Spillway Project gets underway in Chagrin Falls

CHAGRIN FALLS -- Success is brewing in Chagrin Falls and three high school buddies couldn't be happier about their dream project coming to fruition.

On Friday, more than 120 people gathered to watch as the construction equipment took the first whack at one of the buildings. Now, know that what is being saved and renovated is all historic but one or two non-historic buildings are being removed to create a parking area.

Spillway LLC is a development group led by three Chagrin Falls residents -- developer Bob Darden of The Darden Group; Darren Wyville; and Chagrin Falls Firefighter Bill Phillips.

The trio will preserve and renovate as many of the existing 28 buildings in the complex as they can.

"There's going to be two restaurants, very family friendly, a microbrewery with a tap room to sample the beers, we're going to have a small theater for small concerts and movies, plus office space," Darden said.

Redeveloping a part of history has its advantages. The property was placed on the National Historic Registry and recently received a $1.65 million tax credit. The demolition and reconstruction work is underway.

They anticipate, with all the businesses coming in, about 100 jobs to start, permanent jobs, and during the construction, they will probably have 75 construction jobs over the 12-month schedule.

The aim is to keep the historic feeling throughout the complex.

The paper mill began its life back in 1858 and was most recently occupied by Ivex.

Chagrin Falls is a destination place, it always has been. The developers just want to make that star a little bit bigger and include this project.

The Spillway Plan calls for renovation of the existing structure to create the following:

  • Restaurant
  • Microbrewery
  • Mill Pond Lounge
  • Outdoor Plaza
  • Boardwalk and Art Area Multi Purpose Room
  • 16,000 square feet of Office Space
  • Venue for visual and performing arts in its theatre and open spaces.
  • Educational source by providing the history of the last standing example of industrial Chagrin Falls.

Spillway developers are hometown boys raised in Chagrin Falls, but at the same time, they are successful business leaders that have statistics to back their belief in this project.

Cleveland: Search underway for teen missing since 1995

CLEVELAND -- New information has led the FBI and police to West 25th Street and I-90 and they are searching for a teenager missing since 1995.

WKYC's Tom Beres says the FBI and police are digging in a basement of a home at 2610 Vega Avenue, an access road along the north side of Interstate 90.

Crime scene tape has also been put around a vacant lot next to the home. Police also have a K-9 unit on-site.

They are removing barrels of materials dug up from the basement. 

The FBI says a tip has led to a search for Christina Adkins who has been missing since January 11, 1995.

Adkins was 17 and five months pregnant when she went missing.

Police investigate reported attack, fire at career college

RAVENNA -- Ravenna Police are investigating after a woman said she was attacked inside a vocational school building.

Police were called to Fortis College on Enterprise Parkway just before 6:30 a.m. for reports of a burglary. When they arrived they talked to a female employee of the school who said she had been attacked and that a small fire has been set in a hallway.

The victim ran to a neighboring healthcare building for help. Her injuries, including burns, according to a police release, are not believed to be life threatening.

Police say the workers from the healthcare building put out the fire before officers arrived.

According to police, a check of the school building and grounds did not turn up any other persons.

The incident is under investigation. The school canceled classes for the day.

NFL settles concussion lawsuit with retired players

Newport Beach, CA -- The NFL has settled the concussion lawsuit filed by a group of former players.

Under the agreement, the NFL and NFL Properties will contribute $765 million to provide medical benefits and injury compensation for more than 4,500 retired NFL football players or their families.

It will also fund medical and safety research, and cover litigation expenses.

A federal judge says the NFL and more than 4,500 former players want to settle concussion-related lawsuits for $765 million.

The global settlement would fund medical exams, concussion-related compensation and medical research.

The plaintiffs include at least 10 members of the Pro Football Hall of Fame, including former Dallas Cowboys running back Tony Dorsett. They also include Super Bowl-winning quarterback Jim McMahon and the family of Pro Bowl linebacker Junior Seau, who committed suicide last year.

The lawsuits accuse the league of hiding known risks of concussions for decades to return players to games and protect its image.

The NFL has denied any wrongdoing.

Senior U.S. District Judge Anita Brody in Philadelphia announced the proposed settlement Thursday. She still needs to approve the deal, which comes after months of court-ordered mediation.

NFL Preseason: Browns v. Bears on Channel 3

CLEVELAND -- The Browns are back in action tonight as they take on the Chicago Bears in their fourth and final preseason game.

You can watch the game live on WKYC Channel 3 with coverage starting at 7 p.m. Kickoff is at 8 p.m.

The Browns go into the game with a 2-1 preseason record. 

So far, they have beat the Rams (27-19) and the Lions (24-6). They lost to the Colts last weekend (27-6).

The first official game of the season comes Sunday, Sept. 8 as the Browns battle the Miami Dolphins at FirstEnergy Stadium. Kickoff is slated for 1 p.m.

Players to watch in Browns final preseason game

CLEVELAND -- We have finally made it.

It is the fourth preseason game for the Browns tonight in Chicago against the Bears. Only a few of the starters will play tonight. The others, including quarterback Brandon Weeden will rest and get ready for the regular season opener Sunday, September 8 against Miami.

So with Weeden getting the night off, we'll get another look at back-up quarterback Jason Campbell. Campbell has had a good camp as the number two quarterback, completing 74 percent of his passes.

One of his targets against the Bears will be receiver Josh Gordon. Head Coach Rob Chudzinski wanted Gordon to play tonight, because he will miss the first two games of the regular season due to his suspension for violating the NFL's drug policy.

Another receiver to keep an eye on tonight is David Nelson. Nelson has missed most of camp with a bone bruise, on the same knee he had surgery on last year. The Browns signed Nelson during the off-season.

This is an important game for many players, because for some, it could be their last. The Browns must make final cuts by the 6pm deadline on Saturday. The Browns have 75 players in camp and must get down to the final roster of 53 players.

Tonight's game can be seen on WKYC Channel 3. Join us at 7 p.m. for a Browns 2012 review. Then at 7:30 p.m. it's the Pregame Huddle. Kickoff follows at 8 p.m.

Ohio sales tax to rise Sunday

COLUMBUS, Ohio -- Shoppers across Ohio will see a one-quarter percent sales tax increase beginning Sunday.

The rate will rise from 5.5 percent to 5.75 percent, or 25 cents for every $100 spent, on vehicles, electronics, clothing and other retail goods.

Ohio lawmakers approved the increase as part of the state's $62 billion, two-year state operating budget. The increase was part of a larger package of tax adjustments that will reduce overall business and individual taxes by an estimated $2.7 billion over the next three years. That includes a 10-percent cut to the personal income tax that will be phased in starting Sunday.

The Ohio Department of Taxation estimates 35 percent of an average Ohio family's spending is subject to the sales tax. Groceries, housing, medicines and education are exempt from sales taxes.

CPD calls news conference on use of deadly force

CLEVELAND -- A 1:30 p.m. press conference has been called by Police Chief Michael McGrath to present the final report from the Police Executive Research Forum regarding the department's policies in use of deadly force.

A press release from Mayor Frank Jackson's office says the PERF study, overall "finds the Cleveland Division of Police policies and procedures sound and comprehensive."

The release also indicates McGrath implemented 25 of 26 recommendations to enhance existing policies and training.

The discussion of use of deadly force has been a prominent topic with the Cleveland Police Department since two people died in a hail of police gunfire following a chase last November.  The investigation into that incident is ongoing.

Others present at the press conference will be Mayor Frank Jackson and Safety Director Marty Flask.

Judge sentences Holly McFeeture to life in prison

CLEVELAND -- A judge has sentenced a woman convicted of slowly poisoning her boyfriend to death by spiking his drink with anti-freeze to life in prison.  Holly McFeeture will be eligible for parole after serving 30 full years.

The sentencing followed a motion hearing in court that saw the judge deny the defense's request for a new trial.

During the sentencing, members of McFeeture's family spoke as did the relatives of her victim, Matthew Podolak.

Podolak's mother told the judge can "finally rest in peace.  Justice has been served." 

Podolak's father says he has struggled with finding forgiveness.  He told the court, "I have forgiven her but I won't forget what she did."

McFeeture did not speak at sentencing.  An appeal is planned.

Two months ago, a jury found McFeeture guilty on two counts of fatally poisoning Matthew Podolak's iced tea with antifreeze at their home in Old Brooklyn in late July 2006.

A pathologist with the Cuyahoga County Medical Examiner's Office, who performed the autopsy on Matthew Podolak, determined he died from chronic intoxication of ethylene glycol -- the active ingredient in antifreeze.

In July 2006, Podolak began experiencing lower back pain and went to the doctor where he was treated for kidney stones.

On July 30, 2006, Podolak was taken to the hospital in pain. His condition deteriorated. He was in extreme pain, disoriented, and vomiting. Podolak died the next day.

Podolak's death was not ruled a homicide until 2010, after Cleveland police received a tip that ruled out suicide and accidental death.

The couple had two children together.

Police: Thief posts sex videos from stolen phone

SOUTH EUCLID -- On Sunday, a resident reported that his cell phone was taken while he was sleeping.

Police said that, to make matters worse, the resident's personal emails, texts, and sexually explicit videos that were on his phone were posted on Twitter and Instagram and sent to the mother of his children.

Police said that this has created a personal hardship for the victim, through the exposure of his affairs.

Mysteriously, police said, the phone was returned to him by leaving it on his doorstep but the suspect kept the phone's SIM card.

Gas station shooting captured on surveillance camera

AKRON -- Police are hoping surveillance video will help them capture a suspect who allegedly shot a man at a gas pump and then stole the victim's vehicle.

It happened around 5:10 a.m. Sunday at the BP in the 700 block of Grant Street.

The footage shows a suspect wearing a red T-shirt exiting from the passenger side of a burgundy Chevy Silverado truck.

Moments later, the suspect approaches a man who was standing near a gas pump and opens fire.

After the shooting, police say the suspect then drives away with the victim's blue 2013 Chevy Malibu with Alabama license plate FCT-5286.

Anybody with information is asked to contact the Akron Police Department at 330-375-2490.

Police warn the suspects should be considered armed and dangerous.

Reward doubled in nurse's murder investigation

CLEVELAND -- The family of a nurse who was murdered in downtown Cleveland in March has announced a $50,000 Crime Stoppers reward for information leading to the arrest of the person responsible. 

Family and friends held a news conference at noon in the area where Aliza Sherman, 53, was fatally stabbed on March 24. Sherman was on her way to her divorce attorney's office when she was attacked.

The reward had been $25,000. The additional $25,000 was raised by Sherman's family members, siblings and friends.

Jenn Sherman says her mother deserves justice and "monsters who killed her must be found."

Crime Stoppers says this is the largest reward in recent memory.

Browns release 4 players

BEREA -- The Browns have released defensive end Dave Kruger, the brother of starting linebacker Paul Kruger, and three others.

Dave Kruger was signed as an undrafted free agent by Cleveland in April. He was slowed during training camp by a concussion.

The Browns also waived defensive back Vernon Kearney, wide receiver Cordell Roberson and linebacker Tommy Smith. Cleveland's roster now stands at 84 players, and the club has to get down to the NFL-mandated, 75-player limit by 4 p.m. Tuesday.

The Browns have yet to make a move with running back Dion Lewis, who had surgery last week on his broken leg. It's possible Lewis could be played on season-ending injured reserve.

Chardon Twp: Two charged in domestic shooting

CHARDON TOWNSHIP -- A Chardon man has been charged with shooting a woman about 7:15 p.m. Sunday night during a child exchange.

Geauga County Sheriff's Chief Deputy Scott Hildenbrand tells WKYC that the shooting occured during a child exchange where one parent was handing the child over to the other parent.

Hildebrand said two men got into a fight at the Clark Road house in the front yard. One man punched the other man and the man that got punched happened to have a gun and pulled the gun out after the fight, according to Hildebrand.

The man then put the gun down but the other man who did the punching picked up the gun and shot his wife in the shoulder.

A Medevac helicopter landed in a nearby park and took the woman to MetroHealth Medical Center. Her condition is not known Monday afternoon.

Hildebrand says that Gary Schussler, 50, of Chardon, was charged with felonious assault and having a weapon under disability while intoxicated.

Anthony Molchak, 47, was charged with assault and negligent assault, according to Hildebrand.

Both are in the Geauga County Jail.

The entire incident was captured on a cell phone video but it is not being made available because it will be used as evidence.

Man involved in fatal police crash sentenced

PAINESVILLE - The man charged in a fatal crash involving a Willoughby police officer has been sentenced to 48 months behind bars.

Scott Leland was sentenced Monday morning for the deadly crash last September in which officer Jason Gresko was killed.

That night, officer Gresko was responding to a call when Leland, who was driving a pickup truck, pulled in front of the cruiser on Harmony Lane.

When Gresko swerved to avoid a collision, the cruiser slammed into a tree.  Gresko later died at a nearby hospital.

Last December, authorities said Leland had a blood-alcohol level of .14 at the time of the crash.

Leland was also punished with a $1,000 fine, a 10-year driver's license suspension, $2,991 in fees and probation for three years following his release.

Judge Joe Gibson declared, "This is an absolutely classic example of why you shouldn't drink and drive."

Blog: Final score was Indians 7, Browns 6

The Cleveland Indians outscored the Cleveland Browns on Saturday and the 6 points the Browns had in the 27-6 loss to the Colts weren't (as usual) from Phil Dawson but from new kicker Shayne Graham.

We are used to now-former kicker Dawson putting lots (or most) of our points on the board but that ship has sailed and we need a new plan.

I am not happy that the Browns lost but at least we don't have a mess like the Jets and Patriots do. More on that in a minute.

It's a race for the wild card for the Indians so it is more important for them to win than a win in the Browns' preseason game, since the Browns are still a work-in-progress and they are 2-1 now in games that don't really count.

Just remember that the Browns beat the the Rams and Lions by a combined 51-25 score in the first two preseason games.

Cleveland is a sports town, as it has shown through decades of winning and losing teams in various sports. This is the time of year that football and baseball collide and I hope that the Indians have much success.

College football gets underway this week as well and the Browns face another short turnaround before the next game on Thursday in Chicago against the Bears.

That being said, at least the Browns didn't have the havoc on the field that the Jets did.

Remember that the Jets cut back-up QB Tim Tebow and he is fighting -- and apparently failing -- to win a spot on Bill Belichick's Patriots. Tebow rode the bench in the Patriots' 40-9 loss to the Lions last Thursday.

Adding to that, the Patriots had already cut QB Brian Hoyer -- a Lakewood native and St. Ignatius grad -- and Hoyer is now with the Browns behind Brandon Weeden and Jason Campbell. But I digress.  

So Saturday night, the Jets played rookie Geno Smith and, unfortunately, proved he really wasn't ready to take the job. He threw three interceptions and stepped out of the end zone in a panic for a safety.

The Jets' Rex Ryan -- in a move even I couldn't imagine -- put QB Mark Sanchez back in against the New York Giants in the fourth quarter and he was hurt. What was Ryan thinking? The game really means nothing and now you send in your best quarterback? So you beat the Giants in a meaningless game and lose a QB?

We don't know how bad Sanchez's injury is but now Smith is a front-runner for the spot...by default, apparently.

At least the Browns don't have a quarterback controversy this year. So let's stop worrying about the preseason and set our sights on when the games really count.

Good Samaritan saves boy, unable to save man from drowning

CLEVELAND -- One man has died after attempting to save a boy from drowning at Euclid Beach Park Saturday evening. 

Rescue crews first received a call for a swimmer in distress came in around 4:35 p.m. 

Fire crews say two people were missing in the water.

Witnesses say a 24-year-old man entered the water, attempting to help a boy in distress. 

According to MetroParks Rangers, a 10-year-old was found by a good Samaritan who heard the calls for help. The Samaritan ran down to the beach and pulled the boy out of the water in less than 5 minutes. 

Rescue crews arrived and took the boy to Rainbow Babies and Children's Hospital. 

Over an hour after the initial call, dive teams pulled 24-year-old Euclid resident Traveno Sledge from the water. Eyewitnesses say he is the boyfriend of the 10-year-old's mother.  

Sledge was taken to Euclid Hospital by rescue crews where he later died.

The area where the boy was swimming does not have a lifeguard on duty.

Both the Cleveland Fire Department and Cleveland MetroParks Rangers had dive teams at the scene.

The U.S. Coast Guard also responded to assist with search efforts.

Woman ejected, trapped under car during crash

NIMISHILLEN TOWNSHIP, Ohio -- The Ohio State Highway Patrol is investigating an accident that trapped a woman underneath a car.

The accident happened overnight Sunday around 1:51 a.m on Columbus Road just east of Paris Avenue.

Bruno Lindo, 24, was headed east on Columbus Road when he lost control and went off the side of the road. The Ford Explorer came back on the road and overturned.

The passenger, Lindsay Costa, 22, was thrown from the SUV and was trapped under the car.

Fire rescue crews responded to the scene and were able to free Costa. She suffered a serious injury to her leg and was taken to Aultman Hospital for treatment. 

Lindo was also transported to Aultman Hospital to be treated for minor injuries.

Troopers believe alcohol may have affected the driver's ability to safely drive. The crash is still under investigation.

Parma Heights: Local bar busts cell phone caper

PARMA HEIGHTS -- The owner of Cleats, Harry Santillo, and his nephew helped to bring an end to a string of cell phone thefts, after apprehending the suspect inside their bar.

The thief had already stolen 2 phones from Cleats and came back a third time when they caught him.

After investigating, police found he was working with at least 2 other people and they've nabbed 6 phones from bars in Parma, Parma Heights, and Middleburg Heights.

Santillo said, "Growing up on the west side I was always taught to get involved. If you can help someone out, or deter something, why not?"

Cleats proudly changed its slogan at the location to "safest bar in town."

US forces move closer to Syria as options weighed

WASHINGTON -- U.S. naval forces are moving closer to Syria as President Barack Obama considers military options for responding to the alleged use of chemical weapons by the Assad government.

Obama is stressing that a quick intervention in the Syrian civil war is problematic, given the international considerations that should precede a military strike.

Defense Secretary Chuck Hagel, traveling to Asia, declined to discuss any specific force movements while saying that Obama had asked the Pentagon to prepare military options for Syria.

U.S. defense officials say the Navy has sent a fourth warship armed with ballistic missiles into the eastern Mediterranean Sea but without immediate orders for any missile launch into Syria.

According to reports, a chemical attack in a suburb of the Syrian capital killed at least 100 people this week.

Akron: Man stops robbers with hot water

AKRON -- A pair of wannabe robbers were scared away by a fast-thinking employee who defended himself with hot water.

Police say it was around noon Wednesday when two males tried robbing the Church's Chicken at 700 South Arlington Street.

Surveillance video shows two unidentified men walking through the back door -- one armed with a handgun.

An employee, who was in the back room washing dishes, used a hose to spray hot water at the suspects.

Both criminals quickly fled the scene out the same rear door.

Seconds later, the suspects tried running back inside when the worker continued spraying hot water in their direction.

They finally fled the scene for good empty handed.

Akron Police believe these suspects were involved in a previous robbery just a few days earlier at the same Church's Chicken on Sunday night.

Anybody with information is asked to contact the Akron Police Department at 330-375-2490. Police warn these suspects should both be considered armed and dangerous.

Woman fights off attempted abduction in Elyria

ELYRIA -- Police are looking for a man who grabbed and attempted to abduct a woman as she walked in Elyria.

The woman told police she was walking just before midnight on East River Street on August 22 when she noticed a man in a Dodge pickup truck sitting in the hospital parking lot with the engine running.

The victim says the man jumped out of the truck and ran across the street to grab her. The woman says she was physically picked up by the suspect who attempted to take her back to his truck.

The victim kicked and screamed and drew the attention of a passing driver who slowed down. That's when, the victim says, the abductor let go of her, ran back to his truck and took off.

The woman says she did not know her attacker. Police are searching for the suspect.

Bradley Manning says he wants to live as a woman

NEW YORK -- Bradley Manning says he plans to live as a woman and begin hormone therapy, a day after the soldier was sentenced to 35 years in prison for sending classified information to WikiLeaks.

In a written statement provided to NBC's "Today" show on Thursday morning, Manning said he planned to live as a woman named Chelsea.

A military judge announced the sentence in Manning's court-martial on Wednesday. Manning's struggle with gender identity disorder -- his sense that he was a woman trapped in a man's body -- was a key part of the defense.

Attorneys had presented evidence of Manning's struggle with gender identity, including a photo of the soldier in a blond wig and lipstick sent to a therapist.

Cleveland Police Union endorses Ken Lanci for Mayor

CLEVELAND --- The Cleveland Police Patrolman's Union's membership has voted to endorse businessman Ken Lanci in his bid to unseat Mayor Frank Jackson.

The union has expressed a vote of no confidence in Chief Michael McGrath and called for his ouster.

Mayor Frank Jackson has said he has no intention of firing the chief or Safety Director Marty Flask.

The union is upset with McGrath's comments and handling of the investigation of the November citywide chase and shooting that left two unarmed suspects dead.

Lanci has said there is a big disconnect between Cleveland residents and its safety forces.

He has said he would fire McGrath and Flask if he were mayor.

He has called on police officers to donate some time to help with community problems.

The Fraternal Order of Police and Firefighters' Union have yet to back a candidate in this race.

Ohio releases new A-F report cards to schools

COLUMBUS --  Ohio's top public schools official says no district received all As on Ohio's new A-F report cards, and none received all Fs.

Superintendent Richard Ross told reporters ahead of Thursday's release of the first round of new scores that districts instead fell at all points on the scale.

The 2013 report cards rate schools and buildings in the first nine of 18 new performance criteria. Districts and buildings won't receive overall letter grades until 2015.

The Ohio Department of Education released the data on an interactive state website. Aggregate state results weren't immediately available.

The revamped system replaces the six-tier assessment system that featured such labels as "Excellent" and "Continuous Improvement."

The Cleveland Metropolitan School District says the ODE results showed few improvements for the district over the previous year.

"The incremental gains we are seeing on last year's report card are precisely what we have seen year after year, and this is not the change we want or the community demands for our schools," said CEO Eric Gordon. "As we enter the 2013-2014 school year, CMSD's report card is the same as before, but CMSD is not."

The district has implemented the Cleveland Plan to transform the schools and is coming off its first levy passage in 16 years to help fund the schools.

"Seeing another 'F' on our report card is sobering at the start of a new school year, particularly for this staff and this community who worked so hard to bring about the changes we must see in our schools," said Gordon. "But a walk through any one of our schools this year shows that CMSD is clearly not where we were one year ago."

"Ohio has raised the standards for what we expect from schools and clearly Cleveland is not meeting them right now," State Superintendent Richard Ross said. "But I am very hopeful that the aggressive and bold Cleveland Plan will significantly improve the long-term performance of the Cleveland school system. Everyone in Ohio has a stake in seeing that all boys and girls in Cleveland get the education they need to enjoy a bright future."

Company's ties to Pilot questioned in settlement deal

NASHVILLE, Tenn. -- The man who formed the corporation now seeking to settle multiple lawsuits against Pilot Flying J heads a trucking association of which Pilot is a member and major contributor.

Lane Kidd, an Arkansas resident, filed incorporation papers for National Trucking Financial Reclamation Services LLC on April 22, just days after the FBI conducted a widely publicized raid on Pilot's Knoxville headquarters.

Two days later, National Trucking filed the class-action suit leading to the proposed settlement. That led other trucking companies to argue in court filings that Kidd's firm was a "shell" company, "hastily conjured in Arkansas" for resolving the civil cases against Pilot, which has been accused by federal authorities of cheating trucking companies out of promised rebates.

Kidd also is the head of the Arkansas Trucking Association, which counts Pilot as a major contributor and a member. In fact, the two corporations share the same office suite in Little Rock, Ark., according to corporate and tax records.

The relationship between Kidd and Pilot came to light as lawyers for some trucking companies question the so-called global settlement, defined as one that would settle all civil claims against the company.

In one filing this week in Knoxville, Drew McElroy, the attorney for Atlantic Coast Carriers and three other trucking firms, charged that National Trucking was a "shell corporation" that shouldn't qualify to be part of the class action.

"National Trucking is not a trucking company and has never bought a gallon of fuel from Pilot," the motion states.

Kidd could not be reached for comment.

A Pilot spokeswoman acknowledged that the truck stop chain is a member of the Arkansas Trucking Association but said Pilot had nothing to do with the filing of incorporation papers for National Trucking, the lead plaintiff in the Arkansas suit.

In a separate motion filed Aug. 14 in an Alabama federal court, the attorney for Wright Transportation, Stephen M. Tunstall, made an almost identical charge -- that National Transportation was "a shell company recently formed" and that it was not a trucking company or a customer of Pilot.

Pilot's attorneys had petitioned a federal court in Alabama to put the Wright case on hold pending a settlement in Arkansas, but a magistrate judge rejected that request earlier this week.

Wright's lawyers say the so-called settlement does nothing more than give the trucking companies what had been offered publicly by Pilot CEO James A. Haslam himself outside of any court action.

"Following the unsealing of the FBI affidavit and the execution of the search warrant," the Wright motion states, "the defendants went into damage control."

Although Pilot's lawyers said the proposed agreement was a "global, class-wide settlement of all claims," the motion states, "Wright Transportation and other plaintiffs were unaware of any such discussion."

Kidd's association, which is incorporated as a nonprofit, publishes a magazine, the Arkansas Trucking Report, which includes frequent references to Pilot and the fact that the Knoxville truck stop firm is a Gold contributor to the association's annual conferences.

An article in the April 2012 issue of the magazine states that Pilot is a corporate member of the association.

After the settlement was proposed, the magazine published an article with the heading, "We're glad that Mr. Haslam stepped up and did the right thing." The quote came from a statement made by National Trucking's attorney, Michael Roberts.

On Monday, Pilot attorney Aubrey Harwell issued a statement supporting the proposed settlement and quoted one of the attorneys involved in the case as saying it was "the best settlement he ever negotiated."

"It provides that all Pilot Flying J customers who are owed money will be paid quickly, every dollar owed plus interest," Harwell wrote.

Under the agreement, lawyers for the trucking companies will share in fees totaling as much as $14 million. For Pilot, meanwhile, having the cases consolidated in one court would spare the company the expense of defending itself in multiple courts across the country. More than 20 suits have been filed.

Kidd, who is in the midst of a federal bankruptcy case with his wife, Jennifer, earned $194,729 from the association in the most recent fiscal year, according to the association's tax returns.

The tax returns also show that Kidd's wife heads a publishing company, Matthews Publishing Group, which gets paid by the association with annual fees ranging from $74,852 to $221,824.

Kidd also is registered with the state of Arkansas as a lobbyist for the trucking association, Arkansas state records show.

CSI detective shot at while processing burglary scene

CLEVELAND -- Cleveland Police are investigating a felonious assault on an on-duty detective.

Cleveland Police say a Crime Scene Investigation Unit Detective was shot at early Thursday morning while processing a burglary scene on the east side.

Residents called police after hearing gunshots in the area of East 121st and Luke Avenue around 2:30 a.m.

Police say at that time, a CSI detective was at his car and multiple shots were fired at the detective.  Several near-by homes were also hit by the spray of bullets.

The CSI detective returned fire and it's not known if the suspect with the gun was hit.

Detectives and officers are looking for the suspect.

The CSI detective was not hurt.

Whiskey Island salt mine closes, safety concern investigated

CLEVELAND -- Cargill, the company that owns the salt mine at Whiskey Island in Cleveland, has closed the facility to investigate a safety concern in the mine.

Mining operations were suspended Monday, after a routine study of the area indicated some slight movement in an area that was mined years ago.

"We decided to take a prudent position and temporarily stop the underground mining operations while we assess the situation," said Cargill Salt Spokesman Mark Klein.

While Cargill is not mining this week, it will still be shipping salt that has already been mined at the site.

The exact points of data that prompted the closure of the mine are not entirely clear. The company says it is too soon to say whether any seismic activity was involved.

Various measurement tools, including a seismometer, are being delivered to the site today and further study of the mine will continue this week.

Cargill mine workers are on paid leave for the rest of the week as a precaution.

It is not clear how long the tests will take. Klein says the company will take as long as is necessary to ensure the safety of its workers.

Blog: Dick Van Dyke, LeBron's 'freeway escapes'

Comic actor Dick Van Dyke and athlete LeBron James used social media after their 'freeway escapades' on different coasts within the last four days with widely different results...and consequences.

Van Dyke's tweets and the video he posted online from California Monday were self-effacingly funny while LeBron's Miami freeway video posted on Instagram and his Twitter feed smacked of self-importance.

LeBron's video also landed a Miami-Dade police officer in hot water.

Let's start on a positive note.

Van Dyke, 87, and his wife Arlene, 41, thankfully escaped unhurt when their Jaguar XJ caught fire on the 101 Venture Freeway near Parkway Calabasas about 2 p.m. (PST) Monday outside Los Angeles.

They were on the way to Van Dyke's dentist when the Jag's engine started smoking and they pulled to the side of the road. Passersby helped them out of the Jag.

Later Arlene posted a video and tweeted "He's fine Thank God!'and Van Dyke -- with his sense of humor clearly showing -- tweeted that his Jag was now on the market, saying "Used Jag for sale REAL CHEAP!!" with a pic of the car's blackened body.

On the other coast, there was a different type of freeway escapade Friday night which is proving days later that even LeBron James is expected to deal with traffic.

LeBron was enroute to a Jay-Z/Justin Timberlake concert at the Sun Life Stadium when he was caught in traffic about 8 blocks away. Supposedly Jay-Z announced that he would be waiting to start the concert until LeBron arrived.

Details are sketchy on how the police escort was initiated but suffice to say that a so-far-unidentified officer, part of an off-duty team working at Sun Life, led LeBron's vehicle, containing LeBron and fiancee Savannah Brinson, down the wrong side of the street eight blocks, with the cruiser's lights flashing, right to Sun Life.

But it was the video LeBron posted on Instagram -- which went straight to his 3.5 million followers on Twitter -- of them following the cruiser that caught the eye of the world AND Miami-Dade police.

"They treat us so well! Needed it cause traffic was nuts!!" and  "Light police escort on the wrong side of the street," LeBron tweeted. He added, "Headed to the big homie concert, JT. Holla!"

On Monday, Miami-Dade police launched an investigation into the officer who gave King James the "royal" treatment. Police say the escort "violated policy."

You think?

Social media is here to stay and I am sure LeBron didn't do it to get an officer in trouble but that happened just the same. Sometimes your own "self-importance'" can backfire.

Sheriff: Man arrested after falling asleep during burglary

RAVENNA TOWNSHIP -- A man has been booked into the Portage County Jail after the sheriff's office says he fell asleep during a burglary at a home in Ravenna Township.

According to Portage County Sheriff David W. Doak, the homeowner arrived at his house on Jean Drive after work on Monday afternoon and found a stranger asleep in his bed. The sheriff's office says the stranger was wearing the homeowner's clothes and had the homeowner's shotgun on the bed beside him.

When the man awoke he reached for the gun but the homeowner was able to grab it first and detained the man until deputies arrived.

Deputies determined that the stranger, identified as Dustin Sellers Applegate, 31, had allegedly forced entry into the house and gathered items from the home into a backpack before falling asleep.

Applegate is charged with aggravated burglary and is due in court later Tuesday.  According to the sheriff, Applegate has a last known address of Sheldon Street in the City of Ravenna.

Browns name Brandon Weeden starting quarterback

BEREA, Ohio -- Brandon Weeden has been named the Browns' starting quarterback.

Coach Rob Chudzinski announced the decision, ending weeks of speculation about whether Weeden would start the season opener against Miami on Sept. 8.

Chudzinski said Weeden has earned the job with a strong offseason, training camp and preseason. Weeden started 15 games as a rookie last year, but Chudzinski and the Browns' new coaching staff wanted to see improvement from the 29-year-old -- and they have.

Chudzinski has been pleased with everything Weeden has shown and said the QB has the team's full support.

Weeden was pushed in camp by veteran Jason Campbell. In two preseason games, Weeden has completed 18 of 25 passes for 229 yards and three touchdowns.

Amherst Police are just a text message away

AMHERST -- You can now reach out to Amherst Police through text messaging.

Text messages are now being accepted directly into the Amherst Police Department dispatch center for callers wanting to report tips and ask non-emergency questions.

The text line is 440-988-4422.

Officials with the police department say the texting option allows the community another way to contact authorities with questions and minor concerns instead of taking the time to call in.

The Amherst Police Department answers calls for the utilities department after hours and on weekends and holidays. This amounts to 74 percent of the year and creates an increased obligation on the dispatcher during times of power outages, water main breaks and storm-related issues. 

When the utilities (water, electric) go out in a neighborhood, it is not uncommon for the dispatch center to receive numerous calls at one time. Callers report the utility outage, ask when the utility will be restored and often call back to inquire how much longer before the utility is restored.  

The same holds true for storm-related issues. Officials say receiving multiple calls from several residents while a dispatcher is trying to make outgoing calls to contact the utility workers to get services restored, while dealing with priority police radio traffic is very challenging. Non-emergency callers may be placed on hold for long periods of time when they only want to ask a simple question or report a minor problem. 

Amherst residents, business owners and customers of Amherst utilities are strongly encouraged to text their non-emergency questions and minor concerns into the police dispatch center instead of calling.

Because citizens do not generally know when dispatchers are busy, there are several other questions and situations authorities encourage the public to text:

- What time is trick or treat, parades, Christmas tree lighting, etc.?

- What time is curfew?

- Checking to see if an accident report is completed and/or ready for release.

- Checking if a public records request is ready to be picked up.

- Citizens who are hearing and/or speech impaired.

Besides texting the dispatch center with minor questions, you may also text Amherst Police with minor concerns, information or complaints that are not an emergency. Some examples of these are: 

- Minor parking complaints.

- Area utility outages.

- Traffic control devices that are not working properly.

- Storm-related damage that needs a city worker's attention (the city will determine the need for immediate attention).

- Minor safety concerns.

- Building code violations.

- Minor nuisance calls, such as barking dogs or loud music.

- Dead animals on the side of the road.

Residents are encouraged to text any of the above complaints or concerns. If it is a minor complaint where an officer is needed to respond, the dispatcher may text you back requesting more information including your name, address as if you called in. Or, if the issue you are reporting is more than minor, you may be asked to call into the dispatch desk or a dispatcher may call you.

Amherst Police say school-aged children are more willing to text information they would not normally report in person. Many students become aware of information and situations they do not want to tell a teacher or police officer in person even though the issue may be an important safety concern. Large posters will be placed throughout the high school and junior high school encouraging students to text the police department with tips and information. 

- Student concerns.

- Drug activity tips.

- Alcohol activity tips.

- Known underage drinking parties.

- Planned fights.

- Tips on recent crimes such as thefts, vandalism and drug sales.

- Bullying.

- Concealed weapons tips.

- Concerns for others (suicidal thoughts, depression).

When you do text the dispatch center, please give the dispatcher several minutes to respond. If you do not get a response in a reasonable amount of time, please call one of the non-emergency phone lines.

How does it work?

Amherst Police took one of their landline phone lines that was simple to remember (440-988-4422) and ported it to a cellular phone. 

Each of the dispatch consoles has the ability to connect their computer to that cellular phone through a secured Wi-Fi connection. 

When a text message comes in, it appears on the dispatcher's computer monitor. The dispatcher then uses their standard keyboard to reply to the messages as time permits. 

Because all phone calls are forwarded from the cellular phone to our regular landline phones, citizens may still call 440-988-4422 and speak directly to a dispatcher. Also, the system will remind the dispatcher once every 60 seconds until they acknowledge or reply to a waiting text message.

A note of caution:

Do not text emergency situations where immediate police response is necessary. Please call 440-988-2625 or 911 if it is an emergency.

Do not text the police dispatch center (or anyone) while driving.

Any phantom or bogus texts will be dealt with through criminal means and seizure of your electronic device as evidence will likely occur.

Defense presents its case in Zack Reed OVI trial

CLEVELAND -- Councilman Zack Reed's drunk driving trial continues today as defense attorneys are presenting their case.

The prosecution presented and wrapped its case Friday.

Reed was arrested last March at the intersection of East 9th Street and Rockwell Avenue after he police say he ran a red light and made an illegal turn.

Reed claims officers smelled Listerine, not alcohol on his breath.

He refused to take a breath test.

Reed was previously convicted of driving under the influence in 2005 and 2008.

Cleveland police: Abducted woman driven non-stop since kidnapping

CLEVELAND -- Police say a suspected kidnapper is dead and the woman he allegedly abducted has been found alive.

35-year-old Kenya Pierce, who was kidnapped at gunpoint during the weekend, was found early Monday at a location on West 42nd and Mapledale.

At a mid-morning news conference, police said Pierce had a broken arm and was still being evaluated at the hospital but was otherwise in good condition.

Her alleged abductor, 35-year-old Derek Hudson, was found dead of a self-inflicted gunshot. He's accused of kidnapping Pierce after shooting two of his own relatives.

Authorities say they were tipped to that location around 7 a.m. after a neighbor spotted the suspect's car parked on Mapledale. Upon their arrival, police saw both the suspect and victim inside the vehicle. When officers approached, Hudson reportedly shot himself in the head.

Cleveland Police Chief Michael McGrath says Hudson drove Pierce in a car without stopping during the entire ordeal traveling back and forth to Detroit as well as Elyria before being found.

Police say it all started Saturday morning when an argument broke out at a home in the 12400 block of Chesterfield Avenue.

The owners of the home, identified as Hudson's aunt and uncle, went upstairs to see what the argument was about. That's when police say the two were shot by Hudson.

The victims, 52-year-old Ethel Munds and 55-year-old Andre Munds, were taken to MetroHealth Medical Center. One has since been released from the hospital, the other remains in treatment.

Police say Hudson then took Pierce at gunpoint and fled the scene.

Hudson was released on parole earlier this year after serving 10 years for killing Pierce's boyfriend.

Chief McGrath says Hudson was "obsessed" with Pierce.  "He couldn't leave her alone," Chief McGrath told reporters.

Sunday, Pierce's mother pleaded with the suspect to let her daughter go.

Cleveland sports fans are hungry for a championship or at least a playoff appearance.

But its sports teams are getting ready to deliver something else -- a bid to renew Cuyahoga County's sin tax on alcohol and tobacco products.

Cleveland: Woman kidnapped, two shot, Police continue to search for suspect

CLEVELAND -- A woman was kidnapped and two people have been shot Saturday.

Police told Channel 3 an argument occurred between kidnapped woman Kenya Pierce, 35, and Derrick Hudson, 35, a man that may have been staying with her.

The incident happened on the 12400 block of Chesterfield Avenue.

The owners of the home, now identified as Hudson's aunt and uncle, went upstairs to see what the argument was about. That's when police say the two were shot by Hudson.

The victims, 52-year-old Ethel Munds and 55-year-old Andre Munds, were taken to MetroHealth Medical Center. Ethel was treated and released Sunday. Andre remains in critical condition.

Hudson then took Pierce at gunpoint and fled the scene in a red, 2007 Dodge Magnum with the license plate FHY4340. The car was last seen in the area E. 105th Street in Cleveland.

Police say the car is registered to Pierce and it's believed the car may have damage on both sides.

Hudson is described as armed and dangerous, he is a black male, 35-years-old, 5'10", 185lbs and bald.

Pierce was described as a 35-year-old female wearing a white shirt, vest, and jeans.

Hudson was released on parole just this year after serving 10 years for killing Pierce's boyfriend.

This is the seventh shooting Cleveland police are investigating overnight.

Cleveland: Woman kidnapped, two shot - police looking for suspect

CLEVELAND -- A woman has been kidnapped and two people have been shot Saturday and Cleveland Police say they cannot find a child connected to the case.

Police told Channel 3 an argument occurred between the kidnapped Kenya Pierce, 35, and Derrick Hudson, 35, a man that may have been staying with her.

The incident happened on the 12400 block of Chesterfield.

The owners of the home went upstairs to see what the argument was about. That's when police say the two owners were shot by Hudson. The victims were taken to MetroHealth Medical Center and are in stable condition.  It is unknown how severe their injuries are. 

Hudson then took the Pierce and fled the scene in a red Dodge Magnum with the license plate FHY4340.  The car was last seen in the area E. 105th Street in Cleveland.

Hudson is described as armed and dangerous, he is a black male, 35-years-old, 5'10", 185lbs and bald.

Pierce was described as a 35-year-old female wearing a white shirt, vest, and jeans.

Hudson was on parole for manslaughter, reguarding a 2003 case.

This is the seventh shooting Cleveland police are investigating overnight.

The home was for sale. Authorities say nobody was home at the time.

Man suspected in wife's murder appears in court

WILLOUGHBY HILLS -- A 43-year-old man who was arrested last week in connection with his wife's stabbing death from last November will be in court this afternoon.

Kevin Knoefel was taken into custody last week after a lengthy investigation into the Nov. 16, 2012 murder of his wife, Lisa Knoefel.

After Lisa was killed, authorities arrested and charged 18-year-old Sabrina Zunich, who was identified in earlier reports as the couple's foster daughter.

It's alleged that Kevin Knoefel engaged in discussions with Zunich and devised multiple plans to murder his wife while she was asleep. He's also accused of telling Zunich which knife should be used in the stabbing.

GM recalls nearly 293,000 Cruzes for brake problem

DETROIT -- General Motors is recalling nearly 293,000 Chevrolet Cruze compact cars in the U.S. because the power-assisted brakes can fail.

The company says the recall affects Cruzes made in Lordstown, Ohio, from the 2011 and 2012 model years.

The cars have 1.4-liter turbocharged gasoline engines and 6T-40 six-speed automatic transmissions.

GM says the power brake boosters can fail and in rare cases, drivers may have to put extra pressure on the pedals to stop the cars.

GM says Cruze brake problems have caused 27 low-speed crashes but no injuries. Dealers will replace a switch in the power brake vacuum pipe assembly for free.

CLEVELAND -- Jury selection began Thursday morning for Councilman Zack Reed's OVI trial.

On March 5, Reed allegedly failed a sobriety test after police say he was stopped for running a red light and making an improper turn around 2 a.m. near East 9th Street and Rockwell Avenue.

Previously, Reed served a 10-day sentence in 2008 on his second drunk driving conviction.

If he is convicted in this instance, Reed could face one year in jail.

Ariel Castro knife being sold on eBay

A knife that's for sale on eBay could be from the home of Ariel Castro.

The knife appeared for sale earlier this week. There is an opening bid for $100 on the knife.

The sale closes on August 16th.

The item was listed by a seller with the name 'itsalwaysunique.'

There is a single image of the small pocket knife with a leather case.

There's no way to verify this was actually take from Castro's home but is described as a "one of a kind" piece.

Extensive efforts were made during the demolition process of Castro's home to prevent items from being sold for profit.

Castro's home on Seymour Avenue was destroyed after he admitted to hold Amanda Berry, Michelle Knight, and Gina DeJesus captive there for several years.

CLEVELAND -- The Browns are back for game two of the preseason Thursday night as they battle the Detroit Lions at FirstEnergy Stadium.

Tough luck for Tough Mudder runners, sickening details

BROOKLYN, Mich. -- State health officials say a virus that sickened people who participated in a long-distance race through mud and other obstacles in southern Michigan likely originated from a participant on the course.

The state Department of Community Health says there were more than 200 reports of gastrointestinal problems from spectators and runners at the June 29-30 Tough Mudder event in Jackson County. The event included more than 22,000 participants and spectators.

The department says it's a norovirus, which is common and produces flu-like symptoms for a few days.

In an update Tuesday, the Department of Community Health said that most illnesses were reported from people who had mud or muddy water in the mouth.

The state says Tough Mudder officials are working with health officials to prevent future problems.

Teens arrested in purse-snatching attack, dragged victim

AKRON -- Two teens have been arrested after a 51-year-old woman was attacked and robbed of her purse Tuesday afternoon.

Police say the incident happened around 4:30 p.m. as the woman was walking to her car in a parking lot in the 1100 block of West Portage Trail.

The two suspects, ages 14 and 16, reportedly grabbed her purse and dragged her through the parking lot during the attack.

Once the suspects snatched the purse, they fled to a nearby wooded area.

Police say the victim suffered injuries to her right arm and right leg and ankle. 

Responding officers later located the two suspects in an apartment complex.

Both teens were placed in custody of the Summit County Juvenile Detention Center on charges of robbery and obstructing official business.

10 years ago everything went dark

Wednesday is the 10th anniversary of the Great Northeast Blackout of 2003.

It put 55 million people in six states and Canada in the dark and it's blamed on a perfect storm of problems that started right here with FirstEnergy.

Could something like this happen again?

The Eastlake FirstEnergy power plant was the first plant to shut down. Before it was done, more than 100 plants were out of commission.

It was a chain reaction of small things that snowballed, starting with trees pressing on a power line and a software bug that kept an alarm from going off.

It became a memorable two days no one wants to relive.

The power went out in the middle of Little Italy's Feast of the Assumption celebration. Some say it was nice but others said that, happening two years after 9-11, it was scary.

It was a lot of small problems that spread like wildfire, causing 50 million people to lose power and eventually costing $10 billion.

The U.S./Canadian report put most blame on FirstEnergy, for tree limbs that that smacked a power line in Walton Hills and software problems kept an alarm from going off that snowballed, putting New York City and parts of Canada in the dark.

Cleveland's water system lost pressure and filtration. Its planners weren't ready but that's changed.

FirstEnergy's spent a hundred million dollars on improvements -- new monitoring equipment, better computers, worker training, better maintenance and serious tree trimming.

The $45 million Akron Control Center will show workers the big picture for half of its operations and two back-up diesel generators are ready just in case.

Lots of utilities are learning FirstEnergy's lessons. Two Generators that were shut down at the Eastlake Plant are being rebuilt into equipment to to help control conditions on the grid by stabilizing voltage.

The other big-ticket item for FirstEnergy? Tree trimming. It has spent $320 million to cut trees and control vegetation since the blackout.

Agency handing out $15,000 loans to prospective home buyers

CLEVELAND -- A new incentive program will provide $15,000 down payment loans to qualified home buyers.

The catch?

The house they buy must be in Cleveland.

But, if the buyer lives in the home for at least five years, he or she doesn't have to pay the loan back.

It's a proposal to revitalize some areas of the city that have seen better times.

Neighborhood Housing Services of Greater Cleveland will hold a two-day event Sept. 12 and 13 at the Cleveland Convention Center, where prospective home buyers can find out if they qualify.

Parma 'rollover' accident causes two other accidents

PARMA -- One driver was taken to MetroHealth Medical Center after a rollover accident this morning.

The accident happened at the intersection of Pleasant Valley and York roads.

Police say a man in his 70's was taken to MetroHealth Medical Center.

Police said two other minor accidents happened as a result of people trying to see the rollover accident.

The cause of the rollover is still under investigation.

Tallmadge bodies identified as missing mom, son

TALLMADGE -- Tallmadge Police say the Summit County Medical Examiner has identified both sets of remains found in a wooded area Saturday on Stone Creek Drive as those of Wendy Ralston and her 5-year-old son, Peyton.

The two were reported missing on Aug. 7 by Ralston's mother.

The medical examiner identified Wendy Ralston's remains on Monday night. Police announced the identification of the child's remains at a Tuesday morning news conference.

Police say Ralston's mother went to the home on Stone Creek Drive on Aug. 10 and found what she thought were remains wrapped in bedding in the woods. She then contacted police who recovered the bodies.

Authorities say it appears the two were killed inside the home.

This incident, which is being investigated as a double homicide, marks the first murder in Tallmadge in eight years.

Ohio BCI Crime Scene and Cyber Crime units helped Tallmadge Police search Ralston's home and backyard Monday, towing two vehicles into evidence. Police said Tuesday the vehicles belonged to Ralston and her live-in boyfriend.

Police say they have interviewed the boyfriend, a 39-year-old man who also lives at the home, saying he has been cooperative with investigators.

Police also say there are numerous persons of interest as part of their investigation of the crime.  No suspects have been identified.

Stow Municipal Court records show Ralston was to be evicted from the duplex Friday, Aug. 16.

Authorities say they had responded to the property numerous times in the past for domestic issues.

"We hadn't seen the little boy in a few weeks," said neighbor Cara Butcher. "He was always on his bike or his little big wheels and stuff. (Ralston) was always out with him. She seemed to be doing really good."

Tallmadge police questioned neighbors last week after Ralston and her son were reported missing Wednesday.

The Summit County Medical Examiner is conducting autopsies to determine how they died.

Butcher's son, 12-year-old Grant Geer, says he and friends had noticed a smell while playing in the woods behind the homes.

"We were walking through the woods and (my friend) smelled something kind of odd. He said, 'Hey what's that smell?' I said, 'It's probably a dead animal.' He said, 'No it's not. That's not what dead animals smell like.'"

Authorities say the bodies were badly decomposed, appearing to have been in the area for two weeks before they were discovered.

"It's very scary and especially we don't have answers as to what happened. Should we still be nervous? Is there somebody out there?" said Butcher.

Summit County: Two bodies discovered in Tallmadge

TALLMADGE -- Remains found near a Tallmadge home have not been identified, but police are looking at a missings persons case in connection to the discovery.

Lt. Ron Williams tells Channel 3 News that Wendy Ralston and her five-year-old son were reported missing August 7. Ralston lived near Stone Creek Drive, where the bodies were located.

The Summit County Medical Examiner will perform autopsies on the remains of two bodies that were found in a wooded area in Tallmadge.

Lt. Williams said the bodies were badly decomposed, appearing to have been in the area for two weeks before they were discovered.

Police say the bodies were discovered Saturday in the 500 block of Stone Creek Drive.

Police did not speculate on the cause of death but said they were called by a woman who went to the house to check up on her daughter.

Neither victim's identity has been determined.

Officers had a home taped off on Stone Creek Drive early Monday morning.

Condos collapse into sinkhole near Disney World

Engineers on Monday were trying to determine the extent of the damage after luxury resort condominiums crumbled into a massive sinkhole a few miles from of Disney World.

Dozens of guests at the Summer Bay Resort in Clermont, Fla., had only 10 to 15 minutes to escape the cracking, collapsing building, the Orlando Sentinel reports. No injuries were reported, but many fleeing guests left behind all their belongings -- including medications.

About 30% of the three-story structure collapsed early Monday, Lake County Fire Rescue Battalion Chief Tony Cuellar said. The villa at the Summer Bay Resort had already been evacuated and no injuries were reported.

"My heart sunk. I was sick to my stomach," resort president Paul Caldwell told the Sentinel after getting a call about 10:30 p.m. Sunday that the 15-year-old building full of guests was splintering. "No doubt there would've been injuries if they hadn't gotten the building evacuated."

The sinkhole is about 50 feet in diameter and 15 feet deep. Firefighters went door-to-door of building 104, a three-story building of garden-style apartments, to help guests escape from the splintering and cracked building frame.

Security guard Richard Shanley told the Sentinel he ran through the building waking up guests.

"While you are running by, pieces of the building are falling down behind you," he said. "So you just do what you can and get out. "

He said guests were afraid that the building might cave in with people inside.

"Kids were crying. They were saying, 'We don't want to get trapped here. Mommy, we're on vacation. We're here to have fun. This is not what we expected. We don't want to get trapped here,'" Shanley told the newspaper.

The building houses 24 units and about 20 people were staying in it at the time, Cuellar said. The building was sheared nearly in half.

Caldwell told the Sentinel the displaced guests were relocated to other buildings. An adjacent building was also evacuated and 16 people had to leave, Cuellar told the Sentinel.

The American Red Cross was providing assistance at the scene.

Sinkholes, common in Florida, are a function of soft limestone disintegrating from acidic rainwater. Development, heavy rains and removal of groundwater can accelerate the erosion.

In March, a 50-foot deep sinkhole swallowed a home near Tampa. Jeffrey Bush, 37, was sleeping in that home at the time and was declared dead.

Luis Perez, who was staying at a condo building near the sinking one, said he was in his room when the lights went off around 11:30 p.m. He said he was on his way to the front desk to report the outage when he saw firefighters and police outside.

"I started walking toward where they were at and you could see the building leaning and you could see a big crack at the base of the building," said Perez, 54, of Berona, N.J.

Latest Pilot Flying J suit seeks to depose Jimmy Haslam

A new suit has been filed against Pilot Flying J charging that the firm cheated a trucking company out of promised rebates and the plaintiffs already are moving to depose the company's top executive, James A. Haslam.

The suit which was filed in circuit court in Knoxville late last week charges that Pilot Flying J secretly reduced the rebates promised to Cedar Creek, a Georgia trucking company, which operates in Tennessee.

"Pilot regularly, purposely and intentionally understated the amount owed to Cedar Creek," the nine-page complaint states.

Filed along with the complaint was a notice that the attorneys for Cedar Creek plan to depose Haslam and Pilot spokesman Tom Ingram in October. Pilot executives Mark Hazelwood and John Freeman also are scheduled for depositions on Oct. 14.

According to the notice, the videotaped deposition of James Haslam is scheduled for Oct. 15.

Ingram, a well known lobbyist, also serves as a consultant to Haslam's brother, Gov. Bill Haslam.

Like nearly two dozen other suits filed in the past four months, the complaint cites an affidavit filed in U.S. District Court in Knoxville in April by an FBI agent. The 120-page document charges that the Pilot's top sales executives conspired to cheat trucking companies by shaving promised rebates.

The complaint cites the transcripts of secretly recorded Pilot sales meeting in which Freeman and other sales staff discussed the rebate-skimming scheme.

"These conversations also reveal that Pilot took active steps to conceal their activities from its customers and law enforcement officials," the complaint states, adding that the tapes show the scheme took place with the awareness and consent of Haslam and Pilot President Mark Hazelwood.

Cedar Creek's attorney stated in the complaint that they plan to reject a proposed settlement filed in federal court in Arkansas. In that settlement Pilot has promised to reimburse truckers for any reduced rebates plus 6 percent interest.

According to the complaint Pilot officials told Cedar Creek that they have not calculated how much is owed to former customers like Cedar Creek

"Cedar Creek does not wish to participate in the proposed settlement and will opt out of it," the complaint states.

The suit charges Pilot with wrongful conversion, breach of contract and violations of the state's consumer protection laws.

The suit was filed by Knoxville attorney Louis McElroy and Savannah attorney Mark A. Tate.

LeBron giving back to Akron

AKRON -- LeBron James came back north Saturday to give back to his hometown of Akron.

James is giving a speech to children while at St. Vincent- St. Mary's on the football field.

Kids attending will get bikes, uniforms and the unveiling of the new  uniforms for St. Vincent- St. Mary's fall sports teams.

Ohio highway becomes destination for bargain hunters

The historic Ohio Lincoln Highway will be one long yard sale this weekend.

The "Buy-way" yard sale takes place on America's first coast-to-coast paved road and, in Ohio, there will be about 1,000 individual sales.

"This event has grown to national awareness in just five years," says Mike Hocker, executive director of the Ohio byway group.

Legal loophole allows sex offenders to live near schools

CLEVELAND -- In two weeks, kids will soon fill the sidewalks, heading back to school. Near Cleveland's Rickoff Elementary School, young students will walk by the home of registered sex offender who lives across the street.

Another registered sex offender, whose victim was also a juvenile, lives 2 houses away from the school.

Meanwhile in Columbia Station, in Lorain county, the newest resident on Fremont Drive, is not welcome here.

"Most of the neighbors are concerned. Most of us have young children," said Chris Candella. "He's a convicted sex offender and he's living directly next to a day care."

Joseph Lapinta, convicted of unlawful sexual conduct with a minor, is now living right behind a day care -- a violation of the law.

Lapinta was defensive when asked about neighbors' concerns.

"I'm not a bad f------ guy, you know what I mean?" he said.

But Candella and his neighbors want him out of the neighborhood.

"He just keeps slipping through the system, and he's now living next door to us," he said.

Lapinta and other registered sex offenders slipping through a loophole in the law, banning sex offenders from living within 1000-feet of a school or day care. And there's not a thing that sheriff's deputies can do about it.

That's because the Ohio legislature made enforcement of the law -- up to civil courts.

Ohio Attorney General Mike DeWine says it's up to neighbors or city officials to sue the sex offender, and ask a judge to order an eviction.

"I don't want anyone to think that there isn't a remedy," said DeWine. "There's teeth in the law in the sense that a lawsuit can be brought, the person can be evicted from that house."

However DeWine agreed that the lack of a criminal penalty for violations makes it easier for sex offenders to ignore the residency law.

Using the online Cuyahoga Sheriff's Office Sex Offender Registry, Channel 3 News analyzed the number of registered sex offenders living near Cleveland public schools. We found that 63 out of 70 pre-K through 8 schools had at least one registered sex offender living within 1000-feet of school property.

A total of 166 registered sex offenders are living very close to the city's elementary and middle schools. Most of them committed their crimes before the ban took effect in 2003, so the restrictions do not apply.

However, we found 28 registered sex offenders are clearly living in violation of the law.

One of them is Radames Gonzalez, who was convicted of gross sexual imposition of a girl under the age of 13. Gonzalez now lives near Cleveland's Orchard-Halle Elementary School on the city's west side.

"Oh, heck no!" exclaimed neighbor Perry Mitchell, a father of 6 girls. "I can tell you my kids won't be going across the street."

Whether in the city or the suburbs, it's up to citizens to be aware -- by using your sheriff's department's sex offender search website.

"We tell the community to use it as an investigative tool, " said Detective Katie Oleksiak from the sex offender unit of the Cuyahoga Sheriff's Office. "Whether it's for your neighborhood, to buying a house, to even dating, or a new neighbor."

Other states with similar residency restrictions for sex offenders are now considering attaching criminal penalties for violations. Such a bill is currently pending in the New York state legislature.

Husband arrested, indicted in wife's 2012 murder

WILLOUGHBY HILLS -- A 43-year-old man has been arrested for a murder that happened nine months ago.

Police say Kevin Knoefel was taken into custody Thursday following a lengthy investigation into the Nov. 16, 2012 stabbing death of his wife, Lisa Knoefel. 

Knoefel was arrested by Willoughby Hills Police with the assistance of U.S. Marshals.  A search warrant was executed at Knoefel's Chagrin Drive home at the time of the arrest.

A Lake County Grand Jury has returned a secret indicted against Knoefel on 11 counts including complicity to aggravated murder, conspiracy to commit aggravated murder and sexual battery.

Immediately after the 2012 murder, Sabrina Zunich, 18, identified in earlier reports as the couple's foster daughter,  was arrested and charged in the murder. Her case has not yet been presented to the Lake County Grand Jury and she remains jailed in lieu of bond in the Lake County Jail.

Kevin Knoefel's indictment alleges he "engaged in discussions" with Zunich and "devised multiple plans to murder" his wife in her bedroom while she was asleep.

The indictment also charges that Kevin Knoefel told Zunich his wife was "worth more dead than alive" and even alleges he directed which knife should be used in the stabbing.

Copley daycare evacuated due to chemical fire

COPLEY -- A chemical fire on Copley Road has forced the evacuation of a nearby daycare center and other businesses.

The incident on Copley Road north of Cleveland-Massillon Road has emergency crews on scene.

Authorities say a semi in a loading dock area at a trucking company had chemicals inside. An employee reported smelling fumes before those fumes ignited.

HazMat crews responded, allowing the fumes to burn off and hosing off the dock.

Lots of smoke and flames were reported.

It's unknown if anybody was hurt.

WKYC is on scene and will deliver the latest information as it becomes available.
