The Great Lakes Science Center Celebrates "New Year's Eve-Eve"

CLEVELAND -- Most of us are getting ready to ring in 2013. And that means we're planning new year's EVE celebrations, but what about New Year's Eve-Eve?

The Great Lakes Science Center will hold their "New Year's Eve-Eve" party Sunday night from 7 p.m. until 11:30 p.m.  Tickets are $24 for general admission and $20 for members.

Between the Lines: FitzGerald discusses his/county's future

Cuyahoga County Executive Ed FitzGerald is keeping people guessing about whether or not he will challenge Governor John Kasich in 2014.

He's  travelled the state and challenged Kasich on several issues.

But FitzGerald and Governor Ted Strickland are still debating whether or not each will run. Former Attorney General Richard Cordray may still be in the picture too.

What's FitzGerald's latest thinking? What will be the deciding factorfor him?

FitzGerald's starting his third year in charge of Cuyahoga County's reinvented government.

Recently, he's cut a tentative deal to sell the Ameritrust Tower and build a new home for county government.

He's proposed giving all Cuyahoga County kindergarteners $100 to start a college savings fund.

He's announced big tenants and events lined up to launch the new Medical Mart and Convention Center next year.

He's trying to rally support to have Cleveland bid to host a 2016 political convention.

Flying high: Akron-Canton airport breaks record

NORTH CANTON -- The deals are always flying by at Akron Canton Airport. Now more than ever, people are taking notice. 

For the past three years, they've continued to break their own records on the amount of customers serviced.  Business is up 11 percent from last year. 

Cleveland native Jennifer Johnson flies CAK.

"It's smaller but you can get through everything a lot quicker than Cleveland Hopkins," said Johnson. "Once AirTran started docking its station ,that's when I started going."

Turns out, a lot of people are getting to where they want to go from Akron Canton.

The 11 percent increase in traffic is greatly attributed to their low fares.

"Our average fare is $100 less than Hopkins, maybe $40 to $50 less than from Pittsburgh or Columbus," said VP of Marketing Kristie VanAuken.

For passenger Bradley Lemmon, it's all about convenience.

"This is closer, shorter drive... we walked all the way in, checked our bags ready for our flight," said Lemmon. 

This year, about 1.8 million customers have flown in and out. Their traffic alone has sustained and created jobs throughout the hub. 

For instance, Southwest Airlines "jumped from about 40 employees to 75, so nearly a 100 percent increase for people for Southwest Airlines here," VanAuken said.

Cleveland Weather: Snow moving in

A storm system passing to our south this morning is producing snow showers, light to moderate, across our area this morning.

We will likely see anywhere from 1 to 4 inches of snow across the area from this storm, with the heaviest snow south. It will be make for some slick and slippery road conditions at times.

A winter weather advisory has been issued by the National Weather Service office in Pittsburgh for Tuscarawas and Carroll counties.

There are currently no advisories for the rest of northern Ohio, which is covered by the NWS office in Cleveland because in order to meet the criteria for a winter weather advisory, 4" of snow needs to fall in 12 hours ... we'll be just below that.

The snow will taper off in the early afternoon, but then lake effect sets up for the snowbelts. Another 2" to 4" is possible overnight Saturday into Sunday (heaviest accumulations will happen if we can get some bands set up).

Scattered snow, courtesy of the Lake, will continue into early Sunday before dissipating.  Otherwise Sunday looks lovely ... good day to visit the local ski slopes, toboggan shoots, cross-country skiing trails and the car wash!

The last day of 2012 (Monday) starts off fine and dandy, but later in the day snow will develop.  That snow is expected to stay with us for the start of 2013.

Much colder air will be coming our way next week.

Saturday: Cloudy with snow showers likely.  1" to 4" for the entire area.  Low 30s (additional lake effect snow Saturday night in the belts)

Sunday: Flurries linger east, otherwise partly sunny. Near 30

Monday: Partly sunny. Snow showers develop late.  Low 30s

New Year's Day: Cloudy with snow showers likely. Upper 20s

Wednesday: Partly sunny. Mid/upper 20s

Thursday:  Mostly cloudy with scattered snow showers. Cold and windy. Mid 20s

Friday:  Very cold with a chance for lake effect snow showers east.  Highs only near 20!

Akron: 'First Night Akron' New Year's Eve

Cuyahoga County: 3 attorneys indicted on bribery charges

CLEVELAND -- Attorneys Anthony Calabrese III, Marc Doumbas and G. Timothy Marshall have been indicted on bribery charges, Cuyahoga County Prosecutor Timothy McGinty announced Friday.

Between April 19, 2012 and Nov. 6, 2012, it's alleged that Attorneys Anthony O. Calabrese, III, 40, of Bentleyville, Marc G. Doumbas, 44, of Westlake, and Giles Timothy Marshall, 63, of Olmsted Falls, attempted to bribe two separate rape victims in a pending criminal case.

The alleged bribe sought to change the victim's testimony in exchange for $150,000 in cash, including a $6,000 finder fee.

Friday's indictment is part of the ongoing Cuyahoga County corruption probe.

Investigators executed a search warrant at Calabrese's Bentleyville homen Dec. 18, where additional evidence was obtained. 

At approximately 7 p.m. Thursday, Calabrese turned himself in to the Bentleyville Police Department after learning of his arrest warrant.

He is currently being held in the Cuyahoga County Jail.

FOX Sports acquires SportsTime Ohio

LOS ANGELES and CLEVELAND -- FOX Sports Media Group and SportsTime Ohio today announced an agreement that calls for FOX Sports to acquire SportsTime Ohio, the Cleveland-based regional sports network that has been offering local telecasts of Cleveland Indians games for the past seven seasons.      

In addition, FOX Sports Media Group announced that it has secured the exclusive long-term local telecast rights for Indians baseball, ensuring that the Indians will once again be part of the FOX Sports portfolio of regionally televised hometown teams.  Prior to the 2006 season, Indians games were locally televised by FOX Sports Ohio.

FOX Sports Ohio serves more than five million homes throughout the state of Ohio, as well as portions of Kentucky, Indiana, western Pennsylvania, western New York, and West Virginia.  FOX Sports Ohio is the exclusive regional TV home of the Cincinnati Reds, Cleveland Cavaliers, Columbus Blue Jackets, Columbus Crew, Xavier Musketeers, and Cincinnati Bearcats.

SportsTime Ohio also offers other locally relevant sports content, including Cleveland Browns programming, OHSAA football and basketball playoffs and championships, and Mid-American Conference events.

Judge: Relatives' conversations in T.J. Lane case admissible

CHARDON -- A motion to suppress conversations held by T.J. Lane's relatives in a police interrogation room have been denied.

Lane's relatives testified earlier this month that they were unaware of taped surveillance of their conversations in a police interrogation room.

In a written statement, Judge David Fuhry says "there is no reasonable expectation that conversations outside the presence of police officers will be private when they are conducted in what is obviously a police interrogation room."

According to the court, the exception to this instance is when police assure the participants their conversations are private.

Judge Fuhry also states that the Lane family members "voluntarily submitted to questioning" and "should have known that this was an interrogation room and not a private area where private conversations can take place. They knew that a family member was suspected of a serious crime."

Lane, 18, is charged in the shootings that left three students dead and three others injured at Chardon High School in February.  He is being tried as an adult and faces a maximum life sentence without parole if convicted.

Orange: Hotel shooting sends woman to hospital

ORANGE -- A suspect is in custody at the Orange Village police department and is being questioned regarding an incident this morning where a woman was reportedly shot.

A source tells Channel 3 news it appears to be a carjacking gone bad, but that hasn't been confirmed by police.

LifeFlight was also called to the scene and transported a woman to an area hospital.

Witnesses say the incident took place in the parking lot of a Courtyard Marriott hotel. 

The suspect then ran across the street, where he was taken into custody in a wooded area behind Fairfield Inn Hotel and Suites after being tracked by police K-9s.

Police have focused some of their resources on a blue Toyota in the parking lot at Courtyard Marriott.

Neighboring departments, including Solon, Beachwood, and Woodmere, also responded to the scene with K-9 units.

Multiple hotels on Orange Place were placed on lockdown at the time of the search.

Thursday's Snow Showers, tapering off in the afternoon.  A little Freezing Drizzle is possible. Breezy & Cold. High: 33.  Wind: NW 10-15 mph.

Cloudy, Windy & Cold with a few Flurries Thursday night.  Low: 20.  Wind: West 10-15 mph.

Friday will be Mostly Cloudy & Chilly.  High: 32.  Wind: SW-5 mph.

Friday night will be Cloudy with a few late night Snow Showers.  Low: 26.  Wind: South 5-10 mph.

Saturday, another Low Pressure system will push up from the Gulf Coast, but unlike Wednesday's storm, this Low will not be as strong, nor will it have as much moisture to use.

It will bring us a Cloudy Saturday with a few Snow Showers, but most of the moisture will pass well to our southeast.  High: 33.  Wind: West 5-10 mph.

Sunday will be Mostly Cloudy & Cold with a few Snow Showers.  High: 30.

Monday.....the last day of 2012....will be Mostly Cloudy & Chilly.  High: 33.

It should be Cloudy, Cold, Quiet & Dry for New Year's Eve.

2013, New Year's Day, Tuesday, will be Mostly Cloudy with some light snow showers possible.  High: 32.

Cleveland: City to update review of fatal police-involved shootings

CLEVELAND -- A press conference will be held at 1:30 p.m. today to give an update on the city's review of the Nov. 29 incident in which police killed two people after a pursuit.

Mayor Frank Jackson, Public Safety Director Marty Flask and Chief of Police Michael McGrath will be on hand at the City Hall press conference.

During the incident in question, 13 officers fired a total of 137 rounds at two people inside a vehicle after a chase that lasted more than 20 minutes.

Those inside the vehicle -- 43-year-old Timothy Russell and 30-year-old Malissa Williams -- were shot multiple times and pronounced dead at the scene.

Cleveland Weather: Wicked Wednesday

The snow is falling and the wind will be increasing this afternoon.  Roads are already becoming snow covered and slick.  Temperatures will be nearly steady near 30.

A BLIZZARD WARNING has been issued for:  Lakeshore Ashtabula, Lake, Cuyahoga, Lorain, Erie, Huron, Sandusky and Ottawa counties from 11AM Wednesday to 7AM Thursday.  (Blizzard warning criteria are: wind greater than 35mph and visibility less than 1/4 mile for 3 or more hours.)

A WINTER STORM WARNING goes into effect for the rest of northern Ohio from 7AM Wednesday to 7AM Thursday. 

PLEASE - Don't get caught up in the technicalities of a blizzard warning versus a winter storm warning. ALL of northern Ohio will have a nasty day Wednesday.  The wind will be a little higher in the blizzard warning areas and visibilities may be consistently lower, but we will have very tough driving conditions across all of our counties.

Here is the set-up:  A powerful winter storm system will move from the deep south to the New England/Mid-Atlantic coast.  As the storm moves northeast, a swath of very heavy snow will move into northern Ohio from the south.  It will also be quite windy.  

A steady moderate to heavy snow will persist through the afternoon with very heavy, steady snow continuing in the late afternoon through evening.  

When combined with the brisk wind, blizzard conditions are possible in all areas, but most likely in the blizzard warning area.  

6" to 10" of snow will fall across ALL of northern Ohio through the day and evening.  An additional 2" to 5" will fall Wednesday night before the snow cuts down to light showers and flurries early Thursday morning.  

Storm totals by midday Thursday will be 8" to 12" throughout northern Ohio with the possibility of up to 15" of snow.

This will be a constantly evolving situation.

Things to remember:

- The snow will be wet and heavy, so use caution if shoveling.

- Driving will be extremely difficult.  

-If driving south along I-71, expect heavy snow the entire drive through Cincinnati.  

-If driving west on I-80/90, expect heavy snow showers in much of northern Ohio...tapering off to flurries and light snow in Indiana and Michigan.

-If driving south on I-77 or east on I-80/76, expect snow to change over to a wintry mix.

-If driving east on I-90 toward Buffalo, expect snow, but leaving earlier rather than later is a good idea.

- The airports will have problems with arrivals and departures.  So will other regional airports in Columbus and Pittsburgh.

-Bring in the pets and secure outdoor buildings and items.

-Consider telling your kids to wear bike helmets while sledding, tubing and/or skiing or snowboarding.

Friday:  Partly sunny.  Near 30

Saturday:  Mostly cloudy with snow likely.  Low 30s

Expect 4 to 8" west of I-71 and 8 to 12" along and east of I-71.

Cleveland: Famous photos now Christmas ornaments

CLEVELAND -- A Cleveland's photographer's well-known images of the city are now Christmas ornaments.

While Clevelanders might not recognize Jim Ptacek if they ran into him, they certainly have seen his photos, which for more than 30 years have been displayed in homes, offices, and businesses across the area and beyond.

"I wanted to be different. I didn't want to be strictly black and white so I went with the sepia and it seems to have worked," explained Ptacek, from his studio in the basement of his west side home, about his decision decades ago to give his photos of Cleveland landmarks a different look.

Now Ptacek's sepia-tone images of well-known local scenes, which have been made into everything from lampshades to neckties, are part of a Christmas ornament collection, produced by the Wendell August Forge company.

"We can't keep up with the orders. We're on another back order. We keep reordering them," says Barb Keglovich, of the Frame Center Gallery in Cleveland's downtown Galleria. She has been displaying and offering Ptacek's work since 1980.

"He is one of the sustaining artists that really profiles Cleveland and keeps it up to date," Keglovich told WKYC. "And he's so proud of his community and wants to share that through his work."

This year, Wendell August has forged three new images to join the first three of Ptacek's photographs which were made into ornaments during Christmas 2011.

"This year, it's the Soldiers & Sailors Monument, the old Muni Stadium with Chief Wahoo, and the West Side Market," the friendly photographer said, adding that the West Side Market ornament is especially popular because it's the 100th anniversary of the Cleveland landmark.

Vicky Poole stopped by a display Ptacek recently mounted at the Galleria. She had the ornament she purchased personalized by the artist who was glad to chat with his customers.

"I have last year's three so this will add nicely to our tree," Poole said, while admiring Ptacek's distinctive signature. "He does such a good job depicting what our Cleveland past and future is all about."

That's the kind of comment the quiet and humble photographer appreciates. His hometown has always meant much to him, and capturing its past and progress has been in important part of his vision. 

"I grew up in Cleveland here on the west side, and I've always liked Cleveland. Years ago there were a lot of people making fun of it, mistake on the lake, and I didn't want to be a part of that," Ptacek said.

"So I just kept plugging away and making scenes of what people relate to, things you have experienced."

Ptacek realizes his photos have not only captured images of Northeast Ohio over the years, but the imaginations and even the hearts of those who view them.

"If you spent time with your father at the Stadium and he's passed, every time you look at that picture you think of your father," he reflected, "or Euclid Beach, the good times you had there.  So I'm kind of marketing memories, and memories seem to sell."

Especially at the time of the year when new memories are being made.

LIVE: 4 firefighters shot, 2 killed at NY blaze

WEBSTER, N.Y. -- A western New York police chief says a gunman who entrapped and shot four volunteer firefighters outside a blazing home is dead.

Webster Police Chief Gerald Pickering says two of the firefighters were killed and two others hospitalized after the ambush on a spit of land on Lake Ontario just northeast of Rochester.

He also says the gunman is dead and an off-duty police officer who was driving by has injuries from shrapnel. One of the slain firefighters is also a town police lieutenant.

The shooting Monday morning happened in a quiet neighborhood of seasonal and year-round homes.

Police say four homes in all were destroyed and four damaged by the spreading flames.

Report: Nick Swisher agrees to 4-year, $56 million deal with Indians

Nick Swisher has agreed to a four-year, $56 million deal with the Indians, according to Mark Feinsand of the New York Daily News.

Feinsand reports Swisher has a $14 million vesting option for a fifth season in 2017, based solely on plate appearances in 2016.

Swisher, 32, hit .272/.364/.473 with 24 home runs for the Yankees last season.

A native of West Virginia, Swisher played collegiately at Ohio State before he was drafted by the A's in first round of the 2002 draft.

In parts of nine seasons in the big leagues, Swisher's a .256/.361/.467 hitter with 209 home runs.

An All-Star in 2010, Swisher has primarily played right field, first base and designated hitter throughout his career.

The switch-hitter has also played all three outfield spots.

Brandywine: New ski lodge nearly ready to open

CLEVELAND -- A $5 million investment in the local ski industry should be ready to open when there's enough snow.

Construction workers were putting the finish touches on Brandywine's new Base Lodge, a 48,000 square foot, two story facility with a long row of large windows that look out on the ski slopes.

"Our previous lodge was a little older and we're excited to get this," said Steve Mackel, Marketing Manager for Boston Mills/Brandywine.

"People are just going to be blown away when they get here and see how nice this area is. We just want to provide the best product we can for our guests."

The base lodge has been under construction since three smaller buildings were demolished earlier this year. It represents one of the largest investments ever in the local ski industry, which has a limited season.

"Skiing here in Northeast Ohio is maybe two, two and a half months of good skiing," Mackel pointed out. "So we want to make sure in that two and a half months we provide the best product that we can."

The second floor of the lodge features cafeteria style food service and an adjacent lounge and seating area which can accomodate up to 600 guests.

Brandywine has also included a 24-tap bar, which was carved out a huge tree which had fallen into the river on the grounds of the resort.

The rental facility on the first floor contains all new skis and boots, hundreds of pairs, and a vastly improved an enlarged area for fitting.

"We can get every skier fitted quickly and perfectly right on the spot," Mackel told WKYC.   

Nearby Boston Mills, which has also made significant improvements, and Brandywine are both owned by Peak Resorts, a national company which recently bought Alpine Valley in Geauga County.

"For Peak Resorts to make this major committment with a new state-of-the-art base lodge shows how much it values this resort, and the guests who have been so loyal to it for decades," said Vinnie Lewis, General Manager of Boston Mills/Brandywine.

The lodge was expected to be ready to open as soon as the weather cooperates with snowfall, or temperatures low enough to produce snow.  It was hoped that would happen before New Years Day.

CLEVELAND -- It was announced Friday afternoon that award-winning journalist Brennan Donnellan will begin a new role at WKYC starting in January.

"I'm very happy to promote Brennan into the News Director position," stated Brooke Spectorsky, President and General Manager of WKYC.

"While he's only been at Channel 3 for 18 months, he's been instrumental in launching our new anchor teams of Russ Mitchell and Kris Pickel, Chris Tye and Erin Kennedy, and Lynna Lai and John Anderson. He's led our live coverage of major news events including the shootings in Chardon, the presidential election, Superstorm Sandy and others. He's a forward-thinking manager who expects the best from his team and fights for the resources to bring high-quality newscasts to viewers in Northeast Ohio."

An Ohio University graduate, Donnellan has held news management positions in Atlanta, Boston and Cincinnati.

"He also led a digital media team for two years, and understands the challenges and opportunities that producing content for various platforms entails," Spectorsky added.

Brennan will be stepping in to take over from interim News Director Virgil Dominic.

Donnellan was previously the Director of Business Development for nSixty in Cincinnati, a digital media company that specializes in creating apps, video sharing and social networking systems. Prior to that he was News Director of WLWT-TV in Cincinnati.

A winner of six regional Emmys, Brennan and his family live in South Russell.

NRA calls for armed police officer in every school

WASHINGTON -- The nation's largest gun-rights lobby is calling for armed police officers to be posted in every American school to stop the next killer "waiting in the wings."

The National Rifle Association broke its silence Friday on last week's shooting rampage at a Connecticut elementary school that left 26 children and staff dead.

The group's top lobbyist, Wayne LaPierre, said at a Washington news conference that, quote, "The only thing that stops a bad guy with a gun is a good guy with a gun."

Here's a time-stamped breakdown by USA Today of the NRA's Friday press conference:

11:33 a.m. Keene takes the stage and concludes the news conference as reporters shout questions. He repeats the organization's officers won't take questions. The bottom line is the NRA thinks that armed guards at schools and not pushing for more gun control measures is the way lawmakers should go after the issue.

11:31 School safety is a complex issue, but providing armed security could provide an important line of defense to protecting school children, Hutchinson said.

11:28 a.m. Hutchinson said he took the task of directing the model shield program with the condition that it would be independent. Armed, trained personnel will be part of the program, and it won't require any federal money. It will rely on volunteers.

11:26 a.m. "We must act now for the sake every child in America," LaPierre says before introducing Hutchinson

11:24 a.m. The NRA is creating what is calling a "model school shield program" to help improve security at schools It will be lead by former Rep. Asa Hutchinson and will be made available to every school that wants it free of charge, LaPierre says.

11:21 a.m. LaPierre calls on Congress to immediately appropriate money to put armed officers in every school in America. The conversation on this idea has to start immediately. He says the NRA has 11,000 police training instructors willing to help out.

11:17 a.m. LaPierre asks: "Why is the use of a gun when it's asked to be used to protect the president or used by the police, but bad when it's used to protect children." He calls on the media to "at least admit that it's possible" that armed guards could have stopped the Newtown massacre.

11:13 a.m. LaPierre criticizes the media for getting basic facts about guns wrong. "They don't know what they are talking about. He makes the point that increased regulation of guns amounts to "dishonest thinking." He adds, "The only thing that stops a bad guy with a gun is a good guy with a gun."

11:09 a.m. Federal gun prosecutions have decreased by 40% to lowest levels in a decade, LaPierre notes. He criticizes media for placing the blame on gun rights advocates and failing to talk about the "callous, corrupt shadow industry" pushed by Hollywood and video game makers.

11:06 a.m. A protester holding up a red handmade sign interrupts the press conference. He's carried out by security while yelling, "The NRA is killing our children."

11:05 a.m. LaPierre says pushing for gun-free killers offers an invitation to "insane" killers. "We as a society are leaving them utterly defenseless...and the monsters of the world know it."

11:03 a.m. LaPierre says they remained "respectfully silent" out of respect for the families. He adds for all the anger thrown at his organization since Newtown tragedy no one is talking about how we protect our children now.

Federal court upholds Ohio's new exotic pet law

CINCINNATI -- The U.S. District Court for the Southern District of Ohio Eastern Division issued a verdict Thursday upholding Ohio's new regulations on the possession of dangerous wild animals as pets.

The verdict came a week after the court conducted a three-day trial on the constitutionality of the law, which was challenged by certain exotic pet owners and breeders.

The Humane Society of the United States intervened in the case to defend the measure, alongside the Ohio Attorney General and the Ohio Department of Agriculture.

"Three days of trial testimony and the Court's resulting verdict have left no doubt that Ohio's commonsense restrictions on the keeping of dangerous wild animals are not only necessary, but entirely constitutional," said Karen Minton, Ohio state director for The Humane Society of the United States.

"There should never again be a crisis like the one in Zanesville, and powerful wild animals should never be kept in someone's backyard or basement as pets. The reckless individuals who created this very problem in the first place should not be allowed to put public safety and animal welfare further at risk, and put the financial burden on Ohio taxpayers and private groups to clean up their mess."

The new law, S.B. 310, the Ohio Dangerous Wild Animal Act, sponsored by Sen. Troy Balderson, R-Zanesville, was enacted following several incidents relating to dangerous wild animals in Ohio, including the October 2011 Zanesville tragedy in which nearly 50 large animals, including tigers, grizzly bears and lions, were released from their cages by their owner into a residential community, and subsequently killed by law enforcement scurrying to protect public safety.

The HSUS strongly supports the efforts of Ohio Gov. John Kasich, Ohio Attorney General Mike DeWine, and the Ohio Department of Agriculture to implement and enforce the new law.

The new law generally prohibits future private acquisition of dangerous wild animals, including big cats, some smaller exotic cats, bears, hyenas, gray wolves, some primate species, alligators and crocodiles. Current owners may keep their animals as long as they register and obtain a permit from the Ohio Department of Agriculture.

In addition, the Act requires existing owners to obtain liability insurance, comply with housing and safety standards, once established, and comply with additional measures to protect public safety. In its ruling today, the court found that "the animals covered under the Act are inherently dangerous, as they are not normally domesticated and pose unique threats to human life due to their physical and temperamental characteristics, including their strength, speed and unpredictability."

Accordingly, the court concluded that "it is within the prerogative and function of the Ohio General Assembly, within constitutional parameters, to decide whether and how best to regulate such matters as the possession, care, and transfer of these animals."

With the passage of the Ohio Dangerous Wild Animal Act, which went into effect on Sept. 5, only six states remain with little to no restrictions on the private possession of dangerous wild animals: Alabama, Nevada, North Carolina, West Virginia, South Carolina and Wisconsin.

These states should follow Ohio's lead and adopt restrictions on the keeping of dangerous wild animals.

White House threatens veto of Boehner's 'Plan B'

WASHINGTON  --  The White House says President Barack Obama would veto House Speaker John Boehner's 'Plan B' proposal for extending tax cuts for people making up to $1 million.

White House communications director Dan Pfeiffer says it is unlikely that such a bill would pass the Senate. In a statement, he says the deficit reduction that would result from the 'Plan B' approach is minimal and offers no spending cuts.

Pfeiffer says Obama urges Republican leaders to work with the White House to find a reasonable solution instead of engaging in "political exercises." Unless both sides reach an agreement, a series of tax hikes and spending cuts will go into effect starting Jan. 1.

Investigator: Convicted double murderer to be set free

PARMA -- An elderly convicted double murderer is expected to be released from prison this week, despite the objections of the victims' family.  

Edward Jakub, 85, has served 20 years of a 30-years-to-life sentence for the murders of his sister, Marge Churgovich, and her husband, Ed.

It was October 1989 when Jakub walked into the kitchen of the elderly couple's Parma home and gunned them down as they were eating breakfast in their kitchen. 

Marge was 71.  Ed was 70.

Jakub was 62 at the time of the murders.  He drove to the Parma police station immediately after killing the couple and confessed to the killings.

The Churgovich's daughters received notice from the state parole board that it intends to release Jakub into the community as early as Thursday.

The family will testify before the parole board on Thursday, opposing his release.

The family fears they could become Jakub's next victims.

"Before he killed my parents, we were all part of some conspiracy against him, and I don't think that's gone away," said Jean Murray.

Her sister, Diane Carleton, expressed similar feelings.

"He's going to come and do it again. Kill us. It was easy for him to get a gun the first time, and he can do it again," Carleton said.

Ohio prison statistics show convicts Jakub's age are not likely to return to prison for criminal activity. Prison figures show that, of those between the ages of 65 and 69, the figure is 5.6 percent.

It drops to under 3 percent for those between 70 and 74. And not one inmate, 75 or older, commits another criminal act following his or her release from prison.

Still, the family considers Jakub a threat. "Oh I think I will be looking behind me all the time. When will he be there? You don't know," Murray said.

The two sisters say Jakub has a history of mental health issues and needs to be supervised to make sure he's taking his medications.

They said he could be placed in a local nursing home in Northeast Ohio. Since he killed two elderly people, they argue a nursing home would not be a suitable choice.

The state said it would notify a nursing home of Jakub's violent past should he be placed there.

Obama pressing for policy changes after shooting

WASHINGTON  --  President Barack Obama is asking a team led by Vice President Joe Biden to offer "concrete proposals" to curb gun violence no later than January, in the aftermath of the horrific massacre at a Connecticut elementary school.

Obama says after he receives recommendations from Biden's group, he will push legislation "without delay." The president is urging Congress to hold votes on the bill.

Obama says the issue is complex but quote, "we have a deep obligation - all of us - to try."

Biden, a longtime gun control advocate, will lead a team that will include members of Obama's administration and outside groups.

The move comes after Friday's shooting at Sandy Hook Elementary in Newtown, Conn. Twenty children and six adults were killed at the school by a gunman wielding a semi-automatic rifle.

Shaker Heights: Two dead, firefighters injured in house fire

SHAKER HEIGHTS, Ohio --Two people are dead, five other family members were taken to the hospital after an early morning house fire in Shaker Heights Tuesday.

Two firefighters were also injured in the fight.

Emergency crews closed Daleford Road north of Van Aken Boulevard because of the fire.

Five people who escaped on their own were taken to Ahuja Medical Center.

A man and a woman both died in the fire. The medical examiner has not released the identities of the victims.  

The fire broke out before 4 a.m. in the 3300 block of Daleford and was still burning in parts of the house at 6 a.m.

There is no word on what started the fire.

White House rejects Boehner's 'Plan B' option

WASHINGTON  --  The White House is rejecting House Speaker John Boehner's plan to push a backup tax bill as a way to deal with the "fiscal cliff."

In a statement, White House spokesman Jay Carney says Boehner's "Plan B" approach can't pass the Senate. And he says it does little to address the nation's fiscal challenges.

Unless the White House and Congress reach a deal, a series of tax increases and spending cuts begin taking effect on Jan. 1.

Boehner is calling for a separate bill to address only taxes. He wants lawmakers to extend tax cuts for people making up to $1 million.

Carney says the president is willing to continue working with Republicans to keep from going over the fiscal cliff.

Judge to consider Ohio killer's obesity claim

COLUMBUS --  A judge is ready to hear arguments in the case of a condemned Ohio inmate who weighs around 450 pounds and says he's too fat to be executed humanely.

Killer Ronald Post claims he could suffer a "torturous and lingering death" because executioners will have a hard time finding a vein for the lethal chemical used by Ohio or if an untried backup method is used that injects chemicals directly into muscle.

Federal judge Gregory Frost planned a hearing Monday afternoon in Columbus where evidence will be presented by Post's attorneys and also from state lawyers, who oppose Post's request.

A Cleveland federal judge has already rejected Post's argument.

The state parole board on Friday recommended Post be spared because of questions about his legal representation 30 years ago.

Garfield Heights Police: Teen lied about attempted abduction

GARFIELD HEIGHTS -- Garfield Heights Police now say a 13-year-old boy made up a story about an attempted abduction this morning.

Police searched for the suspect and a van after the boy gave them a detailed description.

The teen told police he managed to escape when the man tried to grab him near a bus stop on Rockwood.

Investigators say the boy lied about the entire story, including the detailed description of the suspect and the vehicle.

The case will be turned over to the juvenile prosecutor for potential charges against the teen.

AAA: 3.5 million Ohioans will travel for holidays

COLUMBUS --  The AAA says around 3.5 million Ohioans plan to travel 50 miles or more from home during the holiday season.

The auto club says that's an increase nearly 2 percent over last year. This year the holiday travel period spans 11 days - from Dec. 22 to Jan. 1 - and covers two weekends.

Nationally, 93.3 million people are expected to travel at least 50 miles. That would be an increase of 1.6 percent from 2011.

Year-end travel numbers have gradually improved with the economy over the past few years. This year's numbers will be the second highest in the past decade. Only 2006-2007 saw higher numbers with 93.7 million travelers nationally, including 3.7 million Ohioans.

The majority of Ohio travelers - 3.2 million - will go by car.

137 police shots, 2 dead: many questions in Cleveland

CLEVELAND -- A deadly police chase in Cleveland has left a trail of angry relatives of the victims and accusations of civil rights violations.

The chase in November began with a pop - perhaps a gunshot or backfire from a car. Police don't know why the driver refused to stop. Eventually, 13 officers fired 137 rounds, killing both people in the fleeing car.

The state has taken over the case, but victims' family members and civil-rights groups want a federal investigation.

The fallout has cast Cleveland police in an uneasy light amid complaints about a racially motivated killing with no evidence the victims were armed.

The officers have been assigned to desk duties. Their union defends their actions against a suspect who rammed a patrol car and drove toward an officer on foot.

A children's choir opens 'SNL' with 'Silent Night'

NEW YORK -- Saturday Night Live made a rare departure from its comedic opening to pay tribute to the children and adults killed at a Connecticut elementary school.

Not known for treating anything seriously or tenderly, the show made a fitting exception during the first moments of its show Saturday. Rather than the usual comedic sketch, a children's choir appeared on camera and angelically sang Silent Night, with the touching refrain, "Sleep in heavenly peace."

Then the members of the New York City Children's Chorus shouted out the NBC show's time-honored introduction: "Live from New York, it's Saturday Night!"

It was the night's sole reference to the tragedy and struck just the right tone.

Later, the chorus returned to join musical guest Paul McCartney in a rendition of his Wonderful Christmas.

Connecticut officials: Principal died lunging at gunman

NEWTOWN, Conn. --  Town officials in Connecticut say the principal who died in the rampage at an elementary school was killed while lunging at the gunman as she tried to overtake him.

Dawn Hochsprung was gunned down in Friday's massacre in Newtown. Board of Education chairwoman Debbie Liedlien says administrators were coming out of a meeting when the gunman forced his way into the school and ran toward him.

Jeff Capeci is chairman of the town's Legislative Council. Asked whether Hochsprung is a hero, he says, "From what we know, it's hard to classify her as anything else."

Hochsprung had worked at the school for two years. Both Liedlien and Capeci say she immediately became a beloved figure. Liedlien says "it's so sad to lose somebody like her" and that residents are feeling "a deep sense of loss" over her death.

NBC: Gunman had run-in at school day before shooting

NEWTOWN, CT -- NBC News Chief Justice Correspondent Pete Williams is reporting that the alleged gunman in the shooting at a Connecticut elementary school had an altercation with staff members the day before the shooting.

According to Williams, the alleged gunman, Adam Lanza, 20, argued with four staff members at the elementary school on Thursday. On Friday, Lanza forced his way into the school and opened fire, killing 26 people including 20 children.

Among the dead, Williams says were three of the four staff members who confronted Lanza on Thursday. The four staff member was not at work on Friday at the time of the shootings. Police are now interviewing that person to try and gain more insight into the shooting.

Gunman killed in Connecticut school shooting

NEWTOWN, Conn.  --  An official with knowledge of the situation says a gunman at the center of a school shooting in Newtown, Conn., has been killed.

The official who spoke on condition of anonymity because the investigation is still under way says the man apparently had two guns.

A dispatcher at the Newtown Volunteer Ambulance Corps says a teacher has been shot in the foot and taken to Danbury Hospital, but it's unclear whether there are other injuries.

Ambulance surrounded Sandy Hook Elementary School in western Connecticut and parents were running toward the building as a helicopter flew overhead.

The superintendent's office says the district has locked down schools.

State police say Newtown police called them at about 9:40 a.m. about the shooting reports.

East Cleveland: Demonstrations planned at meeting on deadly chase, shooting

EAST CLEVELAND -- Community activists are joining the American Civil Liberties Union in asking for an independent investigation of the deadly Cleveland police pursuit.

The group is asking Cuyahoga County Prosecutor Tim McGinty to remove himself from the process and that a special prosecutor be appointed.

They are also asking the U.S. Department of Justice to take control of the investigation instead of local law enforcment.

Right now the East Cleveland Police Department and the Cuyahoga County Sheriff's Office is handling the investigation with the Bureau of Criminal Investigation

Friday night the NAACP will hold a public forum at Shaw High School to discuss the incident and the investigation.

Outside in the parking lot, activists plan to voice these recent demands.

Pelosi says time running out for fiscal cliff deal

WASHINGTON  --  House Democratic Leader Nancy Pelosi says a deal must be reached "in the next couple of days or the very beginning of next week" to avoid the fiscal cliff of automatic tax hikes and spending cuts.

The California Democrat criticized Republican House leaders for sending lawmakers home on Thursday, saying they should stay in Washington and work on a solution. Last week, most House members left town on Wednesday.

Pelosi said, "Here we are once again having a two-day work week in the Congress of the United States."

Negotiations appear at standstill over President Barack Obama's insistence that tax rates increase for top earners. House Speaker John Boehner has agreed to increased tax revenue through reducing or eliminating unspecified tax breaks. But Boehner opposes raising tax rates.

Kasich announcing plan for Ohio Turnpike's future

TOLEDO -- Ohio's governor won't lease the Ohio Turnpike and instead proposes raising $1.5 billion in bonds to fund local road projects.

Up to an additional $1.5 billion could be generated by matching local and federal funds.

Republican John Kasich was announcing his plan Thursday. It caps any toll increases on trucks at inflation, freezing rates for 10 years on local trips paid for with an EZ Pass.

Ninety percent of the proceeds from bond sales, backed by future toll revenues, would go to northern Ohio projects, including the turnpike. Diverting toll revenue off the roadway will require lawmaker approval.

The plan retains the Ohio Turnpike Commission as a public entity and retains jobs.

The governor originally touted benefits of a lease. But counties hosting the 241-mile toll road strenuously objected.

LOS ANGELES  --  Steven Spielberg's Civil War saga "Lincoln," the Victor Hugo musical adaptation "Les Miserables" and the lost-soul romance "Silver Linings Playbook" lead the Screen Actors Guild Awards with four nominations each.

All three films were nominated Wednesday for overall performance by their casts. Also nominated for best ensemble cast were the Iran hostage-crisis thriller "Argo" and the British retiree adventure "The Best Exotic Marigold Hotel."

"Lincoln" also scored individual acting nominations for Daniel Day-Lewis, Sally Field and Tommy Lee Jones. "Les Miserables" had individual nominations for Hugh Jackman and Anne Hathaway, plus a nomination for its stunt ensemble. "Silver Linings Playbook" also had nominations for Bradley Cooper, Jennifer Lawrence and Robert De Niro.

Is Ohio next on right-to-work battlefront?

COLUMBUS -- The divisive battle over right-to-work legislation could come to Ohio next year. 

As neighboring Michigan became the 24th state Tuesday to enact laws that prohibit agreements requiring workers to join a union or pay dues, Ohio groups that support the laws say the Buckeye State has to follow suit or watch jobs leave. 

"When we are working with companies who want to investigate locations, the first question on their list is right to work," said Phillip Parker, president and chief executive officer of the Dayton, Ohio, Area Chamber of Commerce. He later backed off the statement he made at a Tuesday press conference, but indications are that the fight is coming to Ohio. 

A group called Ohioans for Workplace Freedom is gathering signatures to put the issue on the fall ballot. They need 385,253.

"Indiana has done this. Michigan will. What choice will Ohio have?" tea party activist Chris Littleton of West Chester, Ohio, told the Toledo (Ohio) Blade this week. "This is economic jet fuel for job creation, wage growth and a vibrant Ohio economy. If two border states do this, how can Ohio afford not to do this?" 

Indiana was the first to enact right-to-work legislation earlier this year. Delaware, Kentucky, Maryland and West Virginia are only states among 16 Southern states without right-to-work laws. 

Ohio's Senate minority leader, Democrat Eric H. Kearney of Cincinnati, said Republicans are trying to introduce right-to-work legislation next year. But he could not identify who was leading that effort. 

House and Senate Republicans deny any effort is under way. 

In Michigan, the right-to-work legislation sped through the state Legislature without public discussion, committee hearings or any Democratic support, and the state's Republican governor signed it immediately. Two bills covering both the public and private sectors make it illegal to require financial support of a labor union as a condition of employment. The new law also prevents closed shops, workplaces that require union membership to get a job. 

The law passed in Michigan even though about 17.5 percent of workers were union members in 2011, according to the Bureau of Labor Statistics. In Ohio, about 13.4 percent of workers are union members. 

Ohio Gov. John R. Kasich, a Republican like Michigan's governor, has said making Ohio a right-to-work state isn't a priority. But he hasn't opposed it either -- something Tuesday that state Democrats were quick to call on him to do in a "crystal-clear" way. 

"Kasich seems intent on following Michigan Gov. Rick Snyder's path, repeatedly assuring Ohioans a right-to-work law is not on his agenda, that is until his agenda miraculously changes," said Chairman Chris Redfern of the Ohio Democratic Party. 

Kasich's hesitancy to back a right-to-work law may be because of the beating he took over a bill last year that the Legislature passed and he signed to limit collective-bargaining rights of public employees. 

The law revived unions, including firefighters and police officers, who led a successful effort to repeal it. Some credit that effort with contributing to President Barack Obama's victory in Ohio last month. 

Kasich runs for re-election in 2014. Even without a right-to-work statute, Kasich said Monday that Ohio is competing well economically with other states. He said he had higher priorities. 

Ohio added 127,000 jobs and is ranked fourth nationally and first in the Midwest in job creation, said Kasich, who regularly promotes the numbers to anyone willing to listen. 

"Ohio has momentum," said Ellen G. van der Horst, president and chief executive officer of the Cincinnati Chamber of Commerce. She noted that Site Selection magazine ranked Ohio No. 2 in the country for its attractive business climate. 

Parker of the Dayton chamber said Ohio needs a right-to-work law to compete with Indiana and Michigan to keep or attract jobs. Hours later, Parker backed off his statement, saying he was speaking only for himself, not even his own organization. 

Matt Davis, vice president of government affairs for the Cincinnati USA Regional Chamber, distanced the Cincinnati chamber from Parker's comments. 

"We have not vetted the issue and do not have a position at this time," he said. 

Kasich said this week he has a very aggressive agenda for the next two years to keep Ohio competitive, lessening the need for a right-to-work law. The governor plans to pursue tax cuts, infrastructure improvements and education reform. 

"I am mindful of the success of states that give workers that option," said state Sen. Bill Coley, a Republican from Liberty Township about 30 miles north of Cincinnati. "But I respect the right of people to bargain." 

A February poll by Quinnipiac University found Ohio voters support a right-to-work law 54 percent to 40 percent.

 In Kentucky, many Republicans have pushed for making the commonwealth a right-to-work state. The previous Republican governor, Ernie Fletcher, wanted a law, as did former Kentucky Senate President David Williams in his unsuccessful 2011 campaign against Democratic Gov. Steve Beshear. However, Democratic-controlled House has not supported the measure.

 

How a right-to-work constitutional amendment could get onto Ohio's November 2013 ballot:

  • Gathering signatures: Petitions with a total of 385,253 valid signatures from registered voters need to be submitted to the Ohio secretary of state by July 3.
  • General Assembly: The GOP-controlled Legislature could pass a resolution to put the issue on the ballot. Its deadline is Aug. 7.

Cleveland: Driver in deadly festival crash sentenced to prison

CLEVELAND -- A man who crashed his car through a festival barricade while drunk last summer has been sentenced to 15 years behind bars.

Mitch Andelmo and Basil Bass died when Timothy Spock rammed his car into the crowd at the Dancing in the Streets celebration at Clifton and W. 117th in July.

Spock pleaded guilty to two counts of aggravated vehicular homicide, aggravated vehicular assault and DUI in November.

Barberton: Man struck, killed by train

BARBERTON -- The Summit County Medical Examiner's Office and the Barberton Police Department are investigating the death of a unidentified man who was struck by a train.

About 1:30 p.m. Monday, the man was seen sitting on the railroad tracks near Coventry Road and State Street in Barberton when he was struck by a CSX train.

He was pronounced dead at the scene just before 2 p.m.

The Medical Examiner will release further information when a positive identification of the man is made.

Michigan House approves right-to-work limiting unions

LANSING, Mich.  --  The Michigan House approved the first of two right-to-work bills Tuesday that would weaken union power in the historical labor stronghold as hundreds of protesters rallied at the Capitol.

The Republican-dominated chamber passed a measure dealing with public-sector workers 58-51 as protesters shouted "shame on you" from the gallery and huge crowds of union backers massed in the state Capitol halls and on the grounds.

Democrats immediately sought to have the vote reconsidered but failed in that effort.

Still to come was a vote on a second bill focusing on private sector workers. The Senate approved both last week. If enacted, Gov. Rick Snyder says he will sign them into law as early as Wednesday.

Even with the outcome considered a foregone conclusion, the heated battle showed no sign of cooling as lawmakers prepared to cast final votes.

Hundreds of protesters flooded the state Capitol hours before the House and Senate convened, chanting and whistling in the chilly darkness. Others joined a three-block march to the building, some wearing coveralls and hard hats.

"I'm inspired," said Lindsey Curtis, 61, a retired city worker from Flint. "I thought the unions had just rolled over."

Valerie Constance, a Wayne County Community College District developmental reading instructor and member or the American Federation of Teachers, sat on the Capitol steps with a sign shaped like a tombstone. It read: "Here lies democracy."

"I do think this is a very sad day in Michigan history," said Constance, 57.

Sue Brown, a 50-year-old pipefitter from Midland, and her 26-year-old daughter Tracy Brown, a chemical plant worker in Hemlock, held handwritten signs disparaging Gov. Rick Snyder, who last week announced support for the measures.

"It's disgraceful," said Sue Brown, who said she's not a union member but fears right-to-work laws would lower wages for all. "The unions and the UAW have created the middle class."

If the bills are enacted, Michigan will become the 24th right-to-work state, banning requirements that nonunion employees pay unions for negotiating contracts and other services.

Sen. John Proos, a Republican from St. Joseph who voted for the right-to-work bills last week, said opponents had a right to voice their anger but predicted it would fade as the shift in policy brings more jobs to Michigan.

"As they say in sports, the atmosphere in the locker room gets a lot better when the team's winning," he said.

Democratic lawmakers and union backers conceded they had little chance of stopping the tide, with Republicans dominating the Legislature and Snyder pledging to sign the measures into law.

In an interview with WWJ-AM, Snyder said he expects the bills to be on his desk later this week. He said the intention is to give workers a choice, not to target unions.

"This is about being pro-worker," Snyder said.

But foes of the law, including President Barack Obama, are trying to keep the spotlight on this latest battleground in the war over union rights.

"People don't understand the labor movement," said protester Sharon Mowers, 54, of Lansing, a United Auto Workers member and General Motors employee. "They don't understand the sacrifices people made to get us to this point."

In other states, similar battles were drawn-out affairs lasting weeks. But Snyder, a business executive-turned-governor, and the Republican-dominated Legislature used their political muscle to rapidly introduce and ramrod legislation through the House and Senate in a single day last week. Demonstrators and Democrats howled in protest, but to no avail.

On Tuesday, asked about the speed at which the legislation moved forward, Snyder said the issue wasn't rushed and that the question of whether to make Michigan a right-to-work state has long been discussed.

"There has been lots of time for citizens to contact legislators and share their feelings," he said.

A victory in Michigan, a cradle of organized labor, would give the right-to-work movement its strongest foothold yet in the Rust Belt, where the 2010 election and tea party movement produced assertive Republican majorities that have dealt unions one body blow after another.

For all the shouting, the actual benefit or harm of such laws is not clear. Each camp has pointed to studies bolstering their claims, but one labor expert said the conclusions are inconclusive.

"Very little is actually known about the impact of right-to-work laws," Gary Chaison, a professor of labor relations at Clark University in Massachusetts, said Monday. "There's a lot of assumptions that they create or destroy jobs, but the correlation is not definite."

Democrats contend Republicans, who lost five House seats in the November election, wanted to act before a new legislature takes office next month. In passionate floor speeches last week, they accused the majority of ignoring the message from voters and bowing to right-wing interest groups.

Criticism of the legislation has come from all the way up the Democratic food chain.

"These so-called right-to-work laws, they don't have anything to do with economics, they have everything to do with politics," Obama told cheering workers Monday during a visit to an engine plant in Redford, Mich. "What they're really talking about is giving you the right to work for less money."

U.S. Sen. Carl Levin and members of the state's U.S. House delegation met with Snyder on Monday in Detroit and urged him to veto the legislation or amend it to allow a statewide referendum. Levin said the governor pledged to "seriously consider" the requests.

In Lansing, leaders of the Democratic minority in the state House acknowledged there was little they could do to stop the fast-moving legislation in the waning days of the session. However, they vowed to vote against other legislation as a form of protest.

Ari Adler, spokesman for Michigan House Speaker Jase Bolger, chided those in Washington for "trying to tell Republicans in Michigan to slow down and not do our job in Lansing while they fail to resolve the nation's fiscal cliff crisis or even approve a budget."

Cleveland: As fiscal cliff nears, local taxpayers' concern grows

CLEVELAND -- The fiscal cliff that could end up costing American families thousands of dollars is now just 22 days away. 

Without an agreement out of Washington, concern is growing among taxpayers over what will happen in the next three weeks. 

At a rally Monday evening, over a dozen people gathered to send a message to lawmakers on what they want and don't want to see happen in 2013.

Fiscal Cliff: Expanded Coverage 

Organized by the ALF-CIO, people voiced their opposition to an extension of the Bush-era tax cuts for the top 2 percent of Americans, as well as their concerns about the future of social security, Medicare and Medicaid.

Political analysts say this week is critical for reaching a deal, because it might take two weeks after that to work through the complexities of one.

Fred Crow, Jr., says whatever they decide will impact his family.

"I'm frightened about it," Crow said. Crow is a 28-year truck driver, 51-years-old, with a wife and three sons. He could be any blue collar worker in America.

"Social Security and Medicare are two programs I'm counting on to take me into my golden years. I'm worried about my pension," Crow said.

As the end of the year nears, Republicans are seeking savings from benefit programs to the tune of $800 billion.

Even President Obama has proposed $400 billion in reduced "entitlement" costs.

Crow considers these programs that have protected his family. He admits, though, he has a better idea of what he doesn't want to see happen, than what the best solution is.

"I'd like to see both parties come together and do what's right for this country. Take the money out of it," Crow said.
