CLEVELAND -- The newspaper guild picketed outside the Cleveland Plain Dealer headquarters at noon.

The protest is due to more apparent cuts to the union staff.

Earlier this year, the union and paper had agreed to approximately 58 cuts from several different departments, but now it seems the paper could lay off an additional 12 or more staff members.

Meanwhile, today is the last Tuesday you'll be able to get the paper at home.

Starting next Monday, home delivery goes down to 3 days a week.

The Plain Dealer had been planning on this change for months.

Triple murder suspect back in court Thursday

CLEVELAND -- Michael Madison, the man accused of murdering three women whose bodies were found wrapped in plastic, will be arraigned Thursday at 8:30 a.m.

Madison, 35, was indicted Monday on multiple charges, including aggravated murder, kidnapping and gross abuse of a corpse.

EXPANDED COVERAGE | East Cleveland triple murder

The victims -- Shetisha Sheeley, Angela H. Deskins and Shirellda Terry -- were all found dead in the same East Cleveland neighborhood earlier this month.

Madison was arrested July 19 following a two-hour standoff with police.

Last week, a judge placed Madison on a $6 million bond.

Madison's arraignment comes the same day Ariel Castro, the admitted Cleveland kidnapper, will be sentenced. Castro pleaded guilty to more than 900 counts last week in the case of Amanda Berry, Gina DeJesus and Michelle Knight -- three women he held captive in his Seymour Avenue home for years.

SHAKER HEIGHTS -- The woman who was punched by an RTA bus driver will be spending a few days in jail for disorderly conduct tied to the incident.

Shidea Lane was sentenced Tuesday morning to three days behind bars with a $250 fine and probation.

She must also complete an anger management program.

Lane was found guilty last month for her role in the Sept. 18 incident. Cell phone video, which surfaced last October, captured Lane arguing with the driver before he delivered an uppercut punch to her face.

Earlier this month, the bus driver who delivered the punch, Artis Hughes, was also sentenced to three days behind bars for charges tied to the scuffle. He was also punished with a $1,000 fine, probation and anger management.

Hughes was fired by the RTA shortly after the video was released.

Cleveland man shoots, kills alleged attacker

CLEVELAND -- A man fatally shot an alleged attacker at his home on Cleveland's east side early Monday morning.

The shooting was reported just before 12:30 a.m. in the 900 block E. 178th Street.

When police arrived, they found a man shot in the driveway. That man died at the scene.

Authorities say the preliminary investigation reveals the homeowner and a female were leaving the home and attempting to enter a vehicle when two masked males approached.

It's reported that one of the males was in possession of a handgun, the other had a crowbar.

After striking the homeowner in the head with the handgun, police say the suspect tried pulling him out of the vehicle. At that time, police say the homeowner grabbed a handgun from inside the vehicle and fired multiple times.

The suspect, who returned fire and missed, was struck in the torso.

During the shooting, police say the second suspect stole the female victim's purse and fled the scene.

The homeowner was conveyed to St. Vincent Charity Hospital, where he was treated and released for a laceration to the head. The female victim is not reporting injury at this time.

The homeowner has a CCW permit.

The suspect has not been identified.

Facts of this investigation to be presented to the Prosecutor's Office for review.

The Cleveland Division of Police is asking that anyone with information regarding this incident to contact the Homicide Unit at 216-623-5464.

2 Pilot Flying J employees take pleas, now 7 guilty in fraud scheme

KNOXVILLE, Tenn. -- Two Pilot Flying J employees entered guilty pleas Monday, adding to the five people who've already admitted to their roles in an alleged plot to cheat trucking company customers out of rebates.

Federal prosecutors are continuing their investigation into the family company of Browns Owner Jimmy Haslam.

Janet Welch, a senior account manager in Knoxville, pleaded guilty to conspiracy to commit a federal criminal offense.

Welch admitted to conspiring with other employees to commit mail fraud, lowering the rebate amounts due to trucking companies.

Welch could face up to five years in prison.

Michael Scott Fenwick, a western regional sales manager who is based in Salt Lake City, Utah, also appeared in U.S. District Court in Knoxville.

He pleaded guilty to conspiracy to commit a federal criminal offense.

Five other employees have entered guilty pleas to fraud and other charges, agreeing to cooperate with prosecutors in their case.

Fenwick's plea agreement says he worked closely with Ashley Judd in the scheme.

Judd and Regional Sales Director Arnold Ralenkotter pleaded guilty in May.

Holly Radford, Jay Stinnett and Kevin Clark entered pleas in June.

Fenwick and Clark both worked under Vincent Greco, a regional sales director who has been identified as a confidential informant for federal authorities.

Pilot Flying J faces nearly 20 civil lawsuits following the FBI's raid of the company headquarters in April. The company offered a settlement in a class action lawsuit earlier this month.

Between the Lines: Opportunity Corridor, Zimmerman verdict fallout

Written By kolimtiga on Senin, 29 Juli 2013 | 00.38

DOWNLOAD OUR FREE WKYC APPS

CLEVELAND -- Governor John Kasich brought a transportation time machine to Cleveland.

He announced plans and funding to speed up major highway projects here and around the state, largely using new dollars from bonds backed by the Turnpike.

The Opportunity Corridor will have a groundbreaking next year, instead of the projected date of 2027. Many Democrats praised Kasich's plan.

His opponent -- Cuyahoga County Executive Ed FitzGerald -- hoped to get mileage out of a Kasich decision to lease or sell the Turnpike that did not happen.

What does Kasich's announcement mean as a boost to the region's economy and his reelection campaign?

The acquittal verdict deciding George Zimmerman committed no crime in killing Trayvon Martin continues to echo here.

There have been multiple protests. More are expected. More voices are joining the debate.

The verdict has heightened the profile of Rep. Marcia Fudge, as spokesperson for the Black Caucus in Congress.

What will the short-term and long-term impacts here be?

Will this heighten emotions about the ultimate Grand Jury decision to indict or not indict Cleveland police officers for shooting two unarmed suspectes following a citywide chase?

A privately-funded Holocaust Memorial will be placed on public grounds at the Statehouse.

Governor John Kasich backs the idea as a way to teach lessons about courage and evil.

Some groups vow to sue it as an illegal endorsement of a specific religion.

Will the courts permit the monument to be built?

Tom Beres discusses these issues with Cuyahoga County Democratic Party Vice Chairman Blaine Griffin and conservative Plain Dealer columnist Kevin O'Brien on this edition of Between the Lines.

Ariel Castro's reign of terror ends with guilty plea

Written By kolimtiga on Sabtu, 27 Juli 2013 | 00.38

CLEVELAND -- Ariel Castro has accepted a plea deal sparing him execution but putting him behind bars for the rest of his life.

He has pleaded guilty to amended charges and the prosecution and defense have agreed to a recommended sentence of life in prison plus 1,000 years.

"I am fully aware and I do consent to that [plea agreement]," Castro told the court.

PHOTOS | Ariel Castro in court

The plea deal was accepted in court during a pre-trial hearing before Judge Michael Russo.  The judge said before the hearing started that Castro will be senteced at a later date.

After avoiding eye contact and remaining silent through the prior court hearings, Castro entered the court today wearing glasses and was alert and talkative to the judge during the hearing. He stared straight ahead and maintained eye contact with Judge Russo.

While answering questions about his understanding of the deal Castro offered details about himself to the judge. Castro made references to his "sex problems." He also told the judge that he had an addiction to pornography which "took a toll on his mind."  As part of the agreement, Castro will be labeled a sex predator.

Judge Russo told Castro that he will be given the opportunity to allocute at his sentencing hearing and have family members speak on his behalf.  The sentencing hearing is scheduled for August 1.  Amanda Berry, Gina DeJesus and Michelle Knights will also have the opportunity to address the court as well at that time if they choose to do so.

Judge Russo says the women can appear in person, have someone speak on their behalf, write a letter or send a video if they choose.

The hearing was interrupted due to clerical errors within the agreement pertaining to the numbering of charges.  Castro pleaded guilty to the charges but said repeatedly he disagreed with the wording.  Specifically, Castro objected to the characterization of him as violent in the description of charges.

He also told the court that he "missed his daughter very much."  He is referring to Amanda Berry's child, fathered while she was held hostage.  In a previous pre-trial, Judge Russo denied Castro's request to see the girl.

As part of the deal, Castro has agreed to turn his home over to the Cuyahoga County Land Bank and Prosecutor Tim McGinty told the court the house would be demolished "and soon."  Castro also forfeits $20,000 and other property.  He also agrees not to profit from his crimes.

Castro, who turned 53 earlier this month, faced 977 criminal counts including kidnapping, rape and aggravated murder.   The deal called for him to plead guilty to 937 of them.

WKYC was the first to deliver the news Thursday that Castro had been offered the plea deal as well as plans already being made to tear down the Seymour Avenue home where the women were held.

NBC News later reported the deal would take the death penalty off the table with Castro accepting a sentence of life without parole plus 1,000 years.

His plea also spares his three victims -- Amanda Berry, Gina DeJesus and Michelle Knight -- the trauma of testifying during a trial.

PHOTOS | Missing Cleveland women found alive

The case was slated for trial Aug. 5.

Castro was initially arrested in May after the three women escaped his Seymour Avenue home where they had been held for a decade.

Earlier this month, the three women released a "thank you" video that took the web by storm as they offered an update on their lives two months after being found alive.

What will be put in place of Ariel Castro's house?

DOWNLOAD OUR FREE WKYC APPS

CLEVELAND -- As the steps move forward toward demolishing Ariel Castro's home on Seymour Avenue, neighbors and strangers alike have ideas on what should happen to the space.

Thursday, a demolition inspector from the Land Bank was on site at 2207 Seymour Avenue, taking pictures of Castro's house and the two vacant houses to the west.

While the Land Bank does not own the properties, they want to acquire as much land as possible to be put to use to benefit the community, the inspector told Channel 3.

Castro still owns the house at 2207, but it is in foreclosure.  Currently, no one can access the building, as it is considered evidence in the criminal case.

But once the case is over -- if Castro pleads, or at the conclusion of a trial -- investigators will release the condemned home to the City of Cleveland.

Cleveland City Council members have received all kinds of suggestions on what to do with the property.

Some have suggested bringing in Habitat for Humanity or a similar organization, to renovate the property.

Neighbors like Javier Marti want to see it demolished and turned into a park.

"It's an eyesore. I don't want no reminder of what happened there," said Marti, who lives across the street on Seymour Ave.

Ward 14 City Councilman Brian Cummins says, since the beginning the consensus has been that the home where Amanda Berry, Gina DeJesus, and Michelle Knight were kidnapped and abused for a decade, needs to go.

"Our gut feeling, from knowing the area, knowing the people on the street, knowing the context of investors is, no one is going to be interested in investing in this street for a couple of years," said Cummins.

It's a parallel situation to that of Imperial Avenue, where Anthony Sowell murdered 11 women in his home.

When Sowell was sentenced to death in August 2011, it took about four months for his home to be demolished.

Today it stands an empty field.

It's unclear if the lot at 2207 Seymour will become anything more.

"What is the most respectful thing based in the survivors interests, and the interests of the residents who live on that street? They should be the ones guiding our decisions," said Cummins.

Cummins hopes, in a few years the City of Cleveland can look at reinvesting in Seymour Avenue; not just the property at 2207, but in fixing up many of the homes on this street.

Amish leader Mullet appeal for release denied by court

Written By kolimtiga on Kamis, 25 Juli 2013 | 00.39

DOWNLOAD OUR FREE WKYC APPS

CINCINNATI -- The U.S. Court of Appeals has again denied release for the convicted ringleader of the Amish cult Samuel Mullet Sr.

The court said the "exceptional circumstances" that Mullet cited in his appeal were "not exceptional."

Mullet and several other members of his group in Bergholz were convicted in five 2011 attacks against fellow Amish in apparent retaliation against those who defied Mullet's authoritarian style.

Mullet, 67, was sentenced to 15 years in prison February 8, while the others convicted of carrying out the beard-and-hair cuttings received sentences ranging from one to seven years in prison.

Thirteen of the sixteen defendants in the case have appealed their convictions.

Related story: Samuel Mullet Sr: 'I am being blamed for being a cult leader'

In its ruling, the appeals court wrote "...Upon review, Mullet's arguments are unexceptional...."

"...his claims that the federal courts did not have jurisdiction...yet this was a Hate Crimes Act...where there is jurisdiction..."

"Second, Mullet argues for a new jury instruction stating that if he were only partially motivated by prejudice, but still would have committed the act regardless of that prejudice, he cannot be found guilty. He contends that the acts in question were merely domestic-violence incidents with no religious undertones and that the prosecution failed to prove religious animus as a result. Such an argument is meritless."

"The victims in this situation had their hair and beards cut because of their unwillingness to abide by Mullet's commands as Bishop of the Bergholz Amish community."

"Third, Mullet argues that the definition of kidnaping used at trial was erroneous because "Congress [never intended to] subject someone who failed to stop others from cutting beards and hair to the same punishment as someone who heartlessly takes human life."

"Assuming...that Mullet is correct, Mullet has failed to present concrete evidence that a new sentence he would receive after a trial with his proposed instruction would be less than the total of the time already served plus the expected duration of the appeal process. Even if Mullet received a jury instruction with a more lenient kidnaping definition, he could still receive a maximum sentence of ten years of imprisonment..."

"...Mullet does not meet the burden that he will not pose a danger to the community. Whether or not Mullet is likely to flee, he has not proven by clear and convincing evidence that he will not be a danger to his community upon returning. He is the leader and exercises control over the members of his community, as evidenced by the actions of the fifteen other co-defendants in this hair- and beard-cutting crime."

"....his motion for release on bail pending appeal is DENIED..."

Pilot Flying J revises class action settlement

NASHVILLE, Tenn. --  The truck-stop company owned by Cleveland Browns owner Jimmy Haslam and Tennessee Gov. Bill Haslam has revised a class action settlement with trucking companies that were allegedly cheated out of fuel rebates.

The original settlement required Pilot Flying J to pay back all money owed with interest. But it only covered the period between Jan. 1, 2008, and July 15, 2013. The revised settlement covers overcharging that occurred as far back as Jan. 1, 2005.

The change answers one of the concerns raised by trucking companies that did not participate in the settlement negotiations. Those companies have criticized the terms and asked the federal courts to let them go forward with their own lawsuits.

A federal judge in Arkansas granted preliminary approval of the revised settlement on Wednesday.

Trucking companies that may have been victims of a fuel rebate scheme at Pilot Flying J can now find out more about a proposed class action settlement on a new website.

A federal judge has given preliminary approval to a nationwide class action settlement agreement. The settlement class potentially includes more than four thousand companies.

A new website, DieselRebateSettlement.com details the plan and the notice of settlement.

The agreement calls for Pilot to pay the companies 100% of what they are owed, plus 6% interest and attorney's fees.

All affected companies will be automatically included in the settlement, unless they specifically opt out by October 15th.

Investigator: Pain doctor accused of sexual abuse, negligence

Written By kolimtiga on Rabu, 24 Juli 2013 | 00.38

DOWNLOAD OUR FREE WKYC APPS

AKRON, Ohio -- An Akron doctor who specialized in pain management is being accused of negligence and of sexually abusing his patients.

A jury recently ordered the pain clinic at which James Bressi was on staff  -- Summit Pain Specialists -- to pay $3 million to a patient who was paralyzed after being treated by Bressi.

The lawyer representing that patient calls Summit Pain Specialists a "pill mill."

In 2010, the pain clinic moved from Cuyahoga Falls Hospital to a medical office building owned by Akron General Hospital.

The clinic is not affiliated with Akron General, though the exterior signs can be misleading.

Another lawsuit against Summit Pain Specialists alleges that Bressi engaged in sexual misconduct with eight female patients.

It goes on to say that those who worked for the pain clinic, including co-owner Dr. Robert Geiger, were notified of this and "by failing to intervene to prevent this ongoing contact, also failed to protect the women."

In a report filed with the Stow Police Department, one patient said she was raped in an attack that left bruises on her stomach.

Two other patients of Dr. James Bressi say he engaged in masturbation, using the patient.

Bressi stopped seeing patients in March. His name has been removed from the sign outside the Summit Pain Specialists office.

Neither Bressi nor Geiger would comment on the allegations.

Dave Motz is the patient who sued the Summit Pain Clinic for negligence and won. Motz suffered from chronic back pain and went to the clinic for relief of his pain.

Instead, a series of shots made the pain worse.

"They did one," says Motz's attorney, Dennis Lansdowne. "He got no relief. They said, 'Come back.' They did another one. Got no relief. They said, 'Come back.'

"Finally they did the third and they paralyzed him."

As Motz puts it, "It was the most sickening feeling I ever had. I was crying."

After that third shot, he felt nothing from the waist down. He still doesn't.

His life changed dramatically -- for the worse. Now he is 60 and confined to a wheelchair. He depends on constant daily care from his wife.

Lansdowne questions the quality of the care that the clinic was or is able to provide, based on the number of patients seen there each day.

"When you're running 200 people a day through a clinic with three doctors, somebody is going to get hurt," he says.

That somebody was Dave Motz.

"I never got the feeling back in my leg," Motz says. "There is no recovery."

The $3 million he was awarded by a jury is money he will use to pay for a wheelchair ramp, a stair lift, medicine, and home health care.

"They rendered him a paraplegic, and they didn't do anything for his pain," says Lansdowne. "He's left with paralysis and the pain he went to get treated for in the first place."

Another lawyer who is suing the pain clinic says as many as 18 women have complained to police about Dr. Bressi.

According to the lawsuit, Bressi "engaged in conduct which was outrageous and would shock the conscience of a normal individual."

The Stow police chief declined comment, saying its investigation is ongoing.

Interestingly, while Summit Pain is accused of operating as a pill mill, Bressi served on an advisory board to state lawmakers who drafted new regulations that crack down on pain clinics that serve as pill mills.

"Angela Deskins was a beautiful, sweet, kind hearted woman. She was raised in Novelty, Ohio by her father Robert Deskins and her step-mother Linda Deskins. Everyone who knew her loved her. She was a wonderful daughter, sister and aunt who truly cared about her family and friends. She is loved so much and will be missed by everyone who knew her.
Our family would appreciate privacy during this time."

Deskins -- listed as victim #2 -- was one of three bodies found wrapped in plastic garbage bags in an East Cleveland neighborhood.

Authorities released her identity at a press conference Monday morning.

Deskins was listed in the Northeast Ohio Missing Persons Database effective July 1, 2013.

The press conference held by city officials was part of an investigation surrounding 35-year-old Michael Madison, a registered sex offender now charged with aggravated murder and kidnapping.

Police exclusively told WKYC early Monday that Madison had confessed to one of the killings. Authorities also say Madison has been cooperative.

The other two victims have not yet been identified.

EAST CLEVELAND -- Authorities have identified a second victim in the East Cleveland triple murder case.

28-year-old Shetisha Sheeley, who was initially known as victim #1, has been missing since September.

The Cuyahoga County Medical Examiner's Office says Sheeley was identified by her fingerprints.  Her body was found in a field near Hayden and Shaw avenues on Saturday.

She has a 12-year-old daughter.

Sheeley, of Cleveland, was identified just one day after authorities released the name of Angela Deskins -- victim #2 in the case.

A third victim remains unidentified.

35-year-old Michael Madison was charged in the three deaths and kidnappings Monday. He remains jailed on $6 million bond.

Madison was arrested after authorities found the bodies of three women wrapped in plastic in the same East Cleveland neighborhood last weekend.

The Cuyahoga County Medical Examiner says the victims were badly decomposed at the time of discovery, which means it could take longer than usual to determine the cause of death.

Her death is the second murder the Sheeley family has experienced in recent months. Last December, her brother, 25-year-old Dontel J. Sheeley, was fatally shot during a home invasion on E. 99th Street.

At a Tuesday press conference, East Cleveland Mayor Gary Norton says he is a friend with the family of one of the victims.

"These aren't just victims with numbers and names, they are real-life people," Norton said.

He added that authorities are continuing to search for other potential victims.

"We hope and pray that we do not find anything else," Norton said.

CLEVELAND -- One of three women victims found over the weekend wrapped in plastic has been identified.  Charges have now been filed against Michael Madison, 35, in connection with the deaths.

PHOTOS | East Cleveland triple murder

East Cleveland's Mayor Gary Norton announced that the second victim found has been identified as Angela Deskins, 38, of Cleveland.  She had been reported missing since June 7 and is listed on the Cleveland Police missing persons website.

Michael Madison is charged with aggravated murder and kidnapping in the deaths of Deskins and the two other victims.  He was arraigned this morning on the charges following a news conference with authorities.

Bond for Madison is set at $6 million.  He did not enter a plea.

Earlier Monday, police exclusively told WKYC that Madison confessed to one of the murders.

The first body was discovered Friday in a garage at Shaw and Hayden, the two others were found Saturday.  Each body had been wrapped in plastic.

Medical Examiner, Dr. Thomas Gilson,  says each body was in advanced stages of decomposition.  Dr. Gilson says all autopsies have been completed but cause of death hasn't been determined.

Fingerprints were used to identify Angela Deskins.

Dr. Gilson says one of the victims had a number of tattoos.  Anyone with information on the possible identity of the victims should call 1-800-CALL-FBI.

Madison is a registered sex offender. Police say Madison has been cooperative.

East Cleveland Mayor Gary Norton says Madison indicated he might have been influenced by the earlier case convicted Cleveland serial killer, Anthony Sowell.

The Facts

People of East Cleveland are shocked after three bodies were discovered wrapped in plastic. The first was discovered Friday followed by two more Saturday.

Sunday volunteers from the neighborhood were told to expect to find more remains in the area of Shaw and Hayden avenues.

Community members, alongside police, searched over 12 streets and roughly 50 abandoned homes for evidence of more victims that may be part of a serial killing spree.

During the search cadaver dogs lead investigators to a lot near the area where 3 other bodies were found. Other cadaver dogs also hinted at the same area.

Three crime scene trucks and an evidence recovery team were brought in to check the lot. Evidence technicians analyzed the area for hours but nothing turned up.

The search was called off last night.

Coroner: Teen in Asiana crash killed by vehicle, not crash

SAN MATEO, Calif. -- A coroner says a teenager in the Asiana Airlines crash was killed when she was struck by a vehicle at the scene.

San Mateo County Coroner Robert Foucrault on Friday disclosed the findings of his autopsy on 16-year-old Ye Meng Yuan, a Chinese student.

Foucralt said she died of multiple blunt injuries that are consistent with being run over by a motor vehicle. He did not say what that vehicle was.

San Francisco Fire Chief Joanne Hayes-White said officials believe the girl was struck by a specialized fire vehicle. Authorities confirmed last week that Yuan was hit by a vehicle racing to extinguish flames that broke out on the Boeing 777.

Police said she was on the ground and covered in fire-retardant foam that rescuers had sprayed on the wreckage.

Safety concerns prompt Cleveland Heights festival cancellation

DOWNLOAD OUR FREE WKYC APPS

CLEVELAND HEIGHTS, Ohio -- For the second year in a row, Cleveland Heights has canceled the Coventry Street Festival due to rising safety concerns.

Police Chief Jeffrey Robertson felt it was in the city's best interest to cancel this year's event because of new social media threats that have raised red flags.

"We've seen things out there where there's talk about fights, making the district rock or shake, it's gonna be hectic things along those lines," explained Chief Robertson. "It's not in the best interests of the city safety wise."

Cleveland Heights Mayor Edward Kelley echoed these sentiments in new release Thursday stating, "We have a responsibility to never compromise the health, welfare and safety of our community. We also want to respect the Coventry commercial district and the surrounding neighborhoods."

The sudden cancellation of the Coventry Street Festival just three days before it was scheduled to kick off, marks yet another long standing community tradition now in jeopardy.

Similar safety concerns have prompted neighboring communities to cancel annual events such as holiday fireworks.

"These are our long standing family fun events and the stigma is that people are taking it upon themselves to ruin it and there's really no reason," said Steve Presser, owner of The Big Cheese on Coventry Road.

Presser spent several months planning this year's festival and, while disappointed, he agrees with the city's decision.

"This was a decision that was well thought out there was documentation on twitter and there was a precedent set at St. Greg so I think they made the wise decision," he said.

WOOD COUNTY -- A big day for drug busts on Ohio highways by Highway Patrol troopers on Wednesday.

While troopers in Ashland seized 30 pounds of marijuana during a traffic stop, their counterparts in western Ohio made a big haul as well.

Six men are facing felony drug charges after troopers discovered 907 pounds of pot and thousands of dollars during related traffic stops. The drugs have a street value of more than $4 million.

Troopers pulled over a 2014 Subaru Outback with Massachusetts license plates on the Ohio Turnpike for following too close to a motorhome in front of it. Troopers say the motorhome was also following the vehicle  in front of it too closely.

An attempted stop was made on both vehicles but only the driver of the Subaru pulled over at milepost 71. The trooper detected an odor of raw marijuana coming from the car and noticed marijuana on the driver's pants.

A search of the vehicle turned up nearly $10,000 in cash bundles. The driver of the Subaru told troopers he was traveling with the motorhome.

Troopers located the motorhome in a service plaza about six miles away. Troopers stopped the motorhome for the original following too close violation. After detecting an odor of raw marijuana a search of the motorhome turned up the more than 900 pounds of pot as well as more than $4,000 in cash bundles.

The driver of the Subaru, Frankie Junior Layz, 22 and his passenger William Luciano Jr., 33, both of Rochester, NY; and the occupants of the motorhome: Justin T. Gould, 27, of Rochester, NY; Jimmy Pross Jr., 35, of Charlotte, NC; and Jose M. Manzanares, 36, of Houston, TX; were incarcerated in the Wood County Jail and were charged with possession of marijuana and trafficking in marijuana, both second-degree felonies; money laundering, a third-degree felony; and possession of criminal tools, a fifth-degree felony.

During the traffic stop of the motorhome, one suspect fled with his seven year-old son. The suspect was later identified as a known drug violator, of Rochester, NY, and he plans to turn himself in to authorities.

Judge orders Castro to raise his head, open eyes

CLEVELAND -- Ariel Castro has entered a not guilty plea to 977 charges in connection with the kidnappings of three women.

Castro was arraigned on the new charges in court this morning.  During the proceeding, the arraignment judge -- Cuyahoga County Common Pleas Judge Pamela Barker -- repeatedly told Castro to look at her and to keep his eyes open.

"I'm trying," replied Castro.

Barker explained she wanted to make sure Castro understood the charges against him. In previous court appearances, Castro kept his eyes averted and closed.

PHOTOS | Ariel Castro in court

Castro's lawyers entered a not guilty plea to the expanded 977 charge indictment on his behalf.  Castro had previously entered a not guilty plea to the initial 329-count indictment.

Barker continued Castro's bond at $8 million.

The new indictment expands upon the previous charges and covers the entire alleged time frame for which Castro is accused of holding Amanda Berry, Gina DeJesus and Michelle Knight captive inside his Seymour Avenue home.

The women had been missing for a decade.

Police rescued the women on May 6 after Amanda Berry broke free from the home and ran to a neighbor to call for help.

Barker has maintained a no-contact order between Castro and the victims.

Prosecutors have not yet determined whether to seek the death penalty in the case.

Castro faces aggravated murder charged in connection with alleged forced termination of one of the women's pregnancies.  His lawyers have said they would be open to a possible plea deal if the death penalty was taken off the table.

Board rejects clemency for condemned Cleveland killer

COLUMBUS --  Ohio's parole board has rejected clemency for a condemned Cleveland killer despite a prosecutor's rare plea to commute his sentence to life without parole.

The board voted 6-4 Tuesday against recommending mercy for death row inmate Billy Slagle in his neighbor's 1987 stabbing death.

Attorneys for the 44-year-old Slagle have long argued he deserves clemency because he was just 18 at the time of the slaying and already a drug addict and alcoholic with a chaotic upbringing.

Cuyahoga County Prosecutor Tim McGinty has changed his office's approach to capital punishment and says he doubts it could obtain a death sentence for Slagle under today's laws.

He asked the board two weeks ago that Slagle's sentence be reduced.

The board's recommendation goes to the governor, who has the final say.

Judge approves Pilot Flying J class action settlement

CLEVELAND -- A judge in Arkansas federal court has approved a preliminary class-action settlement between Pilot Flying J and trucking companies.

The United States District Court Eastern District of Arkansas was reviewing a proposal for a settlement between Pilot Flying J and multiple plaintiffs in Federal Class Action lawsuits.

Court documents that were just released outline a preliminary approval of the settlement.

Court documents show at least eight class action members that joined as part of an original suit in the U.S. District Court in Eastern District of Arkansas asked the judge for approval.

"All class members will receive back every dime that they were shortchanged, plus interest at a healthy rate. Their recovery will be net to them, as all expenses connected with the settlement, including attorneys' fees, will be paid by Defendants," reads the brief, written by the Plaintiff's Attorney Michael Roberts of Roberts Law Firm in Little Rock.

"All accounts will be audited, and the auditors will be audited, all at the expense of Defendants. Moreover, Defendants will submit to an injunction to prohibit these underpayments from occurring in the future. Plaintiffs and their counsel are very pleased to submit this proposed class settlement to this Court for preliminary approval."

Court documents show attorneys for Pilot Flying J request the settlement be applied to all class action members. They estimate there are more than 4,000 customers that fall into the Settlement Class.

At least 21 trucking company customers have filed class action lawsuits since the FBI exposed rebate fraud at the company in April.

"We're aware the court is considering an agreement, but we cannot comment until and if the court rules." said Tom Ingram, a spokesperson for Pilot Flying J.

Jimmy Haslam, who purchased the Cleveland Browns last fall, has denied any wrongdoing or knowledge of the scheme.

Five employees of Pilot Flying J have entered guilty pleas to charges of mail and wire fraud, agreeing to cooperate with federal prosecutors as they continue to investigate the case.

NEW YORK -- Demonstrators from across the country are protesting a jury's decision to clear George Zimmerman in the 2012 shooting death of an unarmed black teenager while the Justice Department considers whether to file criminal civil rights charges.

Rallies on Sunday attracted anywhere from a few dozen people to more than a thousand as demonstrators voiced their support for 17-year-old Trayvon Martin's family -- and decried Zimmerman's not guilty verdict as a miscarriage of justice.

The NAACP and protesters are calling for federal civil rights charges against Zimmerman, a neighborhood watch volunteer who was acquitted Saturday in Martin's death.

The Justice Department says it is looking into the case to determine whether federal prosecutors should file criminal civil rights charges now that Zimmerman has been acquitted in the state case.

Greater Cleveland is expecting a record number of tourists and visitors coming to share parts of the Cleveland experience this year.

About 11 million people are expected to check out many  offerings.

The summer season recently began with the Tall Ships.

On Friday July 19, another big event kicks off.

The Senior Games is expected to bring 35,000 athletes and visitors.

It's the first major event at the new Convention Center which is putting Cleveland back in the convention game after years of competing with an outdated or no facility.

A big event, the Gay Games, will be here next year.

Positively Cleveland and the Downtown Cleveland Alliance are two groups working to enhance the visitor experience.

There are pushes to train waiters, taxi drivers, bartenders and all those hospitality workers who interact with visitors to be more helpful and positive about the city.

Positively Cleveland's David Gilbert has said, "The work of Positively Cleveland ultimately is about bringing more people to Cleveland spending money and creating jobs."

The hospitality industry is Cleveland's 4th biggest employer.

The groups are working to improve Cleveland overall as a product and destination that is welcoming, friendly and simple to navigate.

A batch of new hotels are planned or opening.

A flagship hotel connected to the Convention Center will be the city's biggest.

How will all this impact a possible bid for a political convention?

What is Cleveland's current perception to convention planners and ordinary prospective visitors?

What is the overall impact on the local economy?

How does Cleveland compare with regional rivals, like Columbus, Pittsburgh and Indianapolis?

Will the Convention Center deliver as much as is expected for the huge taxpayer investment?

AKRON -- For the second day, rescue crews are searching for a missing 12-year-old boy who was swept away in a creek off Akron Peninsula Road.

Nic Shaffer, who has autism, was reportedly dipping his toes into the water when the current swept him away Thursday afternoon.

Family members and neighbors tried to pull him to safety, but were overpowered by the current.

Nic was with his mother and sister.

Family members say Nic, who was wearing shorts but no shirt at the time, can swim but doesn't really like to.

The creek, which is located behind the home Nic lives in with his mother, is typically ankle-deep, but recent rains made the water much deeper with a stronger current.

Anybody who might spot the boy is asked to call authorities immediately.

Surprise homecoming for Marine's family at Cedar Point

CEDAR POINT -- When Gunnery Sergeant Jason Cooper learned he'd have the chance to come home for some R&R this summer, he thought he'd make it a big surprise.

An 18 year veteran of the US Marine Corps, Cooper is stationed with his company in Bahrain, in the Middle East.

This deployment began in February and the Coopers did not think Jason would be able to come home at all until next year.

But Gunnery Sgt. Cooper has surprised them before, and this time he made a gesture on a grand scale.

By coordinating with Cedar Point, he was able to set up a scenario where his family spent the day Thursday at the park for what they thought would be military appreciation.

Lisa Cooper and their three children, Ethan, Jayden and Mikayla, were called up on stage before the nightly light and dance show, to watch a video message, taped by the husband and father.

When the message was over, the family turned around and saw GySgt Cooper in the audience.

He raced up on stage for a hug and a kiss.

"It was a great reaction, seeing the wife all emotional like that, and just being able to hold my daughter, hug my sons, and give my wife a kiss and tell her I'll be home for a while," GySgt Cooper said.

The family will have fifteen days together in Amherst, before the Marine returns to his company in Bahrain to serve the rest off this deployment.

Tow truck driver accused of throwing kittens from vehicle

DOWNLOAD OUR FREE WKYC APPS

MANSFIELD -- A Mansfield man has been charged with cruelty to animals after authorities say he tossed kittens out his truck window while driving down Ashland Road.

William Vollmer, a tow truck driver for Eddie's Sunoco, 947 Ashland Road, denied the misdemeanor accusation.

Vollmer, 33, of Mansfield, told police they have problems with stray cats and kittens at Eddie's Sunoco and that they were probably falling out from under the vehicle, according to the police report.

He said he was not throwing the animals from his window.

"They just crawl up under the truck," he said. "Every impound lot in town has problems with cats. We have a million of them."

But police say a Mansfield couple called them after witnessing the incident. Darlene Harris, 54, said she was driving right behind the tow truck around 1:30 p.m. Tuesday.

"The first thing I saw was this kitten, who came from nowhere, just tumbling across the road," she said. "I thought maybe the cat had just run out, but I just never saw anything running. Suddenly it was just there. I dodged that one."

Harris said she continued behind the truck and watched as Vollmer reached out his driver's side window and dropped two more kittens.

"By the time I saw the third, I thought, I'm calling the police," she said. "I think he was hoping that we would run them over."

Her husband Anthony Harris, 46, was in the passenger's seat.

"I couldn't believe it," he said. "I was reading something at the time, but I felt her slam on the brakes for the first one and I said, 'What are you doing?' She said, 'He's throwing kittens out the window.' We kept following and sure enough he was."

The report said Vollmer reportedly tossed at least three kittens from window.

Anthony said they observed the kittens drop near Rockin Wingz, 595 Ashland Road; then another by Madison Junior High, 590 Ashland Road; and then by the Family Dollar, 431 Ashland Road.

When police searched Ashland Road, a dead kitten was found near Rockin Wingz.

There is good news a part of this forecast as well - sunny, dry and comfortable weather will move in for Thursday and will linger into the middle of next week.

THIS AFTERNOON: Heavy rain showers and thunderstorms are expected, with strong to severe thunderstorms very likely. Hot and humid. Mid/Upper 80s

Cleveland one of America's top bed-bug infested cities

Photo by Justin Sullivan, Getty Images.

DOWNLOAD OUR FREE WKYC APPS

Start scratching. Terminix has just issued its annual list of top bed-bug infested cities. In a twist this year, the exterminator has identified the 15 top cities with the largest increase in infestations.

We'll get to that, but first, a look at where the most bed bug-specific calls from anguished (we presume) customers are coming from. Terminix has 300-plus branches nationwide.

The 15 cities with the greatest increases in bed bug complaint calls to Terminix:

- Sacramento - 54%

- Milwaukee - 53%

- Las Vegas - 50%

- Columbus, Ohio - 47%

- Baltimore - 46%

- Riverside-San Bernardino, Calif. - 41%

- St. Louis - 40%

- Cleveland - 36%

- Louisville - 31%

- Denver - 28%

- Los Angeles - 27%

- San Francisco - 26%

- Dallas/Ft. Worth - 25%

- Nashville - 17%

- Houston - 15%

---

Cities with the top number of calls related to bed bugs through May of this year:

- Cincinnati

- Philadelphia

- Detroit

- New York

- Columbus

- Los Angeles

- Dallas

- Chicago

- Houston

- Baltimore

---

The Terminix press release quotes one of its entomologists as saying bed bugs have been associated with anemia, can lead to problems related to excessive scratching and can have a "psychological impact."

I stay in a lot of hotels and I've never seen a bed bug, nor have I been victim to any of the maladies mentioned here, save for occasional bouts of bed-bug hysteria triggered by reading lists like this one.

The condition causes me to whip off the top bedding for closer inspection of the sheets. I also attempt to look behind the headboard for telltale specks on the wall (though that's more often than not futile, since headboards in the grade of hotels I stay in tend to be bolted to the wall).

But more often than not, I don't think twice about these tenacious little suckers I keep reading about

Am I playing bed bug roulette? Are you on the lookout for bed bugs and, if so, have you ever seen one?
