Bedford: Mother, two daughters killed in Friday night crash

BEDFORD, Ohio -- A Maple Heights mother and two of her daughters were killed in a crash on Northfield Road in Bedford Friday night.

Police say a 48-year-old Warrensville Heights man was headed south on Northfield Road around 9:45 p.m. when he ran a red light at the intersection with Berwyn Street.

His car struck a second car with a 30-year-old mother and her four children inside.

The mother, Maria Thorpe, and two of her children, Zariah Roberts, 8, and Zayanah Roberts, 5, died from the crash.

Another 12-year-old was treated and released from the hospital, but the 10-year-old is still listed in critical condition.

The driver of the other car was taken to an area hospital and is in police custody after being released.

The crash remains under investigation. Investigators say alcohol may have been a factor. No charges have been filed yet.

The road has been reopened.

County corruption defendant Jimmy Dimora appeals his conviction

CLEVELAND -- On behalf of convicted Cuyahoga County corruption probe defendant Jimmy Dimora, his attorney Christian Grostic filed an appeal of Dimora's conviction Saturday morning with the court of appeals.

The filing is an appeal of his conviction, not his sentence.

Dimora, 57, who is now in a West Virginia federal prison serving his 28-year sentence, was a former Cuyahoga County commissioner and chairman of the Cuyahoga County Democratic Party.

He was found guilty March 9, 2012, on 33 counts and U.S. District Judge Sara Lioi sentenced him on July 31, 2012.

The appeal alleges:

  • that the district court committed reversible error by excluding evidence central to Dimora's defense- his ethics reports -- and thereby allowing the government to mislead the jury on a key issue in the case.
  • the district court erred by changing its pretrial ruling and excluding Dimora's ethics reports. It alleges Dimora's ethics reports were not hearsay because they were not offered to prove that he actually received things of value
  • the district court abused its discretion by changing its pretrial ruling and excluding evidence that would refute misleading testimony the court permitted the government to introduce repeatedly.
  • the district court committed an error when it excluded evidence central to Dimora's defense and allowed the government to mislead the jury on a key issue in the case. It alleges that the district court compounded its error by excluding the ethics reports of Dimora's alleged co-conspirator who, unlike Dimora, admitted taking bribes and disclosed nothing.
  • the district court committed reversible error by excluding Dimora's evidence that he provided similar assistance to many others without reciving anything of value. It alleges that the district court erred by applying a different and stricter standard to exclude Dimora's reverse 404(b) evidence than what it applied in admitting the government's 404(b) evidence.
  • the government repeatedly relied on the absence of Dimora's reverse 404(b) evidence in arguing for his conviction.
  • the district court's inadequate instructions permitted the jury, at the government's urging, to convict on lawful conduct.
  • the district court rejected instructions that accurately explained the important difference between bribery and lobbying.
  • the district court rejected instructions that explained the limits on what acts are official acts.
  • there was insufficient evidence to convict Dimora on four counts under correct law defining bribery and official acts as it relates to Nicholas Zavarella (Counts 12-13), John Valentin (Count 11) and Gina Meuti Coppers (Count 9)

Canton: Missing teen from carjacking found safe

CANTON -- Canton Police say a 17-year-old Canal Fulton boy knocked unconscious and pulled from a car during an early morning carjacking has been found safe.  

The teen, Alan Strelecki, and two friends were in the 1100 block of  Cleveland Avenue NW when they say three men approached the car around 2:40 a.m.

Police say Strelecki was pistol-whipped and then pulled from the vehicle and left unconscious in a parking lot.

The gunmen then took the car with the other two teens still inside. The teens say they were driven to an ATM where they were forced to withdraw money.  The two teens were eventually released in the 4100 block of  Georgetown Street NW and Trump Avenue.  The teens then called 911.

When police arrived to the carjacking location, they were unable to locate Strelecki.

Officers searched for the teen for several hours until he was located at 6th and Fulton.   He was taken to the hospital for treatment of injuries described as minor by police.

Police are still investigating.  No arrests have been made.

Trial of man who shot dog in Cleveland Heights Monday

CLEVELAND -- The man accused of shooting a bull mastiff and leaving it for dead in a Cleveland Heights park is scheduled to go on trial Monday in U.S. District Court on federal firearms charges.

Federal officials say Raymone "Ramone" Clements, 42, of Cleveland, is charged with being a felon in possession of ammunition, something not allowed by his previous convictions.

An animal rights rally is planned for Monday on Public Square in downtown Cleveland at 7:30 a.m. April is Animal Cruelty Awareness month.

Clements is a convicted felon and is not permitted to have a weapon. Court records show Clements has five aliases and began his criminal career at the age of 18, being convicted of receiving stolen property. He failed to show for his first court appearance back in 1988 and was arrested on a warrant.

Clements has 17 cases that he has been involved in. His last prison term, after he pleaded guilty in 2006 to rape against victims who were under 13, was five years. He left prison in 2011.

In this case, Clements was found to have one round of .357-caliber ammunition and two rounds of .22-caliber ammunition on Dec. 20, 2012, despite previous convictions in the Cuyahoga County Court of Common Pleas for rape (2006), drug trafficking (2003) and aggravated robbery (1991), according to the indictment.

But the story began back in November when Clements was accused of tying the bull mastiff -- now named "Forrest" -- to a tree in Cleveland Heights Nov. 25, then shooting the dog, leaving him for dead.

Dog walker Dee Shedlow found the mastiff dog early Nov. 26 and the PAWS Ohio rescue group took care of him. Forest was emaciated, weighing only 70 pounds.

Forest, now recovered, is now living in a loving home with Robin Stone in Solon. In that incident, Clements has been charged with animal cruelty, discharging a weapon in city limits and having weapons under disability.

If convicted on all counts, Clements faces 5 years and 7 and a half months in prison.

Cleveland: Power restored at Horseshoe Casino

CLEVELAND -- The Cleveland Horseshoe Casino says power has been restored to all areas of the casino. 

This includes the second level of the casino including slots and table games, the high limit area and the food court.

The casino says a faulty part was identified as the cause of the power outage which occurred throughout the Higbee Building at 1:30 a.m.  Backup generators were used to power much of the casino during the outage.

Casino management worked with Forest City, the building owner, and First Energy to replace the part which successfully reinstated power.

Solon: Names of officers in fatal shooting released

SOLON -- Police have released the names and photos of the two officers involved in the March 17 fatal shooting of a suspect during a traffic stop.

No further details on the incident have been released as the state Bureau of Criminal Investigation and Identification is handling the investigation.

"I would like to take this opportunity to thank all of you not only for your patience with this process, but for the concern shown by many of you for our officers," Solon Lt. Bruce Felton said.

"It was comforting that so many of your questions were of their conditions and well being. They are doing well under the circumstances, and while we are saddened of the circumstances, we are extremely grateful for the safety of our members."

"When BCI allows us, we will, at some time, release additional information, including video and pictures."

Davis and Kline were involved in the shooting in which Kevin M. Bailey, 22, of Sylvania Township, fired on police officers after a traffic stop.

The officers then returned fire, killing Bailey.

Davis was hired in 2008 and is a member of the Southeast Area Law Enforcement SWAT team. He was wounded in the shooting when he was struck in the arm and chest by rounds fired by Bailey.

Davis was wearing a bulletproof vest. He was treated and released from the hospital after the incident, but recently had surgery to remove glass fragments from his hand.

He is at home recovering during his administrative leave.

Kline was hired in November 2009 and is a member of the Valley Enforcement Group SWAT Perimeter team.

Parmatown Mall getting a new name

PARMA -- The Parmatown Mall will soon be no more because the location is getting a fresh name: The Shoppes at Parma.

Phillips Edison & Company, which owns and operates the mall, announced the name change Tuesday along with plans for redeveloping the location.

"Our plan is to go beyond a basic facelift and redevelopment for this long-standing regional shopping center," says Roy Williams, senior vice president of Phillips Edison's strategic investment funds. "Besides bringing in additional shops, restaurants and services, our vision is to create a more attractive, pedestrian-friendly, family oriented environment that will act as a town center for Parma residents and surrounding communities."

The first phase of the redevelopment process includes a new design for the Marc's-anchored plaza and future outbuilding.

Williams says the entire redevelopment is based on the theme of "reinventing a retail tradition."

The mall is 1.18 million square feet.

Phillips Edison & Company, which is headquartered in Cincinnati, owns and manages more than 235 shopping centers in 35 states, including two Giant Eagle locations in Parma.

CLEVELAND -- Here's the information you've all been waiting for -- a casting call in Cleveland for the next Marvel movie.

You can be a PAID extra for having a role in the next film.

Come to the Tri-C Metro Campus from 10 a.m. to 3 p.m. on April 19 and 20. The casting call will take place in UTC/Room 229 at 2415 Woodland Avenue in downtown Cleveland.

Your photo will be taken at no charge. You need to dress in business attire and "be well groomed."

The casting call does not indicate which movie this is for, but it's most likely for the "Captain America" sequel, which is set to film in Cleveland in the coming weeks.

TSA PreCheck program expands to Cleveland airport

CLEVELAND -- United Airlines passengers flying out of Cleveland's Hopkins Airport may be able to speed up the time it takes to get through airport security.

The Transportation Security Administration has launched its PreCheck program at Hopkins main terminal.

The pre-screening initiative allows customers to volunteer information about themselves that may make them eligible to expedite their screening experience. The screening allows eligible United customers to leave on their shoes, light outerwear and belts and to keep their laptops and 3-1-1 compliant liquids and gels in their carry-ons. when traveling through the Main Terminal and south checkpoint at CLE.

The TSA manages the program and is working with United and U.S. Customs and Border Protection to identify possible participants. Eligible United MileagePlus members are being invited to participate in the initial phase. Non-members may qualify by becoming eligible members of U.S. Customs and Border Protection's Trusted Traveler programs.

For fliers who choose to participate, the TSA will determine eligibility for expedited screening prior to each flight and embed the information in the barcode of each customer's boarding pass.

The TSA says it will always incorporate random and unpredictable security measures, so no customers are guaranteed expedited screening.

Cleveland: City council approves new ward map

CLEVELAND -- Cleveland City Council has approved a new map carving the city into 17 new wards.

The 17-2 vote came after more than three hours of discussion. The dissenting votes were Councilmen Mike Polensek and Joe Cimperman.

Council must be downsized by two seats because of population loss and rules within the city charters.

There were concerns that some longstanding neighborhoods were being split into multiple wards. Downtown business leaders are unhappy because downtown will now have three council members instead of just one, currently Councilman Joe Cimperman.

Jose Feliciano, spokesman for the Hispanic Roundtable, testified before council. He expressed concerns that the new wards will make it less likely that a Hispanic council member will be elected. He threatened a possible federal voting rights lawsuit.

The new arrangement means that incumbents Kevin Conwell and Jeff Johnson will likely face in the fall election.

The vote comes after an emotional Monday night council meeting that included angry exchanges between council members.

Bay Village: Man says barefoot girlfriend beat him up

BAY VILLAGE -- Police were called to a Bayfair Drive home about 5:45 p.m. Friday after the resident called saying he was just assaulted and robbed by his girlfriend, who fled the scene barefoot.

Police learned the the woman, 24, arrived at the house and demanded money from her boyfriend, 37.

When he refused, she assaulted him and took $40, then ran out of the house.

The man was taken to St. John Medical Center for treatment. Police have been unable to locate the woman.

WASHINGTON -- President Barack Obama has designated five new national monuments, using executive authority to protect historic or ecologically significant sites.

One is the Charles Young Buffalo Soldiers National Monument in Wilberforce, Ohio.

Col. Charles Young, born to former slaves, was the third African American to graduate from West Point, and the first to be promoted to colonel.

He led African American Army troops on a variety of assignments in the late 1800s and early 1900s in Nebraska, Utah, San Francisco.

He and his troops also served as rangers in Sequoia National Park in California. Since African-American troops were primarily sent to serve in the Plains and the West, they were often called "Buffalo Soldiers."

He also served internationally, in the Philippines, Haiti, Liberia, and Mexico.

After serving with distinction in the US Army, he became a professor of military science, French, and mathematics at Wilberforce University in Ohio.

He also directed the college band and composed and played music for the piano, violin, and guitar.

He and W.E.B. DuBois were co-faculty members and close friends. His home in Wilberforce was maintained by his fraternity, Omega Psi Phi, and they donated the site to be named as a monument in his honor.

Vice President Joe Biden and Interior Secretary Ken Salazar joined Obama Monday in the Oval Office as he signed five proclamations designating the sites under the Antiquities Act.

The ceremony was closed to reporters.

The sites are Rio Grande del Norte National Monument in New Mexico; First State National Monument in Delaware; Harriet Tubman Underground Railroad National Monument in Maryland; Charles Young Buffalo Soldiers National Monument in Ohio; and San Juan Islands National Monument in Washington state.

Biden has long sought the site in Delaware, his home state and the only state without a national park. Designating the 1,100 acre site is the first step toward creating a national park there

Cleveland Weather: On the snow watch

A large wintertime/early spring storm will be moving into Northeast Ohio late tonight and linger across our area through Monday. This storm has the potentially to bring anywhere from 3 to 8 inches of snow and winds up to 25 mph to Richland, Ashland, Wayne, Holmes Counties, with the worst conditions across Tuscarawas and Carroll Counties.

As of now, there is uncertainty as to how far north the snow and wintry conditions will make it. Due to this, there are no advisories or warnings issued across Northern Counties of Ohio. With that being said, forecast models suggest we will all get wintry weather from this system. The question is where will it be the worst.

We will keep you up-to-date on this.

Sunday: Starting off mostly sunny, then clouds increase with snow showers and windy weather late in the day. Mid/upper 30s. Winds: NE 5-15 mph.

Teen shot in head outside party

CLEVELAND -- A teenager was shot in the head outside a party early Sunday morning.

The shooting happened just after 1 a.m. on the 1300 block of E. 66th Street. Police say Kortez McRae was involved in a fight inside the E. 66th Street home.

When he went outside, police say the argument was de-escalating. That's when another teen walked up and shot McRae in the head.

McRae was taken to MetroHealth Medical Center and is being treated for his injuries.

Police are looking for a black male, 17, 5'8" and 150 pounds. He was last seen wearing a black hat, grey shirt and blue jeans.

Boys Hoops: Mentor defeats Rogers, claims program's first state title

COLUMBUS, Ohio (AP) -- Caleb Potter had 24 points and Mentor used a dominating third quarter to defeat Toledo Rogers 76-67 in the Division I final of the boys state tournament at Ohio State's Value City Arena on Saturday.

Each team was seeking a first title. Rogers (21-8) was runner-up in 2011, while Mentor played in its first championship game. Mentor beat undefeated Columbus Northland in the semifinals on Friday.

Mentor (25-5) trailed 37-34 at halftime but used a 16-0 run to outscore the Ram 29-9 in the third quarter to take a 63-46 lead.

Rogers got to within eight with 42 seconds left.

Jeff Foreman had 19 points and Connor Krizancic added 16 for Mentor.

Rogers' Devonte Pratt scored 21 of his 23 points in the first half.

Flash in East Coast sky has social media buzzing

WASHINGTON - Social media sites are buzzing with reports of a flash of light streaking across the sky along the East Coast.

Bill Cooke of NASA's Meteoroid Environmental Office said Friday night that the flash appears to be "a single meteor event." He said it "looks to be a fireball that moved roughly toward the southeast, going on visual reports."

He likened it to a boulder entering the Earth's atmosphere over the northeastern U.S.

He noted that the meteor was widely seen, with more than 350 reports on the website of the American Meteor Society alone.

Derrick Pitts, chief astronomer at Philadelphia's Franklin Institute, agreed that the sightings had all the hallmarks of a "fireball."

Pitts said this one caught more eyes because it happened on a Friday evening - and because Twitter has provided a way for people to share information on sightings.

Grafton Twp: Pond rescue underway

GRAFTON TOWNSHIP --  Emergency crews rushed to rescue one man after he drove into a pond Saturday morning. 

The man now identified as 18-year-old Dominic Zunis, was rescued and was transported by LifeFlight to MetroHealth Medical Center where he died from his injuries.

According to troopers on scene say Zunis ran a stop sign on State Route 57 and Mennell Road. That's when he completely submerged his car in a slightly frozen pond.

The Ohio State Highway Patrol says Zunis was the only person in the car at the time of the accident. 

Alcohol is suspected in this accident.

Cleveland: 2 hurt in multi-car crash

CLEVELAND -- Two people have been hurt after a multi-car crash on the city's east side.

Police say three cars were involved in the crash at East 70th and Kinsman.

According to police, a car was eastbound on Kinsman when it went up on the sidewalk and then careened back into the street and across the yellow line into oncoming traffic striking two other cars.

One man was ejected in the crash.  His condition is not known.  Another victim, a woman, was transported from the scene with breaks in both legs.

Akron: Construction begins on new Goodyear blimp

AKRON -- Goodyear Tire & Rubber Company has begun construction of the first of a new generation of airships to replace its fleet of world famous blimps.

The new Zeppelin LZ N07-101 airship, manufactured by Germany's ZLT Zeppelin Luftschifftechnik, will be assembled at Goodyear's Wingfoot Lake Hangar.

An agreement with ZLT Zeppelin to supply Goodyear with the new airships was announced in May 2011.

Construction of the new airship will take about 6-7 months, including the structural build and the installation of advanced on-board avionics and flight control systems.

Certification of the new airship and training of flight personnel will follow during the first half of 2014.

The new airship will be larger, faster and more maneuverable than the current generation of blimps and capable of carrying more passengers.

Goodyear has built and operated more than 300 lighter-than-air vehicles since 1917, including two large rigid airships -- the U.S.S. Macon and U.S.S. Akron.

Goodyear is one of the world's largest tire companies. It employs about 69,000 people and manufactures its products in 52 facilities in 22 countries around the world.

Its two Innovation Centers in Akron, Ohio and Colmar-Berg, Luxembourg strive to develop state-of-the-art products and services that set the technology and performance standard for the industry

"The start of this construction project marks the beginning of a new era for the Goodyear blimp, one of the world's most recognizable brand icons," said Nancy Ray, Goodyear's director of Global Airship Operations.

Special judge to handle Steubenville rape investigation

COLUMBUS -- The chief justice of the Ohio Supreme Court has appointed a special judge to oversee the work of a grand jury investigating possible new charges related to the rape of a 16-year-old girl last summer.

Thursday's appointment follows a request by Jefferson County judge Frank Bruzzese for an outside judge because of ongoing local controversy about an alleged cover-up of the initial rape report.

Bruzzese says "nameless bloggers" who made unproven allegations of a cover-up have a strong following that makes appointing a judge from outside Steubenville necessary.

Chief Justice Maureen O'Connor responded by appointing retired Summit County Judge Patricia Ann Cosgrove to handle the grand jury, which meets in April.

Two football players were convicted Sunday of raping the girl after an alcohol-fueled party in August.

Investigator: City employee faces sex charges

CLEVELAND - A grand jury has charged a Cleveland employee with the kidnapping, attempted rape and gross sexual imposition in connection with two women he was trying to help get back on track.

James E. Box, a well-known community activist with a criminal past whom the city hired in 1999,  has been on administrative duty at the Cleveland Community Relations Board since the allegations of inappropriate sexual contact first arose early last year.

Box is accused of attacking two women in the fall of 2011, according to the indictment handed up the grand jury.  One of the alleged assaults occurred in Cleveland while the second reportedly happened in Shaker Heights.

Box was not immediately available for comment.

Cleveland Police first learned of the allegations on January 10, 2012, when a Probation Department supervisor contacted the sex crimes unit.   

But Cleveland Police did not contact Shaker Heights about the incident there until March 9, 2012, said Shaker Heights Police Chief Scott Lee.

That call was placed three days after the Investigator Tom Meyer first asked Cleveland Police about the allegations against Box.

Box was mentoring the women in his role as an instructor with Amer-I-Can, an at-risk youth program, that is run by former Cleveland Brown running back Jim Brown, according the police reports.  

The two women were undergoing the counseling with Amer-I-Can as a condition of their enrollment in Cleveland Municipal Court's "Get on Track" program. Get on Track is supposed to help low-level offenders turn their lives around and get a high school diploma.

The first incident happened in August 2011 after Box went to the woman's apartment to help fix her car, according to a Cleveland Police report.

After being invited into her home for a drink, Box grabbed the woman and pushed her against a wall, the report said. The woman resisted as Box talked about having sex.

"Box then unzipped his pants and exposed his penis," the detective noted in the report. "(The woman) told him to leave and he did."

City Prosecutor Victor Perez determined there was insufficient evidence to charge Box with a felony following an investigation by Cleveland Police's sex crimes unit, a police report said. He later recommended Box be charged with a misdemeanor  for exposing himself to the woman. 

Box is charged with kidnapping, attempted rape and attempted sexual battery in connection with the incident, according to court papers.

The second incident happened in October 2011, according to a statement from by second woman, which was obtained by Channel 3 News.

The statement says that Box offered the woman a ride home but made a detour to his office at Amer-I-Can on Lee Road in Shaker Heights. Box then took her into a room, started to kiss her and then engaged in sexual contact, the victim wrote.

When she asked Box to stop, the woman wrote, "He also offered me money for sex and offered to take me to a hotel."

Box is charged with kidnapping, attempted rape, attempted sexual batter, gross sexual imposition and soliciting in connection with the incident.

Box is scheduled to be arraigned on the charges on April 3 in Cuyahoga County Common Pleas Court.

AG announces new help for sex assault victims

COLUMBUS -- Ohio Attorney General Mike DeWine has detailed the plan to address existing gaps in sexual assault services across Ohio.

The formation of the new Sexual Assault Services Expansion Program comes after a survey conducted by the Attorney General's Office found that 59 percent of Ohio's counties do not have comprehensive, direct sexual assault services.

"Months before the tragic sexual assault in Steubenville, I asked my Crime Victims Section to undertake an analysis of all crime victim services in the state, and we found startling gaps in sexual assault services in Ohio," said DeWine.

The study found that only 36 Ohio counties offer comprehensive, direct sexual assault services.

According to the Ohio Alliance to End Sexual Violence, a county with comprehensive, direct services offers a 24-hour crisis hotline, criminal justice advocacy, hospital advocacy, community outreach, crisis intervention services, referral services, and agency collaboration.

Forty-four counties were found to offer some of those sexual assault-specific services, and eight counties offer few or no sexual assault-specific services.

Those eight counties include Fulton, Wyandot, Crawford, Clinton, Perry, Meigs, Harrison, and Monroe counties.

The Sexual Assault Services Expansion Program will provide grant funding for new regional sexual assault coordinators who will oversee the implementation of comprehensive, direct sexual assault services in all of Ohio's 88 counties over the next five years.

The coordinators will recruit and train local volunteers, collaborate with local hospitals and criminal justice and mental health professionals, and provide training on how to meet the needs of sexual assault survivors.

The first year of the project will focus on expanding direct sexual assault services to Perry, Meigs, Wyandot, and Crawford counties. Year two will focus on Harrison and Monroe counties, and year three will focus on Fulton and Clinton counties. The coordinators will also work towards bringing counties with some level of sexual assault services to the comprehensive level.

The Attorney General's Office is also working to determine what additional resources can be geared towards prevention efforts, including youth education programs and public awareness campaigns.

Today's announcement comes at the same time as Ohio Representatives Nan Baker and Kirk Schuring announced their proposed Rape Crisis Program Trust Fund legislation. Money from the fund would be raised through $100 sex offender registration fees.

The money would go towards eligible rape crisis programs to provide services such as hotlines, victim advocacy, and support services.

"It is our goal to ensure that a quick and compassionate emergency response is available to any victim of sexual assault at any time of the day, any day of the week, and in any area of the state," DeWine said.

"It is crucial that adequate victim services are available to anyone who has been sexually assaulted," said DeWine.  "We know that these counties are doing the best they can, but they are struggling.  This is why we are going to help."

Chardon School District issues statement on Lane sentencing

CHARDON -- The Chardon Local School District has issued a brief statement following the sentencing of T.J. Lane in a shooting at the high school in 2012.

The Chardon Local School District is relieved that the case State vs. Lane has finally concluded, which allows all of us (the victims' families, our students, staff and greater community) to move on from the tragic events of February 27, 2012. Our thoughts and prayer remain with the victims and their families as we all take another stride towards healing.

A judge sentenced Lane, 18, on Tuesday to three life in prison without parole terms for the aggravated murders of three students and the wounding of three other students.

Lane showed contempt for the victims' families at sentencing making a profanity laced statement and flipping his middle finger. He wore a T-shirt with the word "killer" handwritten on it during the hearing.

TJ Lane given 3 life sentences in Chardon shooting

CHARDON -- The teenager who killed three students and wounded three more at Chardon High School last year has been sentenced to life in prison without parole.

Judge David Fuhry sentenced T.J. Lane, 18,  to life in prison without parole on each of three aggravated murder charges.  The sentences will run consecutively.

In sentencing Lane, Judge Fuhry noted that Lane had exhibited a lack of compassion and no remorse during the proceedings.  Judge Fuhry described the shootings in the school cafeteria as a "merciless rampage."  He continued, "We haven't been provided a clear motive or even a murky one."

Following the 2012 shootings, Lane told deputies he didn't know why he fired the shots but said, "It was something I chose to do."

Judge Fuhry said there was no evidence that Lane suffered from any mental or cognitive impairment and said Lane knew what he was doing that day and he knew it was wrong.

Lane's attorney Ian Friedman told the court during the sentencing hearing Tuesday that Lane did not wish his defense team to present any witnesses, statements or other evidence to mitigate his sentence. 

The teen entered the court wearing a button down shirt but took that off to reveal a white T-shirt with the word "killer" handwritten in marker on it.  The prosecution noted in the hearing the shirt is similar to one that Lane wore the day of the shootings in 2012.

When Lane addressed the court he flipped the middle finger and used profane language toward those in the courtroom including the victims' families.

Lane's guilty plea on Feb. 26 came on the eve of the anniversary of the attacks. Daniel Parmertor, Russell King Jr., and Demterius Hewlin were killed and three others were wounded, two seriously, including Nick Walczak who is now confined to a wheelchair.

Lane wasn't subject to the death penalty because he was 17 at the time of the crimes.

CHARDON -- Shortly after his sentencing hearing, #tjlane became the nation's top trending item on Twitter with #chardon at number three.

Meanwhile, #tjlane was even trending globally.

From his "KILLER" T-shirt to the smile on his face, our Facebook and Twitter pages have been filled with hundreds upon hundreds of comments as viewers offer their thoughts on T.J. Lane's behavior and punishment during his sentencing hearing.

Before a judge punished Lane with three life sentences without the possibility of parole, Lane said the "F" word and flipped the courtroom off before smiling and smirking as victims' relatives addressed him.

Solon: First shooting report out, officers also shot

SOLON -- The Cuyahoga County Medical Examiner's Office has revealed the identity of a police invovled shooting victim.

He is Kevin M. Bailey, 22, of Sylvania Township.

The Ohio Bureau of Criminal Investigation is investigating the  fatal shooting involving police during a traffic stop Sunday night.

The state agency took over the investigation overnight.

Just after noon Monday, the Solon Police Department released its preliminary report:

"On March 17, 2013, just after 9:45 p.m. in the intersection of Bainbridge Road and Sunnywood Drive, officers of the Solon Police Department attempted to stop a suspect vehicle that had fled the scene of a routine traffic stop just a quarter mile down the road."

"The suspect vehicle was disabled after driving over a curb. Before the police officers could exit their cruisers, they came under immediate gun fire from the suspect who shot rounds through both police cars."

"One officer took rounds to both the chest and left arm, but was wearing a bulletproof vest. The suspect succumbed to return fire and was deceased at the scene."

"Both involved officers were treated and released from the Cleveland Clinic Twinsburg Emergency Department early Sunday morning; they have been placed on administrative leave while the incident is under review."

"The incident is being investigated by the Ohio Bureau of Criminal Investigation (BCI). Releases of specific investigative information, including identities of involved parties, will be through their Public Information Officer. It is expected that after the investigation is completed, the results will be reviewed by the Department's Use of Force Investigation team, the Cuyahoga County Prosecutor's Office and the Cuyahoga County Medical Examiner's Office."

"This process will take several weeks."

Mayor Susan A. Drucker expressed her concerns: "While a lost life is always tragic, and our thoughts and prayers go out to the family of the party involved, I am at the least very happy that both of our officers were able to be released from the hospital home to their families this morning. The welfare of all City employees is paramount to me, and I would like to publicly express my concern and support for the well-being of the officers."

"We are working very closely with BCI and the Medical Examiner," said Chief Christopher P. Viland, "we expect a full and complete investigation and await what we feel will be positive results. We will also be in the process of providing appropriate counseling for all involved employees. This is one of those events that no one thinks will ever happen in the suburbs. It is what we train for but hope won't come to pass."

Chief Viland also expressed his condolences for the family of the other party involved.

Witnesses reported hearing gunshots in the area of Sunnywood Drive and Bainbridge Road just before 10 p.m.

Officers stopped a car at at about 9:45 p.m. at Bainbridge Road and Sharondale Drive. During the stop, the driver sped away from police, turning onto Sunnywood Drive, where he crashed.

The man opened fire on police when they approached the area of the crash.

Channel 3 crews at the scene Sunday night said officers were surrounding what appeared to be a body covered by a white tarp.

Witnesses who contacted WKYC said ambulances did show up at the scene, but left a few minutes later.

Just before 4:30 a.m., the Cuyahoga County Medical Examiner's Office removed  Bailey from the scene.

DeWine: Grand jury to be called for Steubenville rape

STEUBENVILLE -- Attorney General Mike DeWine announced Sunday that a grand jury will be convened to determine if anybody else should be charged in a party last summer during which a 16-year-old girl was raped.

The grand jury is expected to begin meeting on our about April 15.

DeWine made the announcement following the verdict in the trial against football players, Ma'Lik Richmond and Trent Mays.  Both were found delinquent on all charges--the equivalent of a guilty verdict in adult court.  Both will spend a minimum of 1-year in a juvenile facility.  Mays was sentenced to an additional year in jail.

"I believe what we saw today was justice," said Attorney General DeWine in reference to the verdict.  "It's not a happy time for anyone.  This is a tragedy."

Steubenville police asked DeWine's office for help in the investigation of the rape.  The severely intoxicated teenage girl was digitally penetrated in a car and in a basement of a home following  a party last August while she was incapacitated.

To date, DeWine's office says the state's crime lab has processed 396,000 text messages and 308,000 photos in connection with the investigation.  The Attorney General says it has determined 43 people were at one or both locations where the assaults occurred.  Sixteen of those people have refused to answer questions.

DeWine says as a result he has come to believe that the investigation "simply cannot be completed ... without the convening of a grand jury." 

DeWine also told reporters that more must be done to address the cavalier attitude that today's teens have towards sex and rape.

"We as a society need to do more to educate our young people about rape. It is horrible crime of violence," said DeWine.

"Crime likes this happen every single weekend in this country.  Steubenville is not the exception. ... We still have an ignorance, from people about the fact that these events happen all the time."  People need to wake up, DeWine said.

Judge finds teens delinquent in Steubenville rape

STEUBENVILLE -- A judge has found two Steubenville high school football players delinquent in the rape of a 16-year-old girl at a party last summer. The finding is the equivalent of a guilty verdict in adult court.

Judge Thomas Lipps delivered his verdict just after 10 a.m.  He found Trent Mays, 17, and Ma'Lik Richmond, 16, delinquent or guilty on all three charges.  Crying could be heard in the courtroom following the verdict.

Both Mays and Richmond--who had largely remained emotionless during the trial that included sexually explicit testimony--also wept following the verdict.  Ma'Lik's father then stepped forward to the defendants' table to comfort both of the teens.

A short time later, Ma'Lik Richmond walked toward the section of the courtroom where the victim was sitting and made a tearful apology. Mays also made an apology. 

Following court statements, Judge Lipps sentenced Richmond and Mays to 1-year minimum in a juvenile facility and said both could be held until they turn 21.  Judge Lipps also sentenced Mays to an additional year in jail on a charge of illegal use of a minor in nudity-oriented material to be served after his rape sentence is completed.

The victim's mother recorded a short statement directed at Mays and Richmond that was played to the media.  In the statement she chastises them both for a lack of compassion or moral code.  "This does not define who my daughter is.  She will peservere, grow and move on."

During the trial prosecutors argued the drunken girl was taken advantage of. Defense attorneys argued the girl had a history of heavy drinking and lying.

The verdict was read following four days of testimony in Jefferson County juvenile court in eastern Ohio.   Judge Lipps said he had reviewed all the text messages entered as evidence prior to making his decision.  "The things our children were saying and doing were profane and ugly," he said.

The two teens were accused of digitally penetrating the West Virginia girl in a car and in a basement.

Social media attention and allegations of selective prosecution have given the case an international profile.

Following the verdict, Ohio Attorney General Mike DeWine announced he will ask a grand jury to be convened in April to determine if any other teens should be charged.  To date 16 people who were at one or both of the locations where the girl was assaulted have refused to answer questions.

"We as a society need to do more to educate our young people about rape.  It is a crime of violence," said DeWine.

Strongsville: Back to the table for teachers union and school board

STRONGSVILLE -- The federal mediator has called another meeting to negotiate the teacher strike.

The session will be held Sunday at 1p.m. for the Board of Education and Strongsville Education Association.

It has been two weeks since teachers have been in the classroom.

This comes one day after a counter protest was held in the city's town square, urging the focus should be on the students.

The meeting will be held at the Federal Mediation and Conciliation Service regional office in Independence.

Chardon: Dr. Michael Hanlon new superintendent of schools

CHARDON -- Dr. Michael Hanlon will begin his new job Aug. 1.

The school board announced his selection Saturday after a unanimous vote.

"There are a lot of educational changes coming, such as the new teacher/principal evaluations and the new common core standards. We need a knowledgeable professional who can hit the ground running," said Board of Education President Karen Blankenship.

Hanlon will leave his position as the superintendent of the Painesville City Schools in July. He will be replaced by Joseph Bergant.

Hanlon is a Cleveland State University graduate earning his bachelors, masters and Ph D. degrees.  He has worked as a teacher for the city of Mentor and as a district principal. He has been the superintendent at Painesville City Schools since July of 1998.

Ohio halts overnight Amber Alerts to cellphones

COLUMBUS -- The Ohio Amber Alert Steering Committee has decided for now to stop sending alerts about abducted children to Ohioans' cellphones between midnight and 6 a.m. after an overnight alert prompted complaints.

A State Highway Patrol spokeswoman tells The Columbus Dispatch there was "considerable grumbling" in complaints to troopers and the attorney general about an alert early Tuesday. The subjects of it were found safe hours later.

The alerts go automatically to phones that are in the Wireless Emergency Alert program, and others can be set to get them.

A patrol spokeswoman says Ohio will study the issue more before possibly permanently excluding alerts during certain hours.

She says some states and the National Center for Missing and Exploited Children choose not to send Amber Alerts at very early hours.

AMBER Alert founder Pastor Charles Williams responded today to those complaints about the new Amber Alert Texting system, Williams says, "This new method is critical. If your child was abducted I'm sure you would think differently."

Williams says that a large percent of Amber Alert suspects try to move under the cover of night from one town to the next.

"If a tornado was coming into the area at 3am you would be alerted, if the country was in any kind of attack you would be alerted, so now it's our children and your complaining about being alerted over night? What about those who work at night and sleep during the day?"

Williams says that cell phone users can always opt out of the alerts if they wish.

Justice Department investigating Cleveland Police

CLEVELAND -- The U.S. Department of Justice today launched an investigation into whether there is a widespread practice within the Cleveland Police Department of officers using excessive force during their encounters with citizens.

Cleveland Mayor Frank Jackson and other community leaders had asked for the Justice Department investigation following the Nov. 29 fatal shooting of two motorists in a hail of bullets fired by officers who had pursued the suspects for 26 minutes.

"We are focused on CPD as a whole," said Assistant Attorney General Thomas Perez of the Civil Rights Division. "We are not looking at individual officers."

Perez says the investigation will focus on the allegations of excessive force by officers as well as whether the Police Department has the proper training, supervision and oversight to prevent such actions.

It will also look at "whether officers are held accountable if they stray from departmental rules and regulations and constitutional norms," said U.S. Attorney Steve Dettelbach, who oversees the federal prosecutors in Cleveland.

Perez said the review is expected to take "as long as necessary," although Justice Department personnel will be in Cleveland for months to speak with community, political and police leaders about their concerns.  

The end result of the DOJ investigation will determine whether reforms are needed in the department.  It is a civil review not a criminal one.

Jackson says he welcomes the review.  He says the investigation is necessary to maintain trust between the people of Cleveland and the officers who are sworn to protect them.

"If there are ... suggestions to us that we need to do better in areas, then we will gladly change because our goal ... is to have a professional police division," Jackson said.

About 30K Ohioans could see delay in tax returns

CLEVELAND  --  A tax-preparation glitch could delay the returns of an estimated 30,000 Ohioans by up to six weeks.

The Plain Dealer reported the estimated number of affected Ohioans on Thursday. The Internal Revenue Service said Wednesday that the glitch will affect about 660,000 tax returns nationwide

The IRS said that a problem with a limited number of software company products affected some taxpayers filing a form used to claim educational credits between Feb. 14 and Feb. 22.

The agency didn't name any companies in the statement. But Kansas City-based H&R Block has been informing customers about problems.

H&R Block spokesman Gene King says the problem involves other tax preparers beyond H&R Block.

He says the returns were prepared accurately, but the error occurred in e-file processing.

Steubenville rape trial: Police talk of phone gathering

STEUBENVILLE -- Police and witnesses from phone service providers have testified about cellphones collected as evidence in the case against two Ohio high school football players accused of raping a 16-year-old West Virginia girl.

Thursday marks the second day of the juvenile court trial in eastern Ohio. The testimony focused on how phones belonging to the defendants and others were gathered by investigators.

Prosecutors and defense attorneys earlier had focused on the girl's level of intoxication and whether she consented to sex.

The case has riveted the small city of Steubenville (STOO'-behn-vihl) amid allegations that more students should have been charged.

Steubenville High School football players Trent Mays and Ma'Lik Richmond maintain their innocence.

A visiting judge is hearing the case without a jury.

Medina: Route 3 closed after accident involving asphalt truck

MEDINA COUNTY -- State Route 3 is closed between Good Road and Chippewa Road south of the City of Medina after an accident involving a truck carrying ashphalt and a car.

A dispatcher with Montville Township tells WKYC that the asphalt truck has overturned as a result of the crash.

The truck driver was trapped and police and EMS had to free him from the wreckage.

A medical transport helicopter is en route.

The asphalt tanker is leaking but there are no evacuations. Hazmat teams are also on the scene.

Police say the road could be closed for up to eight hours.

Motorists are strongly urged to avoid the area.

Prosecutor: Steubenville school rape victim didn't consent

STEUBENVILLE -- The prosecutor in the Ohio trial of two high school football players accused of raping a 16-year-old girl after an alcohol-fueled party says the girl was "substantially impaired," unable to consent to sex and suffered humiliation and degradation.

But a lawyer for one of the defendants, Trent Mays, says his client did not rape the girl.

Special Prosecutor Marianne Hemmeter and Mays' attorney, Brian Duncan, spoke as the trial opened Wednesday.

The case in juvenile court has brought unprecedented attention to the small city of Steubenville (STOO'-behn-vihl) through a barrage of social media and criticism that more students should have been charged.

The defendants, Mays and Ma'Lik Richmond, have been on house arrest but attending classes at a justice center school.

Rep. Ryan unveils $4.6 trillion plan to cut the deficit

WASHINGTON -- House Republicans unveiled a budget Tuesday that would balance the nation's books in 10 years without raising taxes but by eliminating President Obama's health care law, revamping Medicare for future retirees and creating just two tax brackets for individuals -- 10% and 25%.

By cutting $4.6 trillion in current spending over the next decade, the budget would achieve balance between what the government spends and what it collects in revenues by 2023.

"For the third straight year, we've delivered," House Budget Committee Chairman Paul Ryan, R-Wis., said Tuesday at a news conference. Since taking control of the House in 2010, the GOP has approved a budget each year. The House is scheduled to approve Ryan's budget next week. The GOP budget is non-binding and does not have the force of law, but it serves as a philosophical document on the party's views on the size and role of the federal government.

The conservative blueprint stands no chance of gaining traction with Senate Democrats or Obama, but the plan is a starting point for renewed debate about how to balance the budget. Senate Democrats, for the first time since 2009, will unveil a competing budget Wednesday.

Senate Democrats will call for raising $1 trillion in new revenues while cutting $1 trillion in federal spending, but they have not offered any specifics ahead of Wednesday's release. Senate Budget Committee Chairwoman Patty Murray, D-Wash., will preview the budget to her Senate Democratic colleagues at a Tuesday meeting that Obama is scheduled to attend on Capitol Hill. The 50/50 ratio of taxes to cuts is on par with the president's call for "a balanced approach" for deficit reduction.

Key elements of the GOP budget include:

A balanced budget achieved in a decade by not allowing the government to spend more than it collects in revenue, which Republicans set at 19.1% of gross domestic product. By their measure, the federal government will spend $4.6 trillion less over the next decade that the government is currently on track to spend.

A 3.4% annual increase in spending each year, but Republicans estimate the economy will grow by a faster margin to help balance the books.

Cuts the growth of the public debt to an estimated $14.2 trillion by 2023 instead of the nearly $20 trillion estimated by the non-partisan Congressional Budget Office.

Authorizes construction of the 1,700-mile Keystone XL oil pipeline and estimates it would create 20,000 new jobs.

A full repeal of Obama's health care law.

Support for new laws to limit medical malpractice liabilities.

A fundamental overhaul of the Medicare system for future retirees. Starting in 2024, seniors would be given a federal subsidy to purchase health care from the private market, instead of the guaranteed benefit system that currently exists. It also calls for wealthy seniors to pay more for premiums.

Ryan's plan also keeps in place $716 billion in Medicare cuts in payments to providers included in the president's health care law to achieve balance. As a vice presidential candidate in 2012, Ryan opposed these cuts and attacked Obama for it in his convention speech.

A transfer of power to states to determine how Medicaid and other funds should be spent on programs, including food stamps.

An increase in defense spending over current law.

A plan to transform the tax code to simplify it from seven individual tax brackets to two, as well as a repeal of the Alternative Minimum Tax.

A 25% corporate tax rate.

A requirement that the president and Congress offer respective proposals for the long-term solvency of Social Security.

The outline is similar to the two previous budgets offered by House Republicans. Ryan acknowledged that their Medicare proposal is politically sensitive.

"The other side will demagogue this issue. But remember: Anyone who attacks our Medicare proposal without offering a credible alternative is complicit in the program's demise," he wrote in a column published in Tuesday's Wall Street Journal.

In a statement, the White House criticized the Ryan plan as one that would disproportionately hurt the middle class and protect the wealthy. The White House also made clear they would oppose Ryan's Medicare overhaul. "This budget would turn Medicare into a voucher program undercutting the guaranteed benefits that seniors have earned and forcing them to pay thousands more out of their own pockets," they said. "The president still believes it is the wrong course for America."

Senate Democrats are likewise on track to vote on their budget next week. The president has not yet sent his budget request to Congress. It is not expected until early April.

The two chambers are unlikely to reconcile the competing budget plans, but approval in the House and Senate by April 15 will ensure that lawmakers can still collect their paychecks.

A law passed earlier this year mandated that lawmakers approve a budget by the April deadline or their salaries would be held in escrow until a budget was passed or the current Congress ended in January 2015.

Conclave to elect new pope begins

ROME -- The 115 voting cardinals shut themselves into the Sistine Chapel on Tuesday and began the papal conclave that will end with a successor being named for Pope Benedict XVI.

The first vote should take place within hours, but a new pope is not likely to be elected Tuesday. Not in centuries has a pope been elected on the first ballot. There will be one vote Tuesday, then four conclave votes per day starting Wednesday.

After the chanting cardinals entered the chapel, they took their oaths of secrecy by placing their hands on a book containing selections from the gospels. Next comes the traditional cry "Extra Omnes" - "Everyone out" - signaling the official beginning of the conclave.

The cardinals are expected to vote in prayerful silence. Although many use social media to connect with the faithful, everything about this historic exercise is old school. Each will receive a card with the heading "Eligo In Summum Pontifem," meaning simply "I Elect as Pope." Beneath, they hand-write their choice.

In contrast to the 2005 election that selected Pope Benedict, which came on the heels of a massively attended funeral for John Paul II, the crowds outside were sparse.

The usual mix of tourists and clergy crossed the expansive square under the threat of rain, passing Vatican TV cameras that were setting up in prime position facing the balcony on which the next pope will eventually appear. The largest groups by far were found in the always endless line of tourists waiting to enter St. Peter's Basilica.

Standing closest to the St. Peter's balcony, pressed up against a barricade, was the Herrera family from Queretaro, Mexico. In contrast to the throngs of vacationers, they made the trip to Rome solely to see the new pope elected.

"We are Catholics, and this moment means a lot to us," said Monica Herrera, flanked by her husband Ernesto and young daughter Regina. Behind them hung a Mexican flag. They plan to stake out this prime spot for as long as the conclave lasts in order to be front row when history is made.

"John Paul had a lot of charisma and Benedict was very scholarly, so the next pope has big shoes to fill," she said. "He'll have to be modern, and have the strength to confront the church's many issues. We are in a moment of crisis now."

As to who might ascend to the throne of St. Peter, Herrera's bet is "on an Italian," she said with a smile. "I think after a German and a Polish pope, they want it back."

The cardinals charged with making that decision on behalf of the world's 1.2 billion Catholics attended a special Mass in St Peter's Basilica on Tuesday. In his homily, Cardinal Angelo Sodano, dean of the College of Cardinals, referred to the "beloved and venerated" Benedict XVI and his "brilliant" pontificate.

After each vote, the Vatican will release smoke to reveal whether or not a pope has been elected. When a decision is made, white smoke will be released. New chemicals are being added this year to make the no-decision smoke jet black. There was some confusion in 2005 when black smoke did not appear very dark.

"You can expect black smoke" Tuesday, said Vatican spokesman Federico Lombardi, drawing his confidence from a long history of day-one duds. "The first conclave vote rarely has a positive result."

Still, the first day "establishes the spiritual aspects of the conclave," said Matthew Bunson, a religious scholar and author of We Have a Pope! Benedict XVI. "That happens through the procession into the Sistine Chapel and the constant prayers asking for the guidance of the Holy Spirit."

But perhaps more significantly, it clues cardinals in to who's trending.

"They learn from that first vote who the leading contenders are and what level of backing they have," said Bunson, noting that Cardinal Joseph Ratzinger's strong support at the outset of 2005's conclave led to him becoming Pope Benedict in just four ballots.

"If someone gets lots of votes on the first ballot, the momentum could take hold and this could be over quickly," said Thomas Reese, analyst for the National Catholic Reporter, adding that the winner will need two-thirds -- or 77 -- of the 115 votes. "On the other hand, if someone gets to 60 fast, but then stalls, that could require a lot of negotiations to see who's going to compromise on their candidate."

Reese said what partly paved the way for John Paul II's revolutionary election as a Polish pope was that votes were split between the two leading Italian cardinals, resulting in a winning third path. Although presently Milanese Cardinal Angelo Scola is often mentioned as among the leading "papabili," U.S. Cardinal Timothy Dolan of New York also received his share of press of late.

But whenever the new pope is elected, spokesman Lombardi warned that it may take a while before the throngs of faithful and tourists waiting in St. Peter's Square see the new pontiff. That's because the next man to sit on the throne of St. Peter plans to stop in the Pauline Chapel to pray before alighting on the balcony to face the masses.

"It could take longer than last time," when it was almost an hour before Pope Benedict appeared, Lombardi said. "Especially if the new pope immerses himself in prayer."

Monday morning workers readied that famous balcony for its big moment, putting up massive red velvet curtains with a crane while bystanders snapped photos.

Meanwhile, deep inside the labyrinthine recesses of the powerful but troubled city-state, the nearly 100 people who will assist in the conclave - from priests to drivers - swore an oath of secrecy.

That vow echoes the elaborate technological measures being taken to prevent digital information from entering or leaving the Sistine Chapel, perhaps the world's most historic and valuable polling station. Those include the installation of cell jamming devices and even raising the floor of the 15th-century building.

What politicking does occur between balloting sessions will be contained to walks, dinners and late-night chats at the Casa Santa Marta, a five-story building inside the Vatican's imposing walls that houses all of the red-robed electorate. But when there finally is a majority vote, the world will know thanks to smoke signals.

Out of the thinnest of capped chimneys, mounted specifically for the conclave, black or white smoke will pour. Two stoves actually were installed in the Sistine Chapel for the conclave. One is for burning the ballots - previously, wet straw was added to create a blacker smoke, but the method was found lacking - and the other is for burning a special mix of chemicals that should definitively create the right color.

Far from the bustle and tourism of the Basilica, retired bus driver Pietro Boccamazzi, 77, goes to church ever day at Rome's St. Anastasia Church. "I love whoever is pope," he said, but added that an Italian pope would be best. "No disrespect disrespect to other nations. But the church is here (in Italy) for a reason."

In 2005, Benedict's winning ballot took far longer to convey than anticipated. To begin with, the white smoke looked gray. And the Vatican bells that traditionally ring in the election of a new pope stayed silent because the bell-ringer was waiting for clearance from a high-ranking official. Let the drama begin.

Ohio: Sealed criminal-case rate higher in some college towns

CINCINNATI -- A newspaper reports judges in some small Ohio college towns seal a larger proportion of criminal records from the public than some courts in larger metro areas where a college represents a smaller segment of the community.

The Cincinnati Enquirer says it analyzed court records in several college towns, including Oxford, Bowling Green, Athens and Kent.

The newspaper compared the number of sealed misdemeanor cases in some individual courts in 2012 with the number of misdemeanor cases completed last year.

The Enquirer reports that many of those cases likely include charges such as underage drinking or disorderly conduct, although it is impossible to tell what crimes are involved in sealed cases.

Misdemeanors also can include some levels of theft and domestic violence.

Middlefield: Driver shot, killed was Lake County man

MIDDLEFIELD -- Just before noon Monday, Geauga County Coroner, Dr. Robert Coleman has identified the man shot and killed by police officers Sunday.

Coleman said the man was James L. Gilkerson, 42, of Mentor-on-the-Lake.

A shooting involving police officers happened around 6 p.m. Sunday on Old State Road.

Two Middlefield police officers were shot by Gilkerson during what was believed to be a routine traffic stop. Police referred to the gun as a semi-automatic rifle.

Police say two officers pulled Gilkerson over while on patrol. Before they could exit their cruiser, he got out of his car and fired at the officers.

Officers then exited their cruiser and returned fire, killing Gilkerson.

A female officer was shot in the hand. She was taken by a University Hospitals MedEvac helicopter to MetroHealth Medical Center.

A male officer was hit in the leg by shrapnel and was taken to University Hospitals Geauga Medical Center for treatment. 

Their injuries are not life-threatening.

Sheriff Dan McClelland says nothing indicated to officers that the stop wouldn't be routine. Investigators are trying to determine what may have caused the incident to escalate so fast. 

McClelland says, at this time, they haven't been able to determine how many shots were fired.

Akron: Closing arguments start in Craigslist trial

AKRON -- Closing arguments are underway in the triple murder trial of Richard Beasley. 

Judge Lynne Callahan spent more than an hour and half detailing 128 pages of instructions for the jury.

Beasley is accused of using phony Craigslist ads to lure victims to a southern Ohio farm. He's charged with the murder of Ralph Geiger, Timothy Kern and David Pauley. He's also accused of the attempted murder of Scott Davis.

Beasley, 53, faces 26 criminal counts in total, including theft and identity fraud charges. 

Davis escaped from the Caldwell, Ohio farm and alerted authorities in the fall of 2011.

Defense attorneys have argued Beasley was a confidential informant for the Akron Police Department, against the Brothers Motorcycle Club.

They say Beasley was arranging jobs for a friend from the club who owned the Noble County property.

Beasley could face the death penalty if convicted. His teenage co-defendant Brogan Rafferty, too young to face the death penalty, already was convicted and sentenced to life in prison without chance of parole.

The jury will get the case after closing arguments finish this afternoon. The members will be sequestered until a verdict is reached.

Trumbull County: 6 dead in car accident

TRUMBULL COUNTY -- A deadly accident has claimed six lives and two remain in an area hospital.

The Ohio State Highway Patrol tells Channel 3 a Honda Passport carrying eight people went off the side of a road into a pond on Pine Avenue SE.

Troopers say six of the passengers have died. The others were taken to Saint Joseph's Health Center in Warren.

The accident happened around 7 a.m. Sunday. The Trumbull County Sheriff's Office Dive team and Ohio State Troopers Crash Reconstruction team is on the scene.

I-90 still closed as crews remove damaged bridge

CLEVELAND -- Interstate 90 remains closed in both directions as crews scramble to get a damaged highway bridge taken down after a dump truck slammed into it.

The accident happened on I-90 westbound between E. 156th  Street and E. 185th Street around 6:45 a.m Saturday.

Police say the truck from Big Blue Trucking out of Warren, Ohio, was traveling with a raised trailer when it hit the bridge. After hitting the bridge, the truck then rolled over. 

Police have closed the highway in both directions because the bridge is severely damaged.

Unsafe conditions forced the Ohio Department of Transportation to bring in another crane. Crews are rushing to dismantle the bridge but the delay in bringing the second crane may push back the reopening of Interstate 90 one more day.

ODOT wants to have the highway open by Monday morning.

"ODOT will not reopen I-90 until it is 100% safe for the traveling public to drive though this area." said Amanda Lee.

Vehicles traveling eastbound on I-90 will exit on E.152nd Street and head south to St. Clair Avenue. Then take St. Clair Avenue east to Babbitt Road. Head north on Babbitt Rd to Lakeland Boulevard. Head east on Lakeland to get back onto I-90 eastbound. 

Vehicles traveling westbound are asked to exit at E. 260th Street to Babbit Road, north to St. Clair Avenue and onto E. 152nd to access I-90.

Jennifer Ciaccia with the Cleveland Police Department tells Channel 3 the truck driver Michael Edwards, 35, will be cited for all appropriate traffic violations.

The Ohio State Highway Patrol will also be apart of the investigation.  Troopers will inspect the truck for violations.

Westlake: Police have found missing teen

WESTLAKE -- Police have found Devon Smith, a teen that was reported missing Friday evening. 

Police tell Channel 3 she was found at a neighbor's deck around noon.

Smith had minor injuries and was taken to an area hospital to be examined.

Smith attends Hathaway Brown School in Shaker Heights. The bus driver dropped her off at her bus stop right in front of her home on Muirfield Way around 4:30 p.m.

According to neighbors, she did not have her cell phone on her.

People were searching the area throughout the day Saturday but weren't able to locate the girl.

Westlake Police and the FBI assisted to find the girl.

Westlake Police asking for help finding missing teen

WESTLAKE -- Police are asking for help finding a missing teen.

Devon Smith was reported missing Friday evening. 

Smith goes to Hathaway Brown School in Shaker Heights. The bus driver dropped her off at her bus stop around 4:30pm.  Devon never made it inside her home.

Devon is in the 8th grade and is described as 14-years-old, 5'6", 120 pounds with shoulder length brown curly hair. Devon was wearing a blue Hathaway Brown sweatshirt, grey jeans, tan topsider-style shoes, a quilted black jacket and a green backpack.

Dump truck crashes into bridge, closes I-90

CLEVELAND -- Interstate 90 has been closed down after a dump truck crashed into a bridge.

The accident happened on I-90 westbound between E. 156th  Street and E. 185th Street around 6:45a.m.

Police say the truck was traveling with a raised trailer when it hit the bridge causing the truck to roll over. 

Police have closed the highway in both directions because the bridge is severely damaged.

Travelers are asked to avoid the area entirely.

Vehicles traveling eastbound on I-90 will exit on E.185th Street or sooner. People asked to travel south to St. Clair Avenue to E. 152nd Street to access I-90.

Vehicles traveling westbound are asked to take Interstate 271 or Interstate 480.

If you are taking Interstate 77 or Interstate 71 you are asked to take Interstate 480 to go east.

ODOT is on scene and says the bridge maybe closed down for the weekend.

There are no serious injuries or fatalities being reported at this time.

So much of our weather, here in northern Ohio, is dependent upon from which direction the wind is blowing.

A northerly wind will keep the Lake's influence in play, while a southerly wind takes the Lake out of the picture.  With an east wind, we receive down sloping air from the Appalachians, which can give us a small warming affect.  A west wind will keep the Lake in play for some areas, especially those to the east of Cleveland and north of US-422.

Friday will feature a mix of Sun & Clouds & it will still be Chilly.  High: 38.  Wind: North 5-10 mph.

Clearing & Cold Friday night.  Low: 25.  Wind: NW 5 mph.

Saturday will be Partly to Mostly Sunny & Milder, because the wind starts shifting to the SE 5-10 mph.  High: 46.

Increasing cloudiness but not as cold Saturday night.  Low: 38.  Wind: SE 10-15 mph.

Sunday will be Cloudy, Windy & Warmer with scattered late-day showers.  High: 55.  Wind: South 15-20 mph.

Rain showers will continue Sunday night & Monday, as the Front & the waves of Low Pressure that ride along the Front, SLOWLY slides to the east.  High Monday: 46, with temperatures falling as the Front goes past.

We'll see a mix of Rain & Snow Showers Monday night & Tuesday.  High Tuesday: 39.

Another weak system will slide across the lake on Wednesday, bringing us a few scattered snow showers.  High: 40.

Vatican: Conclave to start Tuesday

VATICAN CITY  --  Cardinals have set Tuesday as the start date for the conclave to elect the next pope, signaling that they were wrapping up a week of discussions about the problems of the church and who best among them might lead it.

The conclave date was set on Friday afternoon during a vote by the College of Cardinals. Tuesday will begin with a Mass in the morning in St. Peter's Basilica, followed by the first balloting in the afternoon.

In the past 100 years, no conclave has lasted longer than five days.

That said, there doesn't appear to be a front-runner in this election, and the past week of deliberations has exposed sharp divisions among cardinals about some of the pressing problems facing the church, including of governance within the Holy See itself.

U.S. Cardinal Timothy Dolan, considered a papal contender, said in a blog post Friday that most of the discussions in the closed-door meetings covered preaching and teaching the Catholic faith, tending to Catholic schools and hospitals, protecting families and the unborn, and supporting priests "and getting more of them!"

"Those are the 'big issues,'" he wrote. "You may find that hard to believe, since the 'word on the street' is that all we talk about is corruption in the Vatican, sexual abuse, money. Do these topics come up? Yes! Do they dominate? No!"

Early in the week, the Americans had been pressing for more time to get to the bottom of the level of dysfunction and corruption in the Holy See's governance that were exposed by the leaks of papal documents last year. But by Thursday afternoon, Cardinal Roger Mahony of Los Angeles tweeted that the discussions were "reaching a conclusion" and that a mood of "excitement" was taking hold.

Vatican-based cardinals had been angling for a speedy end to the discussions, perhaps to limit the amount of dirty laundry being aired.

According to Vatican analysts and even some cardinals themselves, the list of papabili, or those considered to have the stuff to be pope, remains relatively unchanged from when Benedict XVI first announced he would resign Feb. 28. But some Italian media have speculated that with governance such a key issue in this conclave, the cardinals might also be considering an informal pope-secretary of state "ticket."

The Vatican secretary of state is primarily responsible for running the Holy See, but it's not an elected job like the pope. It's a papal appointment, and will be a very closely watched papal appointment this time around given the stakes.

Also Friday, the cardinals formally agreed to exempt two of their voting-age colleagues from the conclave who in past weeks had signaled they wouldn't come: Cardinal Julius Darmaatjadja, emeritus archbishop of Jakarta, who is ill, and Scottish Cardinal Keith O'Brien, who resigned last week after admitting to inappropriate sexual misconduct.

That formality brings the number of cardinal electors to 115; a two-thirds majority - or 77 votes - is required for victory. Benedict in 2007 changed the conclave rules to keep the two-thirds majority requirement throughout the voting process after Pope John Paul II had decreed that after about 12 days of inconclusive balloting the threshold could switch to a simple majority.

By reverting back to the traditional two-thirds majority, Benedict was apparently aiming to ensure a consensus candidate emerges quickly and ruling out the possibility that cardinals might hold out until the simple majority kicks in to push through their candidate. His decision might prove prescient, given the apparent lack of a front-runner in this conclave.

Lombardi said a few items of business remain outstanding, including drawing lots for rooms at the Vatican's Santa Marta hotel, where the cardinals will be sequestered once the conclave begins.

On Friday, he showed a video of the room in which the new pope will sleep his first night as pontiff; it features a bed with a heavy, dark wood headboard featuring a carved image of Christ's face. There is also a sitting area and a study.

The pope is expected to stay there for a few weeks even after the election, since the papal apartment in the Apostolic Palace must be renovated. The apartment was sealed Feb. 28, just after Benedict resigned, and cannot be reopened until the new pope formally takes possession of it.

Lombardi explained that after an eight-year papacy, certain plumbing and electric maintenance work that had been put off must be carried out - work that cannot begin, however, until the seal on the doors is broken.
