are almost immediate.

"I can really tell. I speak different, my attitude is different," she tells us.

As the session begins, Allison and Gabrielle are seated at a table. Allison asks Gabrielle a series of questions first, are pertaining to her health, physical and emotional well-being. Once finished, Gabrielle lies down on the table, while Allison takes a series of six different pulses in each of her hands.

Using information gained there, Allison places four needles in each of Gabrielle's ears. Then, as needed she also places needles in points on Gabrielle's arms, hands, legs and feet. Once in place, Gabrielle rests quietly, and undisturbed for about 20 minutes.

"I am centered. I am thinking clearly. I am organized," she says.

Auricular (ear) acupuncture is often used either alone or in combination with body acupuncture. Since the ear is stimulated through a non invasive procedure, it is preferred in children.

Acupuncture can help to calm the impulses that make it hard to stay still. It can also work to improve concentration and bolster the immune system and energy of the patient which can address both the sluggishness commonly associated with ADD patients and hyperactivity commonly seen in patients with ADHD.

Zupon believes a transformation takes place from the time that a client walks into Allison's office, to the moment they walk out.

"We get to see someone go in one way and come out another way. It's wonderful," Zupon said.

Acupuncture in the management of ADHD is still relatively new. Currently, there is no scientific proof to support its benefits. But patients like Gabrielle believe it has made a difference in their lives.

As we mentioned, she does not take medicine. But patients who do, say that the acupuncture can help alleviate common negative side effects of the drugs such as appetite supression, sleeplessness and dry mouth.

In a perfect world, Gabrielle says she would like to get treatment every other week. But she must work it around her visits home from school. Treatment is different for each person. Some people need it every week, others go every other week, or every few months.

And most insurance plans don't cover it. An initial visit typically costs a bit more, but regular visits are roughly $65 to $75.

What does the fiscal cliff mean for debt reduction?

WASHINGTON, D.C. -- The economists agree that if the country drives off that metaphorical fiscal cliff a recession is soon to follow.

But what if the cliff is avoided by delaying measures to start paying down the estimated $14 trillion national debt?

"The fiscal cliff is a lot of deficit reduction over a short period of time but what we really want is a lot of deficit reduction over a long period of time. If you do it too quickly the economy is harmed tremendously.

"We would fall into a recession during the first half of 2013 and we don't want that because the recovery is happening very slowly, so what we would prefer instead is a longer term deficit reduction because that would help the economy both in the short term and help boost economic growth over the long term," said Joshua Gordon of the non-partisan Concord Coalition.

"The real goal is to slow how much debt we take on, to make sure that we are not taking on more and more debt every year at a faster rate than the economy grows and if we can stabilize that and not take on more debt than the economy growth can keep up with.

We're okay with that stabilization.

"Over the long term you can maybe worry about reducing our level of debt but really what's important is stabilizing it so that it keeps at about the same level as a percent of the economy," Gordon told 9News.

"If the deficit keeps getting larger and our debt keeps growing the way it's projected to under current policies, at some point we will have a major economic crisis because we will not be able to borrow money on the open market, the economy will collapse and it will be even worse than the recession we currently find ourselves in," Gordon said.

Ohio executes man for Akron woman's murder

LUCASVILLE --  Ohio has executed a condemned killer who said he was innocent of stabbing a woman 138 times, slitting her throat and cutting off her hands.

Lucasville prison warden Donald Morgan on Tuesday announced Brett Hartman's time of death as 10:34 a.m.

His last words were, "I'm good, let's roll."

Hartman was sentenced to die for the Sept. 9, 1997 killing of 46-year-old Winda Snipes in Akron.

The 38-year-old Hartman acknowledged he had sex with Snipes early that day, then went back to her apartment where he said he found her body, but always denied killing her.

Numerous courts rejected his claim and the Ohio Parole Board three times denied him clemency, citing the "overwhelming evidence" of his guilt.

Hartman's attorneys say no court ever heard the full story of Hartman's troubled childhood.

Kent State issues advisory for man exposing himself

KENT, Ohio -- Kent State University Police issued an advisory Monday morning, warning the community about a man exposing himself outside of residence halls.

An unidentified man, about 40 to 50 years old, reportedly exposed himself outside of Centennial Court Residence Halls at about 1:15 a.m. Monday on the KSU campus.

Police say the man appeared to be caucasian, with brown hair, wearing a blue button-down shirt.

Anyone with any information to report should call Kent State Police at (330) 672-2212.

Warren: One dead after Sunday morning shooting

WARREN, Ohio -- Police are investigating a shooting that left one person dead and another person to the hospital Sunday morning. The shooting happened near Elm Street NE and Elm Court.

It happened in an alleyway next to Cuddles Hugs and Kisses Daycare.  Det. Sgt. Jeff Cole said the owner of the daycare has been notified.  "She has concerns... fortunately, it's a Sunday," said Sgt. Cole. 

Police say two victims were taken to the hospital after being shot near the parking lot of a day care center in downtown Warren.

Metro Health Medical Center confirmed that one of the victims, 32-year-old Marco Dukes was transported to Metro where he died of his injuries.

The other man shot was Larry Smith.  A good samaritan named Jackie was on her way to church and stopped to help Smith.  She says he was shot in the chest. 

According to police, there's a possibility there may be other victims who left the scene on their own.

Two people were taken into custody for questioning in relation to the incident.

Investigators continue to canvass the scene and continue to gather information at this time.

The day care center was closed at the time of the shooting.

Vigil held for woman whose home destroyed by blast

GREENWOOD, Ind. -- A vigil has been held for a suburban Indianapolis teacher whose home was destroyed in an explosion that ripped through her neighborhood.

Two people were killed in the explosion Saturday night. Officials have not released their names. However, a candlelight vigil was held at Greenwood's Southwest Elementary School on Sunday night for second-grade teacher Jennifer Longworth. 

She and her husband, John Dion Longworth, lived at a home destroyed in the blast. WTHR-TV reports that friends, family and colleagues of Jennifer Longworth gathered at the school.

Superintendent David Edds says the Greenwood schools will open two hours late Monday so staff can prepare for how they will talk to students about what happened.

Officials say as many as 31 homes were damaged so badly that they may have to be demolished.

Deputy Code Enforcement Director Adam Collins estimated the damage at $3.6 million.

Deputy Fire Chief Kenny Bacon told reporters Sunday investigators haven't ruled out any possible causes of the late-night blast that was heard miles away.

But a congressman who represents the Indianapolis neighborhood says investigators have ruled out a bomb or a meth lab.

U.S. Rep. Andre Carson said he had received that report from Homeland Security officials during a tour of the devastated middle-class subdivision.

Residents described a loud boom that shook their homes, blew out windows and collapsed ceilings.
